HomeMy WebLinkAboutResolution - 1738 - Urban Renewal Agency Transfer, Creates LNR Office & NRC - 06_28_1984RESOLUTION 1738 - 6/28/84 RESOLUTION A RESOLUTION TRANSFERRING THE URBAN RENEWAL AGENCY STAFF ACTIVITIES AND FUNCTIONS TO THE STAFF OF THE CITY OF LUBBOCK; AUTHORIZING THE CREATION OF A CITY OF LUBBOCK NEIGHBORHOOD REDEVELOPMENT OFFICE; AND PROVIDING FOR THE CREATION OF A NEIGHBORHOOD REDEVELOPMENT COMMISSION TO BE COMPOSED OF THE PRESENT BOARD OF COMMISSIONERS OF THE URBAN RENEWAL AGENCY OF THE CITY OF LUBBOCK. WHEREAS, the City of Lubbock duly passed a Resolution on the 26th day of November, 1957, authorizing the Urban Renewal Agency of the City of Lubbock to exercise Urban Renewal powers as authorized by Vernon's Ann.Civ.St., art. 1269L-3, a copy of which Resolution is attached hereto as Exhibit A; and WHEREAS, the City of Lubbock has undertaken a study to determine the legal and operational feasibility of transferring the Urban Renewal Agency staff activities and functions to the City of Lubbock; and WHEREAS, after reviewing such study, the City Council of the City of Lubbock has determined that it is legally, economically and operationally feasible to transfer the Urban Renewal Agency staff activities and func- tions to the City of Lubbock; and WHEREAS, the City Council of the City of Lubbock has determined that there are several advantages to transferring the Urban Renewal Agency staff activities and functions to the City of Lubbock; those advantages include the elimination of duplication of activities, and better coordination of all housing related activities, which will result in less confusion and more convenience for the citizens of the City of Lubbock and will reduce administrative expenses thereby providing more aid to the citizens of the City of Lubbock; and WHEREAS, the City Council of the City of Lubbock has determined, due to the above reasons, that it is in the best interest of the citizens of the City of Lubbock for the City to provide staff activities and functions rather than have such activities and functions performed by a separate Urban Renewal Agency staff; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to create a Neighbor- hood Redevelopment Office of the City of Lubbock and a Neighborhood Redevelopment Commission of the City of Lubbock; and WHEREAS, the City Council of the City of Lubbock deems it desirable and in the best interest of its citizens to avail itself of the expertise of the present Commissioners of the Urban Renewal Agency of the City of Lubbock by appointing them also as the members of the Neighborhood Re- development Commission of the City of Lubbock; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT from and after August 2, 1984, all Urban Renewal Agency staff activities and functions authorized by Vernon's Ann.Civ.St., art. 1269L-3, shall be exercised by the City of Lubbock, a home rule municipal corporation, through its Neighborhood Redevelopment Office. SECTION 2. THAT to assist in the exercise of Urban Renewal project powers in the City of Lubbock, there shall be created a commission to be known as the Neighborhood Redevelopment Commission of the City of Lubbock, which Commission shall be hereafter created by Resolution of the City Council. SECTION 3. THAT the members of the Commission of the Urban Renewal Agency shall constitute and compose the membership of the Neighborhood Redevelopment Commission, but they also shall retain the authority granted to them by Vernon's Ann.Civ.St., art. 1269L-3, and the City Council of the City of Lubbock through its Resolution of November 26, 1957. SECTION 4. THAT there be created a Neighborhood Redevelopment Office of the City of Lubbock, for the purpose of planning, developing, implementing, operating and administering the following: a. An aggressive neighborhood revitalization strategy for neighbor- hood stabilization; b. Approaches toward diminishing the effects of displacement upon residents of the City; c. Programs for targeting housing assistance within the City; d. Disposition plans for urban renewal lands; e. Projects of housing rehabilitation, and other projects and programs involving neighborhood revitalization, and f. Other functions as assigned by the City of Lubbock. SECTION 5. THAT in order to insure a smooth and orderly transfer of Urban Renewal Agency staff activities and functions to the City of Lubbock, the City Manager shall appoint a transition team to plan, imple- ment and monitor the necessary activities involved in the transfer. WAS SECTION 6. THAT the transition shall follow as closely as possible - the following proposed timetable: a. Prepare preliminary draft for transition task and implementation procedures. July 1-8 b. Final draft review by Deputy City Manager and Assistant City Manager. July 12 C. Final City Council action. July 12 d. Begin Transition. July 13 e. Transition Complete. August 2 SECTION 7. THAT to provide for an orderly transition, the Urban Renewal Agency will make all files, documents, contracts and other infor- mation now in its control, available to the City of Lubbock no later than July 1, 1984. WHEREAS, the City Commission by Resolution on August 22, 1957, ordered that notice of public hearing to be held on October 25, 1957, be published in the August 25, 1957 and September lot, 1957 issues of the Lubbock Avalanche - Journal, the official newspaper of the City of.Labbock, the purpose of said public hearing being to -consider whether or not the City Conniiission would order an election by the qualified voters of the City of Lubbock to determine whether said voters approved the passage by the City Commission of an Urban Renewal Resolution substantially as set forth in the body of this Resolution; and.. WHEREAS, said notices were duly published in the Lubbock Avalanche - Journal in Lubbock, Texas, and said public hearing was duly convened in City Hall, Lubbock, Texas, by the City Commission at 9:00 A. M., C. S. T. on October 25, 1957, and the City Commission determined that said election should be ordered to be held on November 26, 1957, from 7:00 A. M., C. S. T..' to 7:00 P. M. in the City of Lubbock, Texas, said determination being made after all persons present at said public hearing were given an opportunity to speak for and against the proposal; and, WHEREAS, said election was duly held in the City of Lubbock, Texas, on November 26, 1957 and after canvassing the votes of said election, the City Commission found that by a vote of 1181 in favor of adoption and 160 against adoption, the majority of the voters of the City of Lubbock voting at sai election favored the adoption by the City Commission of an Urban Renewal Resolution substantially as..Metforth in the body of this Resolution, and also sub- stantially as set forth in said notices of hearing, published in the Lubbock Avalanche -Journal as aforesaid and also substantially as set forth in the form of ballot prescribed in the Special Urban Renewal Election Ordinance (Ordinance No. 2340 of the City of Lubbock) which was passed by the City Commission on October 25, 1957; and the City Commission further finds that all conditions precedent to passage and adoption of this Resolution have been duly done and performed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK- SECTION 1. It is hereby found and determined that one or -more slum or blighted areas exisisin the City of Lubbock. SECTION 2. It is hereby further found and determined that the rehabilitatior4 eonservation,or slum clearance and redevelopment or a combination thereof, of such slum or blighted area or areas, is necessary in the interest of public health, safety, morals or welfare of the residents of said City. -•Page One - UCTION 3. It is hereby further determined that the City of Lubbock shall exercise the powers granted to the City by the Urban Renewal Law of the State of Tex"# except the Urban Renewal Project Powers as defined in said Urban Renews] UCTION 4. It is hereby further determined to be necessary and in the public interest that the City of Lubbock elect, and, accordingly, the City hereby elects to haye said Urban Renewal Project Powers exercised by the Urban Renewal Agenc of the City of Lubbock, which agency is created by said Urban Renewal Law. OLCTION S. The findings, determinations, and elections herein made are made in accordance with and the various terms used herein are used in the same sense a0 used or defined in said Urban Renewal Law.
