HomeMy WebLinkAboutResolution - 1421 - Special Election To Fill Unexpired Term Of Mayor - 07_05_1983RESOLUTION 1421 - 7/5/83 DGV/mck RESOLUTION WHEREAS, the death of Mayor Bill McAlister on June 27, 1983, has created a vacancy on the City Council of the City of Lubbock; and WHEREAS, the City Charter of the City of Lubbock requires that such vacancy be filled by special election; and WHEREAS, the next available election date under Section 2.Olb of the Texas Election Code is the second Saturday in August; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor is hereby authorized and directed to execute an Order and Notice of Special Election setting such special election to fill said vacancy on the City Council on Saturday, August 13, 1983, and THAT the City Attorney is hereby authorized and directed to seek expedited consideration of such special election upon presubmission of such matter to the U.S. Attorney General. HENRY,44AYOR ATTEST: Evelyn Gaf ga, City c e y-Treasurer APPROVED AS TO FORM: ver, Assistant City Attorney THE STATE OF TEXAS COUNTY OF LUBBOCK CITY OF LUBBOCK ORDER AND NOTICE OF SPECIAL CITY ELECTION ELECTION ORDER I, Alan Henry, currently discharging the duties of Mayor of the City of Lubbock, Texas, by virute of the authority vested in me by law, and according to Charter provisions and the Texas Election Code, do hereby order that a Special Election be held in the City of Lubbock, Texas, on the 13th day of August, 1983, said date being the second Saturday in August, for the purpose of electing the following officer of the City of Lubbock due to the death of Mayor Bill McAlister on June 27, 1983: MAYOR (unexpired term) Said election shall be held at the places in the City of Lubbock herein- after designated as voting precincts and voting places on Exhibit A attached hereto and made a part hereof for all intents and purposes. Polling places shall be open from 7:00 A.M. to 7:00 P.M. and all electors shall vote in -the precinct of their residence unless otherwise provided herein. Electronic voting machines shall be used for this Special City Election. The persons set forth in Exhibit B, which is attached hereto and made a part hereof for all intents and purposes, are hereby appointed Judges and Alternate Judges to hold said Special City Election on August 13, 1983. Each Presiding Judge so named is authorized to appoint not less than two clerks and as many additional clerks as are required, but not exceeding a total of six clerks, for the proper conduct of the election. The Alternate Judges shall serve as Presiding Judges in the event that the regularly appointed Presiding Judge is unable to serve, and the Alternate Judge shall be appointed by the Presiding Judge to serve as one of the clerks in the event that the election is conducted by the regularly appointed Presiding Judge. ELECTION NOTICE The City Secretary is hereby ordered and directed to cause notice of this Special City Election to be given by the alternative method of publishing this Order and Notice of Special City Election in English and Spanish at least one time, not more than 25 days nor less than 10 days before the election, in at least one daily newspaper published within the City of Lubbock. Following such publication, the City Secretary shall file with the County Clerk a copy of the notice as published, together with the name of the newspaper or newspapers and the dates of publication. The City Secretary shall serve a duly certified copy of this Election Order and Notice of Special City Election upon each of the Presiding Judges and Alternate Judges named in Exhibit B. Such service shall be by United.States mail or by personal delivery within 20 days after the date of execution of this Order and Notice of Special Election.
