HW:da RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Special Warranty Deed in favor of Clyde D. Smith, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. SMITH, hereinafter called "GRANTEE", in cash, the receipt and sufficiency of which is hereby acknowledged and confessed, and for the payment of which no right or lien, express or implied is retained: Has GRANTED, SOLD and CONVEYED, and by these presents does GRANT, SELL and CONVEY unto the said GRANTEE all that certain tract and parcel of land lying and being situated in Lubbock County, Texas, as follows: BEGINNING at the southeast corner of Tract "C", Texas Avenue Addition to the City of Lubbock, Lubbock County, Texas; THENCE west along the south line of Tract "C" a distance of 22 feet to a point; THENCE along a curve in a northeasterly direction a distance of 121.16 feet to a point on the south property line of alley south of 29th street; said curve has a radius of 505 feet and subtends an angle of 13°-44'-47"; THENCE east along the south line of alley a distance of 40.54 feet to a point; said point is 41 feet west of the northwest corner of Lot 12, Texas Avenue Addition; THENCE along a curve in a southerly direction a distance of 124.50 feet to the point of beginning; said curve has a radius of 1382.69 feet, subtends an angle of 5°-V -32", and center of arc is located S 720-2'-42" E 1382.69 feet from beginning point of curve; TO HAVE AND TO HOLD the above described premises, together with all and singular the rights and appurtenances thereto in anywise belonging to the said GRANTEE, his heirs and assigns forever, and the said GRANTOR does hereby bind itself, its successors and assigns to WARRANT AND FOREVER DEFEND all and singular the said premises unto the said GRANTEE, his heirs and assigns against every person whomsoever lawfully claiming, or to claim the same, or any part thereof by, through, and under GRANTOR.
