Sherwin, Assistant City Attorney RESOLUTION 1333 - 3/10/83 Q+� Amends Reso. 1145, 7/22/82 APR 1Tv �_(R,_ ADDENDUM TO CONTRACT FOR PROFESSIONAL CONSULTING AND DESIGN SERVICES IN CONNECTION WITH THE CANYON LAKES RIVER WALK PROJECT WHEREAS, the CITY OF LUBBOCK, TEXAS, hereinafter called "CITY", and GROVES, FERNANDEZ, FRAZER AND ASSOCIATES, INC., hereinafter called "CONSULTANT" entered into an agreement on July 22, 1982, for the performance of professional consulting and design services in connection with the development plan for the CANYON LAKES RIVER WALK PROJECT; and WHEREAS, the CITY and CONSULTANT desire to amend said agree- ment by adding thereto provision for the MASTER DEVELOPMENT PLAN for MacKENZIE PARK; NOW THEREFORE, for the consideration herein expressed and mutual covenants herein contained, the CITY and CONSULTANT do hereby agree as follows: I. The CONTRACT FOR PROFESSIONAL CONSULTING AND DESIGN SERVICES IN CONNECTION WITH THE CANYON LAKES RIVER WALK PROJECT and EXHIBIT A thereto, hereinafter called "CONTRACT", entered into on July 22, 1982, between the CITY, acting by and through its mayor thereunto duly authorized pursuant to Resolution 1145 of the City Council of the City of Lubbock, and CONSULTANT are hereby incorporated into this ADDENDUM and made a part hereof for all purposes. II. The Contract is hereby amended by adding thereto Article XI entitled THE MASTER DEVELOPMENT PLAN FOR MacKENZIE STATE PARK which shall provide as follows: ARTICLE XI THE MASTER DEVELOPMENT PLAN FOR MacKENZIE STATE PARK SCOPE OF SERVICES The CONSULTANT shall prepare a Master Development Plan for MacKenzie State Park, hereinafter called "Park", in accordance with the Scope of Services which is enumerated below and made a part of this contract. I. TASK ONE 1. THE PRELIMINARY TASK 1.1. BASE DATA GATHERING 1.1.1. City will furnish to CONSULTANT a site survey of the Park including all existing improvements, trees, utilities, and topography. 1.1.2. The Park Department Staff of CITY, hereinafter called "Staff", will supply to CONSULTANT data pertaining to attendance, past use problem areas, maintenance considerations, traffic problems and various other factors concerning the Park that would influence design considera- tions. 1.1.3. CONSULTANT will assimilate the various elements of information as presented. 1.2. SITE ANALYSIS 1.2.1. CONSULTANT shall perform a systematic and complete analysis of existing features of the Park to include facilities, pedestrian and vehicular circulation, ingress and egress, visual attractions, views good or bad, vege- tation and other features that would influence planning decisions. 1.2.2. As a result of the site analysis of the Park, CONSULTANT shall chronicle all aspects of the site as part of the base data. 1.3. COUNSEL AND STAFF CONFERENCES 1.3.1. A preliminary meeting will be held with the Staff so that they may become acquainted with the CONSULTANT and with the manner in which they may become involved. The CONSULTANT will also receive input and suggestions at this time. II. TASK TWO 2. THE DESIGN TASK 2.1. THE PRELIMINARY DESIGN 2.1.1. This is the task in which the preliminary plan evolves predicated upon base data, conferences, input from the Staff and studies and design judgments of the CONSULTANT. 2.1.2. The preliminary plan will be a working plan drawn to a mutually agreeable scale. The pre- liminary plan will be detailed to the extent that all proposed elements are portrayed in order that decisions can be made concerning all proposed elements. 2.1.3. Presentation and review of the preliminary plan will be made in Lubbock at a mutually agreed upon time. 2.1.4. Decisions concerning the preliminary plan will establish guidelines for finalizing into the final plan. 2.2. THE FINAL MASTER DEVELOPMENT PLAN 2.2.1. CONSULTANT shall prepare the final Master Development Plan which will be a scale working plan that will show the arrangement of all elements of the Park, both existing elements which are to remain, as well as all proposed elements of the long range plan. 2.2.2. In areas where new facilities are to be con- structed, CONSULTANT will delineate these facilities spatially in the Master Plan. CON- SULTANT shall not be obligated to include detailed site planni.r,g for future proposed facilities; however, CONSULTANT will indicate on said Master Plan circulation, pedestrian and vehicular, as well as parking areas, in a general configuration. 2.2.3. The Master Plan will accurately depict elements in order to furnish a working guideline for future construction and development. 3. THE FINAL PLAN PRODUCT, SUMMARY 3.1. CONSULTANT shall provide a reproducible of a Master Plan drawn to scale as a working plan to guide re- development and new development with all elements as indicated above. 3.2. CONSULTANT shall provide a presentation Master Plan which will be a copy of the working master plan graphi- cally portraying the master development plan for Mac- Kenzie Park. This plan will be in color, and will be of a convenient size for mounting and public display purposes. 3.3. CONSULTANT shall produce a report accompanying the plan which will be a brief document; however, it will adequately articulate plan elements and planning ra- tionale. CONSULTANT shall include in such report recommendations concerning the long range role of Mac- Kenzie Park in relation to the total recreational resource and delivery system of the City of Lubbock. 3.4. The report will contain a cost estimate, predicated upon 1983 cost, for each of the proposed plan elements. 3.5. CONSULTANT shall furnish to CITY twenty (20) copies of the report. Should the CITY require more, CONSUL- TANT will furnish such extra copies at actual cost. 4. GENERAL CONSIDERATIONS 4.1. TIMING 4.1.1. TASK ONE: The Preliminary Task shall be completed 60 calendar days after CONSULTANT'S receipt of notice to proceed. 4.1.2. TASK TWO: The Design Task shall be completed 60 calendar days after completion of Task One. 4.2. CITIES RESPONSIBILITIES 4.2.1. The CITY shall arrange Staff conferences and work sessions at a mutually convenient time and shall provide a place for such conferences and sessions. 4..2.2. The CITY shall arrange presentations and re- views at a mutually convenient time and shall provide a place for such presentations and reviews. 4.2.3. The CITY shall provide copies of data, maps, surveys, and any existing plans at no cost to the CONSULTANT, including an adequate up-to- date survey with topography showing contours at no greater than two foot intervals, if such a survey is available to CITY. 4.2.4. Should the CITY be unable to provide an up-to- date survey including topography, an alternate mutually agreed upon solution will be acceptable. 4.3. COMPENSATION 4.3.1. The total compensation ,for all work as outlined under Article XI as set forth in this Addendum, shall be Nine Thousand Five Hundred Dollars ($9,500.00). This amount is in addition to the sum of Thirty Thousand Dollars ($30,000.00) which is enumerated in Article Six of the Contract entitled "Compensation of Consultant." The total Compensation of the CONSULTANT shall now be Thirty Nine Thousand, Five Hundred Dollars ($39,500.00). SCHEDULE OF PAYMENTS 4.3.2. Payments for performance of the Tasks set forth in this Addendum shall be made as follows: (1) $4,000.00 upon completion of Task I. (2) $5,500.00 upon completion of Task II. Such payments shall be made within forty-five (45) days after receipt by the CITY of an invoice outlining the tasks completed. This Agreement is executed this loth day of March 1983, in two counterparts, each of which is an original, on behalf of CONSULTANT by its Vice -President and on behalf of CITY by its Mayor, both of whom are thereunto duly authorized.
