RESOLUTION
A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE
SPECIAL CITY ELECTION HELD ON THE 15TH DAY OF JANUARY, 1983.
BE IT REMEMBERED THAT on the 17th day of January, 1983, the City Council
of the City of Lubbock -met at 9:00 o'clock, A.M., at the regular meeting place
of the City Council in the City Hall of the City of Lubbock, with the following
members present, to -wit:
On Motion of Councilwoman Joan Baker , seconded by
Councilman M. J. A erson , it is unanimously carried that the re-
turns of the Special City Election held January 15, 1983, for the purpose of
submitting proposed amendments to the Charter of the City of Lubbock for
adoption or rejection by the qualified voters of the City of Lubbock, be
opened and canvassed, and the results of the election declared therefrom; and
said returns having been duly canvassed, it is found that the votes for the
various amendments are as follows:
AMENDMENT NO.. 1
Amending Chapter 1, Article V, of the Charter by adding thereto a new
Section 5, which is to read as follows:
LIMITATION OF TAX LEVY
Section 5. The annual ad valorem taxes levied by the governing
authority of the City government shall not exceed the rate of $1.12 per
$100.00 valuation of taxable property.
FOR: 1640 VOTES
AGAINST: 4.jlu VOTES
AMENDMENT NO. 2
Amending Chapter 1, Article V, of the Charter by adding thereto a new
Section 6, which is to read as follows:
LIMITATION ON ASSESSED VALUATION
Section 6. The annual ad valorem taxes levied by the governing
authority of the City government shall not exceed 60 percent of the fair
market value of the property as the assessed valuation of property sub-
ject to tax.
FOR: 1565 VOTES
,AGAINST: 43R9 VOTES
AMENDMENT NO. 3
Amending Chapter 1, Article V, of the Charter by adding thereto a new
Section 7, which is to read as follows:
APPROVAL BY VOTERS ON TAX INCREASE
Section 7. The annual ad valorem taxes levied by the governing
authority of the City government shall not be increased on the basis of
an increase in the rate of evaluation of taxable property nor on the
assessed valuation of property subject to tax, from the preceding tax
year, without first securing approval of said increase at an election
submitting said proposed increase to the voters of the City of Lubbock.
Said increase, if any, requiring a majority vote for its approval.
FOR: 1755 VOTES
AGAINST: 4227 VOTES
And it further appearing that said election was duly held as provided by
law; NOW THEREFORE:
IT IS THEREFORE FOUND, DECLARED AND CERTIFIED BY THE CITY COUNCIL OF THE CITY
OF LUBBOCK:
THAT a majority of the qualified voters of the City of Lubbock voting in
said election are in opposition to Amendment No. 1; a majority of the
qualified voters of the City of Lubbock voting in said election are in oppositic
to Amendment No. 2; and a majority of the qualified voters of the City of
Lubbock voting in said election are in opposition to Amendment No. 3. There-
fore, it is declared that Amendment No. 1 is denied Amendment No.
2 is dented , and Amendment No. 3 is dented -
PASSED, APPROVED AND ADOPTED ON MOTION OF Councilwoman Baker
SECONDED BY Councilman Aderton , this 17th day of January,
1983, by the following vote:
