BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and di-
rected to execute for and on behalf of the City of Lubbock a Partial Paving Re-
lease covering certain abutting properties on Quaker Avenue as set forth in
said Release, said Release being attached herewith which shall be spread upon
the minutes of the Council and as spread upon the minutes of this Council
shall constitute and be a part of this Resolution as if fully copied herein in
detail.

PARTIAL PAYING RELEASE
STATE OF TEXAS §.
COUNTY OF LUBBOCK §
WHEREAS, the City Council of the City of Lubbock, Texas, in Resolution
1226, passed on October 14, 1982, recorded as Instrument No, 24708 'In Volume
828, Pages 383-384 (inclusive) of the Deed of Trust Records of Lubbock County,
Texas on October 21, 1982, declared the necessity for making improvements as
to paving, drainage, curb, and gutter facilities as regards Unit and Subunit
2240-40 for Quaker Avenue from South Loop 289 to 82nd Street as more fully set
forth in said Resolution; and
WHEREAS, certain abutting properties as hereinafter described need to be
released from any lien or cloud on title on such abutting properties by reason
of the fact that certain abutting properties are not and have not been assessed
for such improvements for the reasons hereinafter stated; NOW THEREFORE:
KNOW ALL MEN BY THESE PRESENTS:
In consideration of correcting the public records, any liens or clouds on
title are hereby released, quitclaimed, cancelled, and discharged to the owners
of record as their interest may appear by the City of Lubbock by reason of pas-
sage of the aforesaid Resolution and its recordation as aforesaid because no
assessments for improvements have been made or will be made pursuant to said
Resolution as against the following described properties for the reasons as
indicated below:
(1) Lot 1, Block 1, Furr-Wolf Addition to the City of Lubbock, Lubbock County,
Texas: This property will not be assessed because the curb and gutter and
full width paving will not be constructed since it is abutting State right-
of-way for Loop 289.
(2) Lots 1 and 2, Block 2, Furr-Wolf Addition to the City of Lubbock, Lubbock
County, Texas: These properties will not be assessed because prepaid
paving monies were placed with the City.
(3) Lots 1, 29, 30, 89, 90, 132, 258, 259, 354, 355 and Tracts B, D, F-1,
F-2, F-3 and F-4, Quaker Heights Addition to the City of Lubbock, Lubbock
County, Texas and a parcel of unsubdivided land described by metes and
bounds as follows:
BEGINNING at a point which bears North 0°5' West 974.60 feet and
South 89*55' West 30.00 feet from the Southeast corner of Section
10, Block E-2, Lubbock County, Texas, said point being in the West
right-of-way line of Quaker Avenue.
THENCE South 005' East along the West right-of-way line of Quaker
Avenue a distance of 146.00 feet to a point.
THENCE South 89*55' West a distance of 90.00 feet to a point.
THENCE North 0'5' West a distance of 146.00 feet to a point.
THENCE North 89*55' East of distance of 90.00 feet to the POINT
OF BEGINNING.
These properties will not be assessed because prepaid monies were placed with
the City.
The Release shall only affect the specific abutting properties herein -
;above set forth, and all liens and interests of the City of Lubbock not speci-

fically herein released are hereby retained for all purposes as evidenced by
the passage and recordation of said Resolution as hereinabove set forth.
