HomeMy WebLinkAboutResolution - 939 - Amendment #2 To Contract - TDCA - Weatherization Assistance Program - 10_08_1981O pG� DGV:js RESOLUTION RESOLUTION 939 - 10/8/81 Amends Reso. 735 and Reso. 833 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Amendment No. 2 to the contract between the Texas Department of Community Affairs and the City of Lubbock, Community Services Department, for weatherization assistance to low-income persons, which Amendment No. 2 is attached hereto to be spread upon the minutes of the Council and as spread upon the minutes of the Council shall constitute and be a part of this Resolution as if fully copied herein in detail. The Texas Department of Community Affairs, an agency of the State of Texas, hereinafter referred to as "Department", and --fity_n£ LubbQrk,- m hereinafter referred to as "Contractor", do hereby agree to contract and amend their original contract as initia,11y executed by the Executive Director of the Department effective February 1, 1981 , for the operation of a-Weatherization Assistance for Low -Income Persons project during the period of February 1, 1981 through December 31_,-1981 The total of all payments and other obligations incurred by the Department as given in Section IV. of such contract was not to exceed Fifteen.-Ibousand and no/100 Dollars ($15}000,00)with a minimum number of.dwelling units to be weatherized of SECTION II. The parties hereto agree to amend Section III (D), page 2 of 20, of the contract identified above in SECTION I., to read as follows: D. Contractor shall weatherize a minimum of __6_ eligible dwelling units under this contract. An eligible dwelling unit is a house, including a stationary mobile home, an apartment, a group of rooms, or a single room occupied as separate living quarters which is the dwelling of a family unit 1. whose income is at or below 125% of the poverty level determined in accordance with criteria established by the Director of the Office of Management and Budget; or 2. which contains a member who has received cash assistance payments under Title IV or XVI of the Social Security Act or applicable State or local law paid during the 12-month period preceding the determination of eligibility for weatherization assistance. rJ 1. PAGE 1 OF 2 SECTION III. KThe parties hereto agree to amend Section*IV (D), page 5 of 20, of the contract identifted above in SECTION I., to read as follows: D. MAXIMUM DEPARTMENT LIABILITY Notwithstanding any other provision of this contract, Department shall not be liable hereunder to Contractor in a cumulative amount greater than Thirty -Nine Thousand and no/100 Dollars 39,000.00 SECTION IV. The parties hereto agree to amend Attachment A, of the contract identified above in SECTION I., by deleting in its entirety and replacing it with Exhibit I of this amendment, which is attached hereto and herepy made a part of this amendment. SECTION V. The parties hereto agree that this amendment shall become effective on the 1st day of September , 1981. The parties hereto contract and agree that all the terms of the above named contract and all amendments thereto executed prior to -the effective date of this amendment shall _ remain in effect and shall continue to govern except to the extent that.;they conflict with this amendment. Nothing in this amendment shall be construed as authorizing a violation of federal, state or local laws or regulations as they pertain to such contract identified above in SECTION I. By the signing of this amendment, the parties expressly understand and aqree that this amendment is hereby made a part of the contract identified in SECTION I. above as thouoh it were set forth word for word herein.
