RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized
and directed to execute for and on behalf of the City of Lubbock a
contract for the drilling and developing of 25 wells in the Sandhills
Well Field to be done by Hi -Plains Drilling, Inc., attached herewith
which shall be spread upon the minutes of the Council and as spread upon
the minutes of this Council shall constitute and be a part of this
Resolution as if fully copied herein in detail.
Passed by the City Council this 24th day of —September ,1981.

WHEREAS, it is desirable to make changes in the plans and specifications
for this project;
THIS AGREEMENT WITNESSETH: In consideration of the mutual advantages
gained, the Owner and the Contractor agree to the change shown herein and in the
attached exhibits and data and the Owner and the Contractor agree that the
original contract between them shall be modified and amended to the extent herein
indicated.
IN WITNESS WHEREOF, the Owner and the Contractor have hereto set their
hands this 22nd day of October 1981

BREAKDOWN OF CHANGE
All references in the contract to amount retained from payments due
the contractor shall be changed from 10`6 to 5%.

contract with the City of Lubbock, said Contract being dated Sept, 24, 1981

under W.W.O. 11610 , and that the work and contract has been completed
according to the plans and specifications pertaining to the project and that
all labor, material, supplies and other cost including equipment, rental
and hire, and all expense items incurred in connection with said project have
been paid in full; that all liens and rights to fix liens against any part of
said project or the moneys, bonds, or warrants due the Contractdr, have been
satisfied by payment to the claimant, his authorized agent or attorney, and
full release of all recorded.liens or claims have been secured by
settlement and duly filed of record with the County Clerk of Lubbock County.
I further represent and affirm that all Federal, State and Municipal
laws were substantially complied with by me in doing and carrying out the job
and project herein referred to and that I paid applicable scale of wages,
and this affidavit is made to secure payment from the City of Lubbock to
me of the full and final moneys due me under this contract.

(27) 1981, reducing amount of retainage on monthly estimates.
The Legislature recently passed a bill whereby any contract over $400,000 awarded

81-40A-714-1017 Consider accepting well collector lines, Wells 231-240, and authorize final
(28) payment to contractor.
This is a routine acceptance.
The motion was made by Councilwoman Baker, seconded by Councilman Aderton to
accept the construction of the well collector lines, stated above, and to authorize
final payment to the contractor. Motion carried: 5 Yeas; 0 Nays. (See Reso 856,
June 25, 1981)
