A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, AUTHORIZING
APPLICATION TO THE TEXAS WATER COMMISSION FOR A WATER PERMIT FROM THE BRAZOS
RIVER IN KENT COUNTY, TEXAS, AND RELATED MATTERS.
WHEREAS, the City of Lubbock, Texas needs an additional supply of water
for the domestic and municipal uses of the water supply customers of the City;
and
WHEREAS, the City of Lubbock proposes to build a dam and reservoir and
diversion project on the Brazos River in Kent County, Texas, which will provide
the City with an additional supply of water for domestic and municipal uses;
and
WHEREAS, the Rules of the Department of Water Resources require that
applications for a permit be signed by a duly authorized official of the City;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK,
TEXAS, THAT:
1. The Mayor of the City of Lubbock is hereby authorized on behalf of
the City Council to sign such applications as necessary to be made to the
Texas Water Commission for a permit authorizing the appropriation of
public water from the Brazos River.
2. The Mayor of the City of Lubbock is hereby authorized and directed on
behalf of the City Council to file the application with the Commission,
appear and arrange for the appearance of persons representing the City of
Lubbock at the hearing and other proceedings on the application before the
Commission, and otherwise direct prosecution of the application on behalf
of the City.

Water which is diverted but not consumed as a result
of the above stated use will be returned to the City's
sewage treatment plant, on the North Fork of the
Double Mountain Fork of the Brazos River, Brazos
River Basin.
The secondary use of treated sewage effluent for
irrigation is necessary under waste discharge
Permit No. 10353. A total of approximately 10,000
acres of land in Lubbock and Lynn Counties will be
utilized for this purpose. There will be no return
flow from the secondary irrigation use.
D. Surplus Water
Water which is diverted but not used beneficially
will be returned to the South Fork of the Double
Mountain Fork of the Brazos River at a point S 040
45' E (bearing) 3,500 feet (distance) from the
northwest corner of Section 55 of Block 5 of
Houston and Great Northern Railroad Co. Original
Survey, Abstract No. 120, Kent County, Texas.

4. General Information:
A. The proposed works will be located on land acquired
by eminent domain.
B. Irrigation is contemplated only as a secondary use
in connection with the treatment/disposal of effluent
from the City's municipal sewage treatment plant. In
order to allow the necessary flexibility to successfully
dispose of effluent in this manner, the City requests
to be considered a water supplier so that irrigation
rights do not attach to the irrigated lands.
C. If a permit for the appropriation is granted, either
in whole or in part, construction works will be begun
within two years after such permit is issued. The
proposed work will be completed within five years
from the date of issuance of permit.
5. Maps, plats, and drawings accompanying the original
application, as required by the Commission's Rules,
are incorporated herein.
