Health Department and Texas Tech University School of Nursing, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. City Attorney RESOLUTION 872 - 7/23/81 • AFFILIATION AGREEMENT riTY SrrPETARY•TREASURER THE STATE OF TEXAS § COUNTY OF LUBBOCK § THIS AGREEMENT MADE AND ENTERED INTO this 26th day of May, 1981, by and between the City of Lubbock, Texas, acting by and through the Lubbock City Health Department, hereinafter called "Health Department," and Texas Tech University School of Nursing, hereinafter called "University." WHEREAS, the Health Department operates health care facilities at Lubbock, Texas, and WHEREAS, the University operates a nursing school, and WHEREAS, the Parties desire to advance nursing education and aid in meeting the ever increasing demand in the State and Nation for trained health manpower, and to make available better health service to patients, and WHEREAS, it is deemed advisable and to the best interest of the Parties to establish an affiliation for the purpose of carrying out these objectives, NOW, THEREFORE, for and in consideration of the foregoing and in further consideration of the mutual benefits, the Parties hereto agree as follows: 1. Term. The term of this agreement shall begin on the date of its execution and shall continue for an indefinite period provided, however, that either Party shall have the right to terminate the agreement on twelve months written notice to the other Party. 2. Understanding. a. The Health Department will -- i. Allow the use of its facilities for the education of nursing students. ii. Provide some staff supervision, in conjunction with full- time faculty from the University, for students in nursing education programs. iii. Provide access for faculty and students to patients and their clinical records at the Health Department as part of their clinical training program. iv. Review periodically the specific programmatic efforts and number(s) of students to participate at the Health Depart- ment, both factors being subject to mutual agreement of the Signatory Parties. V. Maintain responsibility for policies and administrative guidelines to be used in the operation of the Health Department. vi. Encourage its staff to participate in the educational activities of the University. vii. Participate in annual Program Review activities of the School of Nursing, which are directed toward continuing program improvement. b. The University will -- i. Maintain the authority and responsibility for nursing education programs for its students which may be conducted within the Health Department. ii. Consider for clinical and/or adjunct faculty appointment those members of the Health Department staff who contri- bute significantly to the educational programs subject to academic standards and rank used by the University. iii. Adhere, by its faculty and students, to the Health Depart- ment policies and procedures when in attendance at the Health Department. Jv. Provide faculty participation on committees and task forces of Health Department. 3. Research. It is understood that clinical research programs based at the Health Department may be encouraged in order to strengthen the academic program and will be subject to rules and regulations of the University in developing such programs. This does not mean that the Health Department is prohibited from developing research programs of its own, not related to the academic program of the University. Research programs will not be initiated prior to approval of Signatory Parties. 4. Claims. The City of Lubbock shall be responsible for all claims, damages, losses or expenses incurred by reason of any negligent acts of its employees and will hold the University harmless in such situations. The University shall be responsible for all claims, damages, losses or expenses incurred by reason of any negligent acts of its employees or students and will hold the City of Lubbock harmless in such situations.
