HomeMy WebLinkAboutResolution - 2022-R0486 - Voluntary Substandard Structure Demolition GrantResolution No. 2022-RO486 Item No. 7.15 November 16, 2022 RESOLUTION WHEREAS, the City Council of the City of Lubbock finds that it is in the best interest of the health, safety and welfare of the citizens of Lubbock to provide a program to reduce the number of structures that violate the City of Lubbock (the "City") health and safety codes within the City; and WHEREAS, the Voluntary Substandard Structure Demolition Grant Program (the "Program") would provide for a criteria for City Code officers to identify qualifying structures and provide the incentive for owners of such structures to voluntarily permit demolition of the structures by the City; and WHEREAS, the City Council finds that the creation of the Program and enactment of the Policies related thereto provide a public purpose and benefit to the citizens of the City by decreasing the number of unsafe and unsound structures within the City, NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council hereby adopts the Voluntary Substandard Structure Demolition Grant Program for the City of Lubbock. Said Program policies are attached hereto and I incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by the City Council on ATTEST: j W � jy Re ecca Garza, City Secretary APPROVED AS TO CONTENT: Erik Rejino, Assistant City Manager APPROVED AS TO ims, Deputy City Attorney November 16, 2022 TRA A , MAYOR RES.Voluntary Substandard Structure Demolition Grant Program Resolution No. 2022-R0486 Voluntary Substandard Structure Demolition Grant Overview This purpose of this grant program is to allow the City of Lubbock to demolish substandard structures and dangerous buildings in an efficient and economical manner by obtaining the consent of the property owner. Consent of the property owner allows the City not to involve the Substandard Structure Commission or Municipal Court, which expedites the process to demolish a substandard structure. The grant program focuses on primary dwelling structures that are considered substandard in nature. The program will pay for up to $7,500 for the demolition and related expenses of a substandard structure. The funds will be available on a first come first serve basis at the sole discretion of the City of Lubbock and will be available so long as funds are available for this purpose. Grant Eligibility • Structure must be a primary dwelling inside the City limits of Lubbock. Secondary structures may be eligible at the sole discretion of the City of Lubbock. • Structure must be dilapidated, substandard, unfit for human habitation, a hazard to the public health, safety and welfare, constitutes an urban nuisance, and cannot be repaired without substantial reconstruction. • Legal property owner of record must execute a demolition agreement with the City of Lubbock. • The legal property owner shall have the legal authority to consent to the demolition of any structure on the property. • The legal property owner shall either be the sole interest holder of the property and/or shall obtain consent for a demolition from all persons or entities that have a legal interest in the property, including, but not limited to, lien holders and cotenants. • Any property where all interested parties to the property cannot be obtained shall be ineligible for this program. • City staff shall obtain a completed title search for any potential property to determine potential ownership prior to program eligiblilty. Grant Details • Grant will pay for up to $7,500 of the demolition of the structure. • Grant will be paid directly to the contractor of the City's choice. • All grants are awarded at the sole discretion of the City of Lubbock continent on the availably of budgeted funds. • No demolition lien will be applied to the property.
