QQ A RESOLUTION OF THE CITY OF LUBBOCK, TEXAS, AS THE REGULATORY AUTHORITY
UNDER VERNON'S ANN.CIV.STAT., ART. 1446c, AS TO RATE APPLICATION BY SOUTH
PLAINS ELECTRIC COOPERATIVE, INC.
WHEREAS, the South Plains Electric Cooperative, Inc., filed its Rate
Application with the City of Lubbock, Texas, on the 23rd day of November,
1979; and,
WHEREAS, the Regulatory Authority on the 20th day of December, 1979, by
resolution, suspended the operation of such proposed rate schedules for a
period of 120 days beyond the date on which such schedules would otherwise go
into effect; and,
WHEREAS, by continuances granted heretofore by the Regulatory Authority,
this Public Hearing as been continued until this date; and,
WHEREAS, no customer or other interested party has filed comlaint as to
such proposed rates with the Regulatory Authority; and,
WHEREAS, the documentation supporting such rate schedule required by law
has been presented to the Regulatory Authority; and,
WHEREAS, upon such documentation and recommendations of staff no evidence
has been presented to the Regulatory Authority that would indicate that such
proposed rates were unreasonable under Vernon's Ann.Civ.Stat., art 1446c; and,
WHEREAS, upon consideration of all matters properly before it the Regu-
latory Authority at public hearing finds that no finding that such proposed
rates (as modified) are unreasonable is appropriate, and that it would be
appropriate to withdraw its suspension of the operation of such proposed rate
schedules for a period of 120 days beyond that date on which such schedules
would otherwise go into effect, as enacted by resolution dated the 20th day of
December, 1979; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, SITTING AS
THE REGULATORY AUTHORITY:
Pursuant to the provisions of Vernon's Ann.Civ.Stat., art. 1446c, the
Resolution of the City of Lubbock, Texas, dated the 20th day of December,
1979, which suspended the operation of the Rate Application of South Plains
Electric Cooperative, Inc., as filed with the City of Lubbock, Texas, on the
23rd day of November, 1979, for a period of 120 days beyond the date on which
such schedules would otherwise have gone into effect; should be, and is hereby,
withdrawn and repealed.
That by this action South Plains Electric Cooperative, Inc., shall be
entitled to place into effect such proposed rates schedules, as modified by
letter dated April 2, 1980, as are identical to and consistent with those rate
schedules approved by the Public Utility Commission of Texas, at such time and
date hereafter as may be consistent with their system -wide effective application
of such proposed rates.
ADOPTED by the City Council of the City of Lubbock, this the 24th day of
April, 1980.
