HomeMy WebLinkAboutResolution - 398 - Desire To Terminate Contract - TDCA - #48006480, YACC Grant - 01_24_1980() IILGB/pg RESOLUTION #398 - 1/24/80 1' a1U 1 RESOLUTION WHEREAS the City of Lubbock seeks worthwhile social programs to benefit its citizens for which reason it entered into a contract with the Texas Department of Community Affairs to establish a Young Adult Conservation Corps in Lubbock, and WHEREAS the Parks and Recreation department and other staff of the City of Lubbock have invested in excess of 100 budgeted man-hours in a concerned effort to help our citizens and operate within the program's guidelines. WHEREAS the City of Lubbock finds the program guidelines to be so restricted as to be self defeating, in particular the requirement that unemployed applicants must pay for their own physicals, WHEREAS because of this restriction and others the City of Lubbock, despite its best efforts, has not yet been able to comply with the program's guidelines, and WHEREAS the letters received by the City of Lubbock from the Texas Department of Community Affairs, threatening termination of this contract, indicate that they demonstrate very little understanding of the problems of hiring, turnover, and other salient points in developing and operating this type of program, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF LUBBOCK: THAT it is the express will of the City Council for the City of Lubbock that this contract #48006480, relating to the Young Adult Conservation Corps Grant, from the Texas Department of Community Affairs be terminated, THAT the Mayor is hereby authorized to execute this resolution on behalf of the City of Lubbock and to cause it to be delivered to the Texas Department of Community Affairs and to the Honorable Bill Clements, Governor of the State of Texas. Box 2000 Lubbock, Texas 79457 Dear Mayor West: February 6, 1980 Please allow this letter to serve as acknowledgement on behalf of the Texas Department of Community Affairs of the desire of the City of Lubbock to terminate contract number 48006480 (effective October 1, 1979), between the City of Lubbock and the Texas Department of Community Affairs as stated in your letter dated January 29, 1980 (received by Department on February 4, 1980). The Department finds this notification to be in compliance with Section XXII (B) of the contract, page 16 of 18. Therefore, the Texas Department of Community Affairs contract number 4006480 will terminate on February 15, 1980. According to our records, the total amount of payments to the City of Lubbock has been $2,714.47 for the following periods listed: October 1979 $ 245.00 November 1979 1,005.85 December 1979 1,463.62 In accordance with Section XXII (C) of the contract, page 16 of 18, the City of Lubbock is to cancel, withdraw, or otherwise terminate any outstanding orders or sub -contracts relating to this contract, and cease to incur costs hereunder. In addition, in accordance with Section IV, Subsection 11, the Department shall not be liable for any costs which are not billed to the Department within ninety (90) days following the termination of this contract. The City of Lubbock shall preserve and protect from damage, loss, or destruction all records pertaining to this contract and its programs. Complete close-out information will be forwarded to the City of Lubbock by the Texas Department of Community Affairs.
