HomeMy WebLinkAboutResolution - 381 - Lease Agreement - SCRC - Parking Lot, Portion Of Section 6 Block E2 - 01_10_1980-JWF: c _ RESOLUTION #381 - 1/10/80 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock be and is hereby authorized and directed to execute for and on behalf of the City of Lubbock (as Lessor) a lease in favor of Heinsheimer, Gibler & Bennett, Inc. DBA Supreme Court Racquetball Club (as Lessee) attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Passed by the City Council this 10th day of January , 1980 . DBA Supreme Court Racquetball Club, a Texas Corporation, herein called "Club", do hereby contract and agree as follows: I. City hereby leases unto Club the following described real estate for the purpose of a parking lot for vehicles, to -wit: A strip of land out of Section 6, Block E-2, Lubbock County, Texas, being more particularly described as follows: BEGINNING at the most westerly northwest corner of Lot 1-B, Block 1, Westmoreland Addition to the City of Lubbock, Lubbock County, Texas; THENCE North 41*06' West a distance of 30.00 feet; THENCE North 48*54' East a distance of 271.26 feet; THENCE South 41*06' East a distance of 30.00 feet to a point in the northwest boundary of Lot 1-B, Block 1, Westmoreland Addition; THENCE South 48*54' West, along the northwest boundary line of Lot 1-B, Westmoreland Addition, a distance of 271.26 feet to the PLACE OF BEGINNING. II. This lease is for a term of 10 years beginning January 1, 1980 and ending December 31, 1989. Club shall pay City as compensation for this lease $600.00 per year, in advance, the first payment being due with the execution of this lease, and each annual payment thereafter being due on the first day of January of each succeeding year thereafter during the term of this lease, said payment to be made at City Hall, loth Street and Texas Avenue, Lubbock, Lubbock County, Texas. City may cancel this lease at any time upon 30 days written notice to such effect by United States Mail addressed to Club at 5507 Brownfield Road, Lubbock, Texas, or to last known address of the Club. In case of such cancellation, City will refund any rents prepaid by Club at the rate of $50.00 per month for any months so prepaid. City may also terminate this lease for any violation of the terms hereof by the Club by written notice given in like manner as required for cancellation as above set forth. LeiV This lease may not be assigned by the Club in whole or in part except upon written permission of the City Manager of the City thereto being first obtained by the Club. V. The operation of the parking lot by Club shall conform to all zoning, subdivision, traffic, and street regulations and ordinances of the City. • VI. Ingress, egress, and regress is retained to -the leased premises for all public utilities of the City or franchised to operate by the City, to repair, reconstruct, construct, maintain, and operate any of said utilities existing in, upon, over, along, under, and across said leased premises.
