FJA"I11, RESOLUTION #245 - 8/23/79 RESOLUTION A RESOLUTION APPROVING THE SUBMISSION OF AN APPLICATION FOR AN ADDITIONAL 80 UNITS OF SECTION 8 EXISTING HOUSING FOR LOWER INCOME FAMILIES BY THE HOUSING AUTHORITY OF THE CITY OF LUBBOCK TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT WHEREAS, the City of Lubbock has provided that the Housing Authority of the City of Lubbock shall provide and do certain activities and services in connection with the provision of low -rent housing; and WHEREAS, under the provisions of the Housing and Community Development Act of 1974, Section 8, as amended, the Department of Housing and Urban Development is authorized to provide financial assistance to public housing agencies for low -rent housing; and WHEREAS, the Housing Authority of the City of Lubbock is authorized by law and is willing to apply for and administer such financial assistance; and WHEREAS, the application for 80 additional units of Section 8 Existing Housing"is consistent with the goals described in the 1978-79 City of Lubbock Housing Assistance Plan; and WHEREAS, the City Council has determined that it would be in the best interest of the citizens of the City of Lubbock that the submission of an application for an additional 80 units of Section 8 Existing Housing be approved; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Housing Authority of the City of Lubbock shall cause to be prepared and shall send to the Department of Housing and Urban Development an application for an additional 80 units of Section 8 Existing Housing pursuant to the terms and provisions of the Housing and Community Development Act of 1974 as amended. Dwellings The Housing 4uthority is now in the process of Modernization on Projects TEX 18-1 and 18-2 in the amount of $1,490,000.00, which is to be completed within two years.•,Projects TEX 16-3 and 18-4 are now being painted;through funding by the Squth Plains Association of Governments in the amount of $141,796.16. The labor is furnished through the CETA program with the Authority furnishing the paint. The exteriors of al1;Qf the houses in the above projects are tp be painted by the end of. July„ 1978. Within tho past year the Authority has been able to secure C.D. funds from the City to renovate three apartments at Green Fair Manor to offices for. Counseling Services and an Activity Center. These funds amount to $33,,800,00. In addition, the Authority has recently been awarded $69,060.06 from C.D. funds .for security. In addition to unit ownership, the Housing Authority asnages and maintains a Central office, Community Center, Maintenance shop and warehouse in a separate Iocation as well as offices in Projects TEX 28-1 and 18-2. The Authority has been allotted 100 certificates for Section 8 Existinghousing and has an application pending with HUD for an additional 100 certificates. The operation of a Housing Authority of this magnitude is a. large and complex task. However, with 'almost 40 years experience to their credit, The Lubbock.Housing Authority has evolved an efficient and economical mane9ement plan which is capable of performing the task. The Housing Authority staff is a conscientious team.whose problem solving talents coupled vith solid leadership have enabled the Authority to operate its four projects and, 8 exri,ting program sanoty and effectively. Aide 'U 3 Laborers 6 The Housing Authority is currently in the process of upgrading occupancy and,has had considerable success in the past year in imp- lementing rent ranges and delinquency collection. All of the pro- jects are operated under Annual Contribution Contract (ACC). The Authority has approximately $1,000.000.00 invested in Certificates of Deposit. The Payment in Lieu of Taxes (PILOT) has been for- gi uen by both -the City and County, which enables the Authority to use the $175,000.00 to implement programs which the ACC will not cover. In 'summary, the Lubbock Housing Authority is an old, well esta- blished, efficiently managed local Housing Authority. Their success- ful performance in areas of management and improvements qualifies them as ideal owners and managers of Section 8 new housijtg- U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ASSURANCES IN CONNECTION WITH THE DEVELOPMENT AND OPERATION OF A LOW -RENT PUBLIC HOUSING PROGRAM ESTABLISHED PURSUANT TO THE U.S. HOUSING ACT OF 1937, AS AMENDED INSTRUCTIONS The PHA must provide assurances and certify to all of the following items. The PHA hereby assures and certifies that: (i) It will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and regulations pursuant thereto (Title 24 CFR Part 1) which state that no person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the applicant re- ceives financial assistance; and will immediately take any measures necessary to effectuate this agreement. With reference to the real property and structure(s) thereon which are provided or im- proved with the aid of Federal financial assistance extended to the PHA, this assurance shall obligate the PHA, or in the case of any transfer of property, the transferee, for the period .during which the real property and structure(s) are used for a purpose for which the Federal financial assistance is extended or for another purpose involving the provision of similar services or benefits. (ii) It will comply with Title VIII of the Civil Rights Act of 1968 (P.L. 90-284) as amended, and admin- ister its programs and activities relating to housing in a manner to affirmatively further fair housing. (iii) It will comply with Executive Order 11063 on Equal Opportunity in Housing and nondiscrimination in the sale and rental of housing provided with Federal financial assistance. (iv) In establishing criteria for the selection of tenants, the PHA will not utilize preferences or priori- ties which are based upon the length of time the applicant has resided in the jurisdiction. The PHA shall treat non-resident applicants who are working or have been notified that they are hired. to work in the jurisdiction as residents of the jurisdiction. (v) It will comply with Executive Order 11246 and all regulations pursuant thereto (24CFR Part 1.f0) which state that no person shall be discriminated against on the basis of race, color, religion, sex or national orgin in all phases of employment during the performance of Federal or federally assisted contracts and -shall take affirmative action to insure equal employment opportunity. (vi) It will comply with Section 3 of the Housing Lind Urban Development Act of 1968, as amended, (12 U.S.C. 1701u), which requires that, to the greatest extent feasible, opportunities for training and employment be given lower -income residents of the project area and contracts for work in connection with the project be awarded to business concerns which are located in, or owned in substantial part by persons residing in, the area of the project.
