AT 1406 AVENUE Q - DOWNTOWN FACADE GRANT THE STATE OF TEXAS COUNTY OF LUBBOCK At a regular meeting of the Board of Directors of MARKET LUBBOCK ECONOMIC DEVELOPMENT CORPORATION, INC., a Texas nonprofit corporation (MLI), on Wednesday, September 28, 2022, held in conformity with the bylaws, after due notice as therein provided, a quorum being present and acting, the following resolution was unanimously adopted: WHEREAS, MLI presented to members of the Board the proposal of a possible Economic Development Grant and Contract to Flip's LBK, Inc. at 1406 Avenue Q, and is making improvements to the exterior of their property, which is located in the Downtown TIF. Zach Beauchamp, Michael Tweed, and Jason Berryman, are owners of the downtown entities Flippers Tavern for the past 6 years, Inkfluence for 27 years and the Electric Lofts for 3 years. The scope of work includes removing dead foliage and installing Xeriscape, installing new planters, brick repair, security cameras and bike rack and installing new lighting and signage totaling $32,059. The terms and conditions of such Economic Development Grant and Contract, other than the normal terms and conditions applicable to all such Economic Development Grant and Contracts by the Corporation, are described generally as follows, to wit: Grant Flips LBK, Inc. a Downtown Facade Grant for $16,030 at 1406 Avenue Q, which is in the Downtown TIF, once proof of payment has been submitted. WHEREAS, The Board of Directors of MLI finds that an Economic Development Grant and Contract offering the incentive for providing assistance for renovations to their property, meet and comply with the qualifications and purposes of the Corporation for the granting of such Economic Development Grants and Contracts. Upon Motion by Director, Mr. Barry Orr, and Seconded by Director, Mr. Sonny Garza. IT WAS RESOLVED that MLI offer and, if accepted by Recipient, enter into an Economic Grant and Contract with Flips, LBK, Inc., for improvements to the property at 1406 Avenue Q, Lubbock, Texas. Crape Myrtle Clause: Herein our area of west Texas and Eastern New Mexico sometimes our winters are a bit tricky. These tricky winters can have an impact on all crape myrtles in our area. Though the winters may kill off the nice grown tops and trunks of crape myrtles on occasion the crapes always bounce back and start re - growing from the root ball. Due to this Nash and Associates will not warranty the tops or trunks of crapes through winter months. 7. Nash and Associates warrantees all construction, concrete, and masonry for i year as long as concrete has rebar reinforcement in large flatwork areas. Warranty is voided if client refuses rebar reinforcement in referred areas. S. Nash and Associates warrantees all Led lighting for i year. 9. Nash and Associates warrantees all Artificial Turf for 1 Year. 10. Any unexpected electrical or plumbing/irrigation repair is not included in bid and will be billed separately. 11. This bid does not include electrical outlet to ponds or pergolas if desired. 12. This bid does not include live water plumbing to ponds or fountains. 13. Once in contract client may not try to find cheaper material from an outside source. We set our prices and confirm bid approval weeks and or months before projects start. Our projects are bid with our material in mind. Changes to this can result in forfeiture of contract or a restocking fee of z0% on the material changed. 14. Client has up until 4 weeks before the installation starts to make changes on plants, other material or location of plants, shrubs and trees. The changes may result in price changing for the new material. If changes are made within the z week — Start Date period there will be a zo% restocking fee on unused material. Please try to ensure all changes for project are made before the 4 week - Start Date to avoid any unnecessary restocking fees. 15. If client wishes to move, transplant or relocate any plant, shrub or tree after it has been planted the warranty for that plant, shrub or tree is voided. 16. Any additions or changes to the original design and or bid need to be done through the office. My crew is there with a plan, design and material sheet They are very focused and determined to stay on the project schedule I have laid out. Feel free to call the office or my cell phone if you wish to discuss last minute changes. 17• Design fee is not included in this bid. Design fee has a separate invoice discussed between client and designer for $75 -$135/ hour. A design quote is always given during my initial visit. Some projects do not need a design and for those projects there is no fee for an itemized bid. 18. Nash and Associates does not provide weekly or seasonal maintenance services to clients. We do not run a maintenance division. Once the project is complete it is client's responsibility for all maintenance of the landscape. This includes weeding, mowing, chemical, fertilizer, etc... We do offer a seasonal clean up of landscaping at $95/ hour to remove winter kill, dead leaves and such. 19. Prices on Outdoor Kitchens, pergolas, bars and all general construction may change depending on client preferences. zo. Prices are good on all material and labor for 90 days. 21.
