HomeMy WebLinkAboutResolution - 2022-R0427 - Downtown Grant Permittable to Sigma Lubbock Investments at 1622 10th St.Resolution No. 2022-RO427 Item No. 5.3 October 25, 2022 RESOLUTION WHEREAS, pursuant to Article IV, Section 5 of the Amended and Restated Bylaws of the Market Lubbock Economic Development Corporation (the "Corporation"), the City Council of the City of Lubbock (the "City Council"), as the Corporation's authorizing unit, has the authority to approve all programs and expenditures of the Corporation; and WHEREAS, the City Council finds that it is in the best interest of the public to approve the program or expenditure, as proposed to the City Council by the Corporation, as set forth in Exhibit "A" attached hereto and incorporated herein by reference; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Downtown Permittable Grant program or expenditure of the Corporation, in the amount set forth in Exhibit "A" attached hereto and incorporated herein by reference, to be provided to Sigma Lubbock Investments, LLC is hereby approved pursuant to Section 5 of the Amended and Restated Bylaws of the Corporation. Market Lubbock DT Permittable Grant — Sigma Lubbock 9.29.22 RE 22-65 RESOLUTION APPROVING SIGMA LUBBOCK INVESTMENTS, LLC 1622 loth STREET DOWNTOWN PERMITTABLE GRANT THE STATE OF TEXAS COUNTY OF LUBBOCK At a regular meeting of the Board of Directors of MARKET LUBBOCK ECONOMIC DEVELOPMENT CORPORATION, INC., a Texas nonprofit corporation (MLI), on Wednesday, September 28, 2022, held in conformity with the bylaws, after due notice as therein provided, a quorum being present and acting, the following resolution was unanimously adopted: WHEREAS, MLI staff presented to members of the Board the proposal of a possible Economic Development Grant and Contract to Sigma Lubbock Investments, LLC for renovations to the property at 1622 10t' Street, located within the downtown TIF. Sigma Lubbock Investments, LLC, which is owned by Mark Luna and Walt Cathey, currently has the building leased to a state agency. The scope of permittable work will include replacing the sewer line which replacement will cost $13,385 for this project. The terms and conditions of such Economic Development Grant and Contract, other than the normal terms and conditions applicable to all such Economic Development Grant and Contracts by the Corporation, are described generally as follows, to wit: Grant Sigma Lubbock Investments, LLC, a Downtown Permittable Grant totaling $1,339 for the project at 1622 10'' Street, which is located within the Downtown TIF, once proof of payment has been submitted. WHEREAS, The Board of Directors of MLI finds that an Economic Development Grant and Contract offering the incentive for providing assistance to renovations to their property, meet and comply with the qualifications and purposes of the Corporation for the granting of such Economic Development Grants and Contracts. Upon Motion by Director, Mr. Barry Orr and Seconded by Director, Mr. Sonny Garza, IT WAS RESOLVED that MLI offer and, if accepted by Recipient, enter into an Economic Grant and Contract with Sigma Lubbock Investments, LLC, for the improvements to the building at 1622 101 Street, Lubbock, Texas. This Economic Development Grant and Contract will be on the normal terms and conditions of such Downtown Grant Program and Contract offered by MLI to existing businesses and business prospects and authorize the CEO to enter into and execute all documents related to the Economic Grant and Contract. We will start by setting up plastic and HEPPA fans on walls and floors of all three rooms. Once all plastic is set up we will bust up a 2x30ft trench as well as dispose of all concrete. We will then dig down and expose old cast iron pipe. If we cannot find good pipe to tie onto, we will have to start chasing pipe until good pipe is found to tie onto. When chasing pipe we will add and extra $350 per foot we have to go. After cast iron is out and we have good pipe to tie onto we will install new schedule 40 PVC, bed in pipe and test fall, and test for proper operation. Once we ensure operation we will then backfill all dirt and pour back concrete. Earls plumbing is not responsible for any flooring, construction or any other repairs needed at completion of project. Refrigerant leaks — When dealing with a refrigerant loss on a system, this indicates a refrigerant leak on the system. Refrigerant leak detection is recommended every time there is a refrigerant loss. If we do not perform leak detection, we will charge the system to the correct level of refrigerant and offer no warranty. If we perform leak detection and make a repair, our warranty is only for the leak we repaired. Anytime there is one leak on a system it is possible to have more than one. Our warranty is for the leak we repaired only. However if we make a leak repair and there is a refrigerant loss within 30 days, we will perform another leak detection at no charge, however the customer will be responsible to pay for any new repairs and refrigerant replacement. 3. All warranties do not cover neglect, abuse, or acts of God. PAYMENT 1. Payment is due upon completion of work. 2. We accept cash, checks, and credit cards. We also have financing available. 3.
