HomeMy WebLinkAboutResolution - 2010-R0277 - SPS Application Suspension - 06/10/2010Resolution No. 2010-RO277 June 10, 2010 Item No. 6.4 ORDER AND RESOLUTION AN ORDER AND RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK SITTING AS A REGULATORY AUTHORITY PURSUANT TO §33.001 OF THE TEXAS UTILITIES CODE, WITH REGARD TO A RATE CHANGE APPLICATION FILED BY SOUTHWESTERN PUBLIC SERVICE COMPANY D/B/A/ XCEL ENERGY ("SPS") WITH THE CITY. WHEREAS, pursuant to Section 33.001 of the TEXAS UTILITIES CODE, the City of Lubbock has exclusive original jurisdiction over the rates, operations, and services of an electric utility operating within the corporate limits of the City of Lubbock; and WHEREAS, SPS has heretofore filed a Statement of Intent and Application of Southwestern Public Service Company for Authority to Change Rates (the "Application") on May 17, 2010; and WHEREAS, SPS has requested that the City suspend in its Application for ninety (90) days so that the City of Lubbock will have adequate time to review the Application, and NOW THEREFORE BE IT ORDERED AND RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT. due to the request by SPS to suspend its Application and pursuant to the applicable provisions of the TEXAS UTILITIES CODE including but not limited to the authority outlined in TEX. UTIL. CODE §36.108, the City Council of the City of Lubbock. sitting as a regulatory authority with jurisdiction over the rates, operations, and services of an electric utility operating within the corporate limits of the City of Lubbock hereby SUSPENDS the Application of SPS for ninety (90) days from the date of this Order and Resolution.
