RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on behalf of the City of Lubbock, Amendment No. 3 for Engineering
Services, by and between the City of Lubbock and Parkhill Smith & Cooper, Inc. of
Lubbock, Texas, and related documents. Said Amendment is attached hereto and
incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.

AMENDMENT NO.3
TO AGREEMENT
CITY OF LUBBOCK, TEXAS
AND
PARKHILL, SMITH & COOPER, INC.
FOR ENGINEERING SERVICES
ENGINEERNIG SERVICES FOR: Frankford Avenue from 98`h Street to 114`h Street, 98`h Street from
Frankford Avenue to Milwaukee Avenue, and Milwaukee Avenue from 94`h Street to 100`h Street, Project
No. 92158, hereinafter referred to as "the Project."
THIS IS AN AMENDMENT TO THE AGREEMENT dated October 23, 2008 and entered into by and
between the CITY OF LUBBOCK, TEXAS, hereinafter called "Owner," and PARKHILL, SMITH &
COOPER, INC., hereinafter called the "Engineer," of 4222 85`h Street, Lubbock, Texas. The original
Agreement was approved by City Council action on October 23, 2008, Resolution No. 2008 R0418.
Amendment No. 1, which added scope and fee to the original agreement, was approved by City Council
action on August 27, 2009. Amendment No. 2, which added a time extension to the original agreement,
was approved by Purchasing and Contract Management on January 19, 2010 to cover delays caused
beyond the Engineer's control.
The purpose of this amendment is to extend the Project termination date of the original Agreement and
Amendments, and to increase the maximum fee of the Project. The original Project scope required the
Engineer to design one plan set that included improvements to Frankford Avenue, 98`h Street and
Milwaukee Avenue. The City of Lubbock has requested the Engineer to separate the single plan set into
three independent plan sets, thus requiring additional time, additional design effort, and additional fee for
the Engineer to perform the requested services. The three plan sets will include the following roadways:
Project 1: Bond Project
Milwaukee Avenue: 94`h Street to 106`h Street (7 -lanes concrete pavement)
Milwaukee Avenue: 106`h Street to 114`h Street (3 -lanes asphalt strip pavement)
98th Street: Milwaukee Avenue to Juneau Avenue (2 -lanes asphalt strip pavement)
Project 2: Frankford Avenue - 98`h Street to 114`h Street (7 -lanes concrete pavement)
Project 3: 98`h Street - Frankford Avenue to Milwaukee Avenue (7 -lanes concrete pavement)
The extended time should provide the Engineer with the timeframe required to complete the three plan
sets, to assist the City of Lubbock with Bid Phase Services at the time of bidding, and to recover time lost
while the Engineer performed design work to evaluate various alternative alignments for Milwaukee
Avenue through and around a playa lake at 98`h Street that was not covered by the original scope of
services. The extended time accommodates the time needed until the Bid Phase Services for Milwaukee
Avenue can begin, which is not until the Lake Alan Henry Water Line has been constructed through the
limits of the Milwaukee Avenue roadway project.
This amendment extends the time for the original Agreement and Amendment No. 1 such that the
Agreement and Amendment No. 1 shall terminate at the close of business on July 31, 2011, unless a
mutual agreement is made by the Owner and the Engineer to extend the agreement.
This amendment will add $200,000.00 to the maximum amount payable of this project, thus increasing
the maximum amount payable from $1,356,616.00, and establishing a new maximum amount payable for
this contract at $1,556,616.00. The added cost is necessary to compensate the Engineer for the additional
scope of designing strip pavement and a traffic control plan for the recently approved Bond Project that
was not a part of the original scope, and to cover expenses incurred by the Engineer while evaluating the
alternative alignments for Milwaukee Avenue through and around the playa lake at 98th Street that was
not part of the original scope.
All other portions of the original Agreement shall remain in place and are not altered by this amendment.
Executed in three counterparts (each of which is an original) on behalf of Engineer by its Vice President
shown below and on behalf of Owner this 27th day of May , 2010.
