RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public needs,
safety and welfare demand and create a public necessity for the acquisition of additional
land for municipal public use and purposes, to -wit: for the widening of Milwaukee
Avenue from 94th Street to 1041h Street and the City Council of said City finds it in the
public interest and for public purposes and municipal purposes to proceed with the
acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the tract of land further described in
Exhibit "A" attached hereto, be acquired for public purposes and municipal purposes as
set forth in the preamble hereof.
SECTION 2. THAT the owner of said tract, being Larry D. Allen and Joyce L.
Allen, BE offered through the Right -of -Way Department of the City of Lubbock the
amount of $ 120,000.00, which is the amount appraised as the value and total damages,
plus closing cost for the fee simple title for the use and benefit of the City of Lubbock,
Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of
said City of Lubbock is hereby authorized and instructed to institute condemnation
(eminent domain) proceedings to acquire the fee simple title.
SECTION 3. THAT subsequent to the City's acquisition of the tract of land, the
City shall pay to the owner the reasonable expenses of moving the property owner's
personal property from the tract upon proper documentation.

EXHIBIT "A"
TRACT 1: A tract of land out of Section 22, Block A -K, Lubbock County, Texas, and
being more particularly described by metes and bounds as follows:
BEGINNING at an iron rod that is South 1683.315 feet from the Northeast corner of
Section 22, Block A -K, Lubbock County, Texas;
THENCE West 320 feet to an iron rod;
THENCE South 143.055 feet to an iron rod;
THENCE East 320 feet to an iron rod;
THENCE North 143.055 feet to the Place of Beginning.
TRACT II: A tract of land located in the Northeast Quarter of Section 22, Block A -K,
Lubbock County, Texas, being further described as follows:
BEGINNING at a '/2" iron rod with cap set for the Northeast corner of this tract which
bears South, 1611.79 feet from the Northeast corner of Section 22, Block A -K, Lubbock
County, Texas;
THENCE South, a distance of 71.53 feet to a''/z" iron rod with cap set for the Southeast
corner of this tract;
THENCE West, at 50.0 feet pass a''/z" iron rod with cap set in reference, continuing for a
total distance of 320.00 feet to a'/2" iron rod with cap set for the Southwest corner of this
tract;
THENCE North, a distance of 71.53 feet to a''/z" iron rod with cap set for the Northwest
corner of this tract;
THENCE East, at 270.0 feet pass a''/z" iron rod with cap set in reference, continuing for a
total distance of 320.00 feet to the Point of Beginning.
