AN ORDINANCE ABANDONING AND CLOSING A PORTION OF AN A
UNDERGROUND UTILITY EASEMENT, LOCATED WITHIN LOT 12, WESTAC
ADDITION, LUBBOCK COUNTY, TEXAS WHICH IS MORE PARTICULARLY
DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY
ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID r
ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING FOR PUBLICATION. win

WHEREAS, the City Council finds that the easement hereinafter described in the body Ev
of this Ordinance is no longer needed for easement purposes and for public use; and it would
be in the public interest to close, vacate and abandon the same for easement purposes and for
public use; NOW THEREFORE: —
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement as hereinafter described shall BE and the same is
hereby closed, vacated and abandoned for easement purposes and for public use, such easement
being more particularly described in the attached Exhibit "A".
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the
official maps of the City of Lubbock to reflect said abandonment and closing, showing the
number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word
of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.

Portion of the 20' underground Utility Easement to be Vacated
Commencing at the Southwest corner of the property in the name of
Lowe's Home Centers recorded in Instrument No. 2006041628 with
the County Clerk's Office of Lubbock County, Texas on the Eastern
right of way of Frankfort Avenue; thence with the Eastern right of
way line of Frankfort Avenue North 01'49'16" East for 379.46 feet to
a point on said Eastern right of way line of Frankfort Avenue and
the Southwestern corner of an existing 20' underground utility
easement as shown on that plat recorded as Plat No. 1382.12 with
the County Clerk's Office of Lubbock County, Texas and the Point of
Beginning;
Thence from said Point of beginning and continuing along the
common line of said Eastern right of way line of Frankfort Avenue
and the said 20' underground utility easement North 01'49'16' East
for 20.00 feet to the Northwestern corner of said 20' underground
utility easement; thence leaving said Eastern right of way line and
following the northern line of said 20' underground utility easement
South 88'10'39" East for 138.01 feet to a point; thence a new line
South 46'50'20" West for 28.29 feet to a point on the Southern line
of said 20' underground utility easement; thence along the Southern
line of said 20' underground utility easement North 88'10'39" West
for 117.99 feet to the Point of Beginning.
Containing 2,560 square feet, more or less.
