AN ORDINANCE AMENDING CHAPTER 22 "UTILITIES", ARTICLE 22.1
"STORMWATER REGULATIONS" OF THE CODE OF ORDINANCES OF THE CITY 0
LUBBOCK, TEXAS, WITH REGARD TO STORMWATER PLAN REVIEW FEE!
PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY; AND PROVIDING FO.
PUBLICATION.
WHEREAS, the City Council of the City of Lubbock, Texas deems it in the best interes�
of the citizens of Lubbock to make the following amendments to Article 22.11 of the Code o
Ordinances of the City of Lubbock in order to align stormwater plan review fees with budgeted
fees; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 22.11.034 of the Code of Ordinances of the City
Lubbock, Texas, is hereby repealed in its entirety and that same section reserved for future use.
SECTION 2. THAT Section 22.11.035 of the Code of Ordinances of the City of
Lubbock, Texas, is hereby amended to read as follows:
Sec. 22.11.035 Stormwater plan review
(a) Process. Stormwater pollution prevention plan (SWP3) shall be submitted for
review in accordance with NPDES or TPDES permit requirements and this article. Any operator
desiring TPDES permit coverage shall submit to the stormwater engineer a stormwater plan
review application on a form provided by the City of Lubbock Stormwater Management
Department along with a copy of the SWP3 and the fee as established by subsection (b). Should
the plan review process exceed ten (10) business days, construction activities may commence
under the submitted SWP3. Once the plan review is complete, any necessary changes will be
made to the SWP3 at the project site.
(b) Storm Water Plan Review Fees. All applications for storm water plan review
approval shall be accompanied by the appropriate processing fee. The fee for review shall be a
flat fee set annually in the City's budget ordinance.
SECTION 3. THAT should any paragraph, section, clause, phrase or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of the
shall not be affected thereby.

SECTION 4. THAT a violation of any provision of this Ordinance shall be deemed
misdemeanor punishable in accordance with state law and Section 1.01.004 of the Code of
Ordinances of the City of Lubbock.
SECTION 5. THAT the City Secretary of the City of Lubbock, Texas, is hereby
authorized and directed to cause publication of the descriptive caption of this Ordinance as a
alternative means of publication provided by law.
