RESOLUTION
WHEREAS, an 11.7 acre tract of land in Coronado Tex. R-33, the City of
Lubbock's Urban Renewal Plan, was transferred to the City of Lubbock by the Urban
Renewal Agency in 1973 by Dedication Deed "for public use forever for park purposes;"
and
WHEREAS, upon the recommendation of the Parks Board, the Urban Renewal
Board, and the Planning and Zoning Commission, and after holding a public hearing, the
City Council amended the Urban Renewal Plan to change the use of this 11.7 acre tract
from use as a public park to use as a public railroad dock: and
WHEREAS, the City of Lubbock desires to transfer the property to the Urban
Renewal Agency to be conveyed for use as a public railroad deck in conformance with
the amendment to the Urban Renewal Plan and has determined that the project is
beneficial to the City's residents; and
WHEREAS, pursuant to Section 374.906(a) and (c) of Vernon's Texas Codes
Annotated Local Government Code, the City may convey its interest in the 11.7 acres
with or without consideration to an urban renewal agency; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Mayor of the City of Lubbock is hereby authorized and
directed to execute a Deed Without Warranty from the City of Lubbock to the Urban
Renewal Agency, as Grantee, for a consideration of $10.00, in cash paid to the City of
Lubbock by said Grantee, a copy of which Deed is attached hereto and incorporated in
this Resolution as if fully set forth herein and shall be included in the minutes of the
Council.

Grantor, for the consideration stated herein, GRANTS, SELLS, and CONVEYS
to Grantee the Property, to have and to hold it to Grantee and Grantee's successors and
assigns forever, without warranty, express or implied, statutory or otherwise, and all
warranties that might arise by common law and the warranties created by Section 5.023
