Home My WebLink AboutResolution - 2010-R0081 - Offer To Garza County For Purchase Of 8 Easements LAH Pipeline Project - 02/12/2010Resolution No. 2010-R0081 February 12, 2010 Item No. 2.1 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs. safety and welfare demand and create a public necessity for the acquisition of additional real property interests for municipal public use and purposes, to -wit: for the Lake Alan Henry Pipeline Project, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of certain interests in real property as needed for such purposes as aforesaid; WHEREAS, the value of the real property interests to be acquired is presently in dispute between the City of Lubbock and Garza County, Texas; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT water pipeline easements on, under, and across certain tracts of land further described in Exhibits "A," "B," "C," "D," "E," "F," "G," and "H" attached hereto, be acquired for public purposes and municipal purposes as set forth in the preamble hereof. SECTION 2. THAT the City of Lubbock, through its Right -of -Way Department shall offer to Garza County, Texas. or subsequently discovered landowners, as fair and reasonable compensation, an amount equal to the greater of. 1) $500.00 per easement acquired; or 2) the fair market value of each easement to be acquired, as determined by an appraiser licensed in and by the State of Texas. SECTION 3. THAT unless said offer shall be accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the easement interests as set forth above.
