RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for
and on behalf of the City of Lubbock, Amendment No. 3 to Agreement No. 97871 for labor
services for cleaning and maintaining public right-of-way and other public property, by and
between the City of Lubbock and Lubbock County, and related documents. Said Amendment is
attached hereto and incorporated in this resolution as if fully set forth herein and shall be
included in the minutes of the City Council.

AMENDMENT NO.3 TO AN INTERLOCAL COOPERATIVE
AGREEMENT BETWEEN THE CITY OF LUBBOCK AND
LUBBOCK COUNTY, TEXAS
THIS IS THE SECOND AMENDMENT (the "Amendment") TO THE INTERLOCAL
COOPERATION AGREEMENT dated and entered into the 14th day of October 2010 (the
"Agreement"), by and between the City of Lubbock (the "City") and Lubbock County, Texas
(the "County").
The County entered into the Agreement with the City for the provision of labor services for
cleaning and maintaining public rights -of -way and other public property owned, operated, or
controlled by the City. The labor services will be carried out by inmates of the Lubbock County
Jail with the supervision of the said inmates to be carried out by Law Enforcement Officers of
the Lubbock County Sheriff's Office who shall be either Correctional Officers or Deputy
Sheriffs.
A First Amendment to the Agreement (the "First Amendment"), executed by the City and
County on May 22, 2014, increased the payment of the Agreement by seventy-three thousand
seven hundred fifty dollars ($73,750) so, that the payment amount in the Agreement was three
hundred sixty-eight thousand seven hundred fifty dollars ($368,750).
A Second Amendment to the Agreement (the "Second Amendment"), executed by the City and
County on September 14, 2017, increased the payment fifty-six thousand two hundred and fifty
dollars ($56,250) for Fiscal Year 2017, so that the payment amount in the Agreement was
four hundred twenty-five thousand dollars ($425,000) for Fiscal Year 2017. Further, the Second
Amendment increased the payment in the Agreement and the First Amendment by an additional forty
thousand dollars ($40,000) for Fiscal Year 2018, so that the payment amount in the Agreement was
four hundred sixty- five thousand dollars ($465,000) for Fiscal Year 2018. The Second
Amendment allows the Fiscal Year 2018 increase on an as -needed and as -utilized basis. During
Fiscal Year 2018 one crew was added for the landfill, utilizing the increased as -needed and as -
utilized Agreement amount.
This Amendment increases the payment in the Agreement by additional sixty three thousand
four hundred and twenty-five dollars ($63,425) for an additional deputy salary for the landfill's
exclusive use, so that the payment amount in the Agreement shall be for five hundred twenty-
eight thousand four hundred and twenty-five dollars (528,425) until the Agreement is terminated
or renegotiated. The expiration date and termination provisions of the Agreement shall remain
as originally stated. Subject to the approved budget of each Party to the Agreement, the payment
amount of the Agreement may be adjusted each succeeding year of the Agreement, and shall
be effective on the anniversary of the Agreement. Such succeeding year increase in the payment
amount of the Agreement shall not exceed the percent increase of the respective fiscal year
salary increase of the Lubbock County Sheriffs Office's budget as approved by the Lubbock
County Commissioner's Court.
All other portions of the Agreement and previous amendments shall remain in place and are not
altered by this amendment.
