W1 [ERAS, as part of' Ordinance Nos. 2019-00048 all([ 20 18-001I5, a variance request may be made by an entity in order to appeal to the City Council for relief- from hardship caused by the moratorium: WHEREAS, Lamar Advertising of' Woll'forth. 'Texas (Lamar) is appealing, it) the Luhbock City Council for a variance to the one hundred eighty day moratorium (180) on billboards: WHEREAS, the Texas Department of Transportation (TXI7OT)' in preparation for the building of' Loop 88, is rcqucsting, Lamar move billboards along the proposed route due to a change in the States right-of-way to make way fir tilt new highway; WHEREAS. the location of the billboard, both current and as moved ill the future upon grant of a variance, depicted in Exhibit "A" attached hereto, is located near the intersections of' 1 14th Street and US I hghway 87, Lubhock County, Tc%as. and WHEREAS, the City Council has heard from and reviewed the sttpporting documents Irom Lamar representatives demonstrating, that Lamar meets the criteria for a variance provided For in the morator41111 ordinance: WFIFREAS, the Cite Council of the City of- [.uhbock deems it to be in the best interest of the citizens of the City of Lubbock to grant said variance: and W1II:REAS, the City Council directs the planning staff, to coordinate with [.amar in order to initiate the permitting process for this request, subject to all applicable City of I.ubbock regulations and procedures. as granted by this variance to the billboard moratorium. I'he granting of the variance will not he detrimental to the public safety, health, or welfare, be injurious to surrounding property, or violate the intent and purpose of the regulation: 2. -1-hat the granting of the variancc is not based on a hardship which is self-imposed: 3. Most of these situations involve TXD0T taking parts of property and reassigning Right of Way (ROW) boundaries within their jurisdiction. These tie«, requirements will require expedited actions in order to comply with the Future plans for these land uses. Lamar AdvcrtIsling of Lubbock has recently been contacted by TX DOT regarding a parcel of 1)roperty where RU W boundaries wi I be changed anti actions will need to be taken within a matter of weeks. This property currently has an existing billboard which is completely legal per the conditions as to when it was built: and will need sett}e minor modifications in order to meet the needs of -the TXI)OT loop 88 Project. Modifications may include complete reconstruction of the structure back on the same property as a new Modern mono -pole structure or removing two 1-beams from one end and replacing them on the other and reconfiguring the head portion of the structure. Any of these actions are compliant with TXDOT. If the acquisition represents a separate economic entity, then it should be valued as such. This could require a new valuation analysis with new comparable data separate from that utilized in the valuation of the whole property. If the acquisition cannot be treated as a separate economic entity, however, then its value is derived from its contribution to the whole property. The residual value of the property after the value of the acquisition is subtracted is called the remainder before. DESCRIPTION OF THE ACQUISITION The acquisition of Parcel 316 includes 2,247 square feet or 0.052 acre of land area at the property's east side adjacent to US 87. The acquisition is a rectangular land strip, 100 feet wide and 22.47 feet deep. The acquisition bisects the billboard site which includes part of the structure itself and the land rights (entitlement) to host an off -premise advertising sign on the property. For purposes of this appraisal, and in recognition of the category I bisection of the billboard, I have included all of the billboard in the part acquired. The acquisition also takes in about 1,100 SF of the gravel paving, and 1,100 square feet of the mixed concrete and asphalt paving. The purpose of the acquisition is to facilitate improvements to FM 1585 at the intersection with US 87. No access rights are being acquired. A depiction of the acquisition area is provided below and on the next page (red shaded areas).
