RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for
and on behalf of the City of Lubbock, Professional Services Contract No. 13547 for Temporary
Employment Services, by and between the City of Lubbock and Kelly Services, Inc., and related
documents. Said Contract is attached hereto and incorporated in this resolution as if fully set forth
herein and shall be included in the minutes of the City Council.

Service Agreement
Contract 13547
This Service Agreement (this "Agreement") is entered into as of the 24th day of August
2017("Effective Date") by and between Kelly Services, Inc. (the Contractor), and the City of Lubbock
(the "City").
RECITALS
WHEREAS, the City has issued a Request for Proposal 17-13294-SS Temporary Employment
Services.
WHEREAS, the proposal submitted by the Contractor has been selected as the proposal which best
meets the needs of the City for this service; and
WHEREAS, Contractor desires to perform as an independent Contractor to provide Temporary
Employment Services, upon terms and conditions maintained in this Agreement; and
NOW THEREFORE, for and in consideration of the mutual promises contained herein, the City
and Consultant agree as follows:
City and Contractor acknowledge the Agreement consists of the following exhibits which are
attached hereto and incorporated herein by reference, listed in their order of priority in the event of
inconsistent or contradictory provisions:

Scope of Work
Contractor shall provide the services that are specified in Exhibit A. The Contractor shall comply with all
the applicable requirements set forth in Exhibit B, C and D attached hereto.
Article 1 Services
1.1 The contract shall be for a term of one (1) year, with the option of four (4), one (1) year
extensions, said date of term beginning upon formal approval. All stated quantities are
approximations of usage during the time period to be covered by pricing established by this
bid. Actual usage may be more or less. Order quantities will be determined by actual need.
The City of Lubbock does not guarantee any specific amount of compensation, volume,
minimum, or maximum amount of services under this bid and resulting contract. The
Contractor must maintain the insurance coverage required during the term of this contract
including any extensions. It is the responsibility of the Contractor to ensure that valid
insurance is on file with the Purchasing and Contract Management Department as required
by contract or contract may be terminated for non-compliance.
1.2 This contract shall remain in effect until the first of the following occurs: (1) the expiration
date, (2) performance of services ordered, or (3) termination of by either party with a 30 day
written notice. The City of Lubbock reserves the right to award the canceled contract to the
next lowest and best bidder as it deems to be in the best interest of the city.
1.3 The Contractor shall not assign any interest in this Agreement and shall not transfer any
interest in the Agreement, whatsoever, without prior consent of the City.
1.4 All funds for payment by the City under this Agreement are subject to the availability of an
annual appropriation for this purpose by the City. In the event of non -appropriation of funds
by the City Council of the City of Lubbock for the goods or services provided under the
Agreement, the City will terminate the Agreement, without termination charge or other
liability, on the last day of the then -current fiscal year or when the appropriation made for
the then -current year for the goods or services covered by this Agreement is spent,
whichever event occurs first. If at any time funds are not appropriated for the continuance
of this Agreement, cancellation shall be accepted by the Contractor on 30 days prior written
notice, but failure to give such notice shall be of no effect and the City shall not be
obligated under this Agreement beyond the date of termination.
Article 2 Miscellaneous.
2.1 This Agreement is made in the State of Texas and shall for all purposes be construed in
accordance with the laws of said State, without reference to choice of law provisions. This
Agreement is performable in, and venue of any action related or pertaining to this
Agreement shall lie in, Lubbock, Texas.
2.2 This Agreement and its Exhibits contains the entire agreement between the City and
Contractor and supersedes any and all previous agreements, written or oral, between the
parties relating to the subject matter hereof. No amendment or modification of the terms of
this Agreement shall be binding upon the parties unless reduced to writing and signed by
both parties.
2.3 This Agreement may be executed in counterparts, each of which shall be deemed an
original.
2.4 In the event any provision of this Agreement is held illegal or invalid, the remaining
provisions of this Agreement shall not be affected thereby.
2.5 The waiver of a breach of any provision of this Agreement by any parties or the failure of
any parties otherwise to insist upon strict performance of any provision hereof shall not
constitute a waiver of any subsequent breach or of any subsequent failure to perform.
2.6 This Agreement shall be binding upon and inure to the benefit of the parties and their
respective heirs, representatives and successors and may be assigned by Contractor or the
City to any successor only on the written approval of the other party.
2.7 All claims, disputes, and other matters in question between the Parties arising out of or
relating to this Agreement or the breach thereof, shall be formally discussed and negotiated
between the Parties for resolution. In the event that the Parties are unable to resolve the
claims, disputes, or other matters in question within 30 days of written notification from the
aggrieved Party to the other Party, the aggrieved Party shall be free to pursue all remedies
available at law or in equity.
2.8 At any time during the term of the contract, or thereafter, the City, or a duly authorized
audit representative of the City or the State of Texas, at its expense and at reasonable times,
reserves the right to audit Contractor's records and books relevant to all services provided to
the City under this Contract. In the event such an audit by the City reveals any errors or
overpayments by the City, Contractor shall refund the City the full amount of such
overpayments within 30 days of such audit findings, or the City, at its option, reserves the
right to deduct such amounts owing the City from any payments due Contractor.
2.9 The City reserves the right to exercise any right or remedy to it by law, contract, equity, or
otherwise, including without limitation, the right to seek any and all forms of relief in a
court of competent jurisdiction. Further, the City shall not be subject to any arbitration
process prior to exercising its unrestricted right to seek judicial remedy. The remedies set
forth herein are cumulative and not exclusive, and may be exercised concurrently. To the
extent of any conflict between this provision and another provision in, or related to, this do.
2.10 The Contractor shall not assign or sublet the contract, or any portion of the contract, without
written consent from the Director of Purchasing and Contract Management. Should
consent be given, the Contractor shall insure the Subcontractor or shall provide proof of
insurance from the Subcontractor that complies with all contract Insurance requirements
document, this provision shall control.
IN WITNESS WHEREOF, this Agreement is executed as of the Effective Date.

Temporary Employment Services
I. SCOPE OF WORK
BACKGROUND
1.1 The City of Lubbock (hereinafter called "City") is seeking proposals from temporary
employment agencies (hereinafter called "Agency") for information on the quality and cost of
temporary employment services. The City utilizes approximately 25 to 35 clerical and
professional temporary workers per year. Each clerical or professional temporary worker
requested works from a few days to several months, where the majority of requests are two to
six weeks in duration. The City also utilizes approximately 90 to 150 trade's temporary
workers per year. The majority of these workers are utilized during the summer months as
seasonal workers and work from about the middle of May through the middle of September. A
Medical category is included in the event an LVN is needed for the Health Department on a
contingency basis or as needed.
1.2 The City may select more than two temporary employment agencies, per job family category, to
service this contract and will provide personnel requests to the agencies that provide the most
prompt and quality placement by category. The City has spent an average of $1.5 million each
year over the past five years for temporary employment services. The total appropriation for
temporary employment services in FY 2016-2017 budget is $1.4 million.
1.3 The City of Lubbock will require the successful temporary employment agencies to conduct a
standard background check for all temporary employees placed with the City and provide
copies to the designated representative at the City of Lubbock.
1.3.1 Telephone reference checks to ensure education and skills are correct, as presented on
an applicant's application.
1.3.2 Conduct criminal history checks, through the Texas Department of Public Safety or
State of Current Residence, on all applicants who are being referred for City jobs.
1.3.3 Make every reasonable effort to contact past and present employers to gain information
about the work habits of the applicant(s).
1.3.4 The Lubbock Police Department will conduct a more thorough background check on
any temporary employee(s) who will be required to work in confidential police work
areas or police records.
1.4 The City of Lubbock will require the temporary employment agencies to conduct pre-
employment screening for all temporary employees placed with the City and provide
documentation that the temporary employees passed to the designated representative at the City
of Lubbock prior to placement.
1.4.1 All temporary employees must have a drug screening completed within ten (10) days
prior to placement.
1.4.2 Temporary employees in trades' positions will have a physical exam, as needed,
completed within thirty (30) days prior to placement, unless they have had one within
the last six (6) months.
1.4.3 Temporary employees who drive City vehicles must have a driver's license check
completed within one (1) year prior to placement.
1.4.4 Prior to placement at the City, Human Resources will run a check through our internal
databases and approve all temporary applicants for placement.
1.5 The City currently uses Microsoft Office Products.
GENERAL CONDITIONS
2.1 Agency will quote an hourly wage and bill rate at various levels (EXHIBIT C) for each type of
temporary worker described in the job descriptions in EXHIBIT B, as applicable. These rates
will remain effective for one year. Any increases in the second and third year of the contract
shall be in accordance with the Consumer Price Index; however, a three to five year price
guarantee will be looked on favorably. The rate should encompass any payments to the
temporary employee as well as applicable costs for conducting Driver's License Checks,
Criminal History Background Checks, Drug/Alcohol Screens, Physicals, etc. Workers
compensation coverage will be the responsibility of the agencies.
Agency must notate any difference in mark-up percentage for overtime pay. Overtime is
defined as more than 40 hours actually worked in any one week beginning on Saturday and
ending on Sunday.
City of Lubbock Retirees, returning to their same position, are an exception to the quoted rates.
They can return through a staffing agency at the same hourly rate upon retirement. The hourly
wage shall be verified with the designated representative at the City of Lubbock prior to the
temporary assignment. The bill rate for these employees shall be at the same percentage or
better as all other temporary employees.
The City reserves the right to request a temporary employee for a position that is not included
in this contract. The hourly wage shall be verified with the designated representative at the
City prior to the temporary assignment. These rates will be at 5% under the City's pay plan but
no lower than minimum wage. The bill rate for these temporary employees shall be at the same
percentage as all other temporary employees.
2.2 The selected agencies will appoint one person who is an employee of the agency who will
service this contract and who will be the liaison between the City and their agency.
2.3 The agencies will be solely responsible for ensuring the workers they provide the City meet all
legal requirements to be able to work in the United States and complete the I-9 form accurately
and in its entirety.
2.4 The agencies will be able to provide temporary workers within 8 hours of the request and if the
City is not contacted and/or provided with a temporary within that time period the City reserves
the right to contact another agency for service.
2.5 The agencies will provide workers who possess the necessary skills, knowledge, and ability to
perform the jobs into which they are to be placed, as per attached job description.
2.6 The City reserves the right to reject workers provided by the successful agencies, if they are
found to be unacceptable before or after starting on the job to which they have been assigned.
2.7 There shall be no obligation on the part of the City to hire any temporary worker it is supplied
under the terms of this RFP on a full time basis following the term of the temporary
employment.
2.8 Should the City wish to hire an individual who has been filling the temporary position, neither
the individual nor the City will be required to pay a placement fee.
2.9 The selected agencies will have and maintain a $500,000 crime bond on the employees it
provides to the City to protect the City from any loss caused by the workers it provides.
2.10 The successful agencies are to provide the City with weekly billing by department. Normal
payment terms are Net 30. The ability to accept a City purchasing card for payment is
preferred.
3 CONTRACT TERM/TERMINATION
3.1 The contract shall be for a term of five years, said date of term beginning upon formal approval.
This contract shall remain in effect until the expiration date, performance of services ordered,
or termination by either party with a thirty (30) date written notice. Such written notice must
state the reason for cancellation. The City of Lubbock does not guarantee any specific amount
of compensation, volume, minimum, or maximum amount of services under this proposal and
resulting contract. The Contractor must maintain the insurance coverage required during the
term of this contract including any extensions. It is the responsibility of the Contractor to
ensure that valid insurance is on file with the Purchasing and Contract Management
Department as required by contract or contract may be terminated for non-compliance.
3.2 This contract shall remain in effect until the first of the following occurs: (1) the
expiration date, (2) performance of services ordered, or (3) termination of by either party
with a 30 day written notice. Such written notice must state the reason for cancellation.
The City of Lubbock reserves the right to award the canceled contract to the next lowest
and best bidder as it deems to be in the best interest of the city.
4 INDEMNITY INSURANCE
PROOF OF COVERAGE SHALL BE FURNISHED TO THE CITY OF LUBBOCK IN THE
FORM OF A CERTIFICATE OF INSURANCE. THE INSURANCE CERTIFICATES FURNISHED
SHALL NAME THE CITY OF LUBBOCK AS A PRIMARY ADDITIONAL INSURED AND
PROVIDE A WAIVER OF SUBROGATION IN FAVOR OF THE CITY OF LUBBOCK, OR IN THE
ALTERNATIVE, SHALL BE ACCOMPANIED BY A STATEMENT FROM THE CONTRACTOR
TO THE EFFECT THAT NO WORK ON THIS PARTICULAR PROJECT SHALL BE
SUBCONTRACTED. IT SHALL BE THE CONTRACTOR'S RESPONSIBILITY TO PROVIDE TO
THE OWNER ALL PROOF OF COVERAGE INSURANCE DOCUMENTS INCLUDING
WORKERS COMPENSATION COVERAGE FOR EACH SUBCONTRACTOR.
4.1 Agency shall indemnify, hold harmless, and defend the City of Lubbock, its officers and
employees from and against any and all liability or alleged liability without fault and liability
by virtue of the obligations that the City of Lubbock assumes toward its indemnity(s) insofar as
applicable to this Contract or the work to be performed hereunder and including cost of suit,
attorneys' fees, and all other related costs and expenses of whatever kind or character arising
directly or indirectly from any cause whatsoever in connection with or incidental to this
Contract or the work to be performed hereunder, including such injury or harm as may be
caused in part by any neglect, act, or omission of the City, its officers and employees, excepting
only such injury or harm as may be caused solely by an act or omission of the City, its officers
and employees. Notwithstanding the foregoing, the Agency specifically agrees to so indemnify,
hold harmless, and defend the City from and against any and all such liability, suits, action,
legal proceedings, claims, or demands that may be made or pursued by an employee of Agency,
or of any subcontractor, or materials man, or anyone acting on behalf of contractor in
connection with or incidental to this Contract which are alleged to be attributable to any
condition of or upon the City's property facilities, materials, or equipment, including where
such condition and resulting injury or harm is caused in part by any negligent act or omission of
City, its officers and employees, but excepting only such injury or harm as may be caused
solely by an act or omission of City, its officers and employees. Agency agrees to waive any
and all claims and suits covered by this indemnity agreement and agrees that any insurance
carrier involved shall not be entitled to subrogation under any circumstance against City, its
officers and employees.
4.2 The Agency shall secure and maintain insurance for the duration of the contract. Proof of the
Agency's liability insurance shall be provided prior to receipt of a signed contract. The
following insurance is required.
4.2.1 Workers' Compensation Insurance covering all employees whether employed by the
Agency or any Subcontractor on the job including Employers Liability of at least
$1,000,000 aggregate.
Commercial General Liability Insurance at minimum combined single limits of
$1,000,000 each occurrence and in the aggregate and shall include the following:
$1,000,000 Products and completed operations
$1,000,000 Personal Injury and Advertising Injury
Crime Policy $500,000 General Aggregate
Automobile Liability - Agency's insurance shall contain a combined single limit of at
least $1,000,000 per occurrence, and include coverage for, but not limited to the
following: Any Auto
4.3 All policies or certificates shall also contain the following endorsements:
4.3.1 Name insured wording which includes the Agency, Subcontractors, and the City of
Lubbock with respect to general liability and automobile liability.
4.3.2 All liability policies shall contain cross liability and severability of interest clauses.
4.3.3 A waiver of subrogation in favor of the City of Lubbock for all types of insurance
coverages.
4.3.4 The policy shall be endorsed to require the insured to immediately notify the City of
Lubbock of any changes in the insurance coverage.
4.4 All insurance shall be purchased from an insurance company that meets the following
requirements.
4.4.1 A Best financial grading of A:VII or better
4.4.2 Licensed and admitted to do business in the State of Texas and is a subscriber to the
Texas Guaranty Fund.
4.5 All insurance must be written on forms filed with and approved by the Texas State Board of
Insurance. Certificates of insurance shall be prepared and executed by the insurance company
or its authorized agent and shall contain provisions representing and warranting the
following:
4.5.1 The company is licensed and admitted to do business in the State of Texas.
4.5.2 The company's forms have been approved by the Texas State Board of Insurance.
4.5.3 Sets forth all endorsements as required above.
4.6 The City of Lubbock shall receive at least twenty (20) calendar days' notice prior to
cancellation or termination of insurance, except in the case of non-payment.
5 PROPOSAL FORMAT
5.1 Proposals should provide a straightforward, concise description of the Agency's capabilities to
satisfy the requirements of the RFP. Emphasis should be on completeness, clarity of content,
and conveyance of the information requested by the City.
5.2 The proposal should be bound in a single volume where practical. All documentation
submitted with the proposal should be bound in that single volume. Notebooks are preferred.
5.3 If the proposal includes any comment over and above the specific information requested in the
RFP, it is to be included as a separate appendix to the proposal.
5.4 If the proposal includes any exception to the specific information requested in the RFP, it is to
be included as a separate appendix to the proposal.
5.5 Cover letter addressed to the Honorable Mayor and City Council that states the Proposer's
understanding of the services to be provided. Include any additional information believed
necessary that is not requested elsewhere in the RFP.
6 PROPOSER INFORMATION
6.1 The Agency shall submit the following information with their proposal. The proposal must be
submitted in an indexed binder with the required response item sections in the following order:
6.1.1 Describe the testing procedures used to determine skills and physical abilities of
workers.
6.1.2 Methodology used to supply qualified personnel after notification of need (criminal
history checks through the Texas Department of Public Safety, drug testing, etc.).
6.1.3 Ability to provide driver's license checks completed no longer than one year before
placement.
6.1.4 Describe procedures to replace workers that do not meet job expectations.
6.1.5 Describe normal billing procedures, include sample invoice, and state overtime rates.
Describe any special billing procedure, particularly markup on overtime rate and any
other special circumstance.
6.1.6 Describe CDL random drug testing for temporary drivers.
6.1.7 Describe bonding information (agency, capacities, etc.).
6.1.8 Describe any work restrictions (below ground, above ground, lifting of weight,
number of consecutive hours worked, driving/equipment, etc.).
6.1.9 Proposal Submittal Form Rate Sheet EXHIBIT C Part 1 and Part2.
6.1.10 Five (5) customer references, including name of customer, telephone number, and
individual to contact EXHIBIT D.

II. TEMPORARY WORKER QUALIFICATIONS
The following job descriptions are examples of the minimum experience required and fall under Level 1 of the
Proposal Submittal Form Rate Sheet in EXHIBIT C. Levels 2, 3, and 4 are used for experience in addition to
what is required in the below job descriptions. Depending on the department's needs, a request may be made
specifically for a bilingual temporary worker for any of the below positions.
Professional Positions
1.1 Summary: Performs professional level accounting duties to prepare and maintain accurate
financial records and provide financial reports to internal and external users.
Education/Experience: Any combination of education and experience equivalent to a bachelor
degree in accounting or finance with four years' experience required. May consider other
degree with 18 hours coursework in accounting. Knowledge of the principles, practices, and
standards of general and governmental accounting and financial and quantitative analysis
methods. Ability to prepare and review financial transactions; prepare accounting and financial
statements and schedules; communicate effectively orally and in writing; operate computer and
software; compile and interpret data; and analyze problems and develop effective solutions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Performs sedentary work that involves sitting most
of the time, but may involve walking or standing for brief periods of time; requires little or no
dexterity.
1.2 Worker's Compensation Classification of Operations Code: 8810
2 GIS/CAD Technician
2.1 Summary: Create and draw projects using computer aided design for drafting, and assist
customers and other city employees by providing maps and other info as needed.
Education/Experience: Requires an Associate's Degree involving engineering related
coursework with one year experience in drafting, mapping, or technical drawing; or any
combination of relevant education and experience. Must have experience involving engineering
related coursework, updating information in GIS systems, provide drafting for capital projects,
maintain permanent records, transfer information from hard maps to computer -based maps and
provide various customer supports.
Licenses/Certifications: Must possess a valid Texas Driver's license.
Work Conditions/Physical Requirements: Performs light work that involves walking or
standing most of the time and involves exerting up to 20 pounds of force on a regular and
recurring basis, or skill, adeptness and speed in the use of fingers, hands or limbs on repetitive
operation of mechanical or electronic office or shop machines or tools within moderate
tolerances or limits of accuracy.
2.2 Worker's Compensation Classification of Operations Code: 8810
3 End User Support Tech
3.1 Summary: Provide technical support for laptops, PC's, mobile devices, printers and peripherals
to restore service and deliver solutions to meet user requirements for all employees.
Education/Experience: Requires a Bachelor's Degree in management information systems,
computer science, or a related field. Related experience may substitute for education
requirement on a year-to-year basis. No specific experience required.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Performs light work that involves walking or
standing most of the time and involves exerting up to 20 pounds of force on a regular and
recurring basis, or skill, adeptness and speed in the use of fingers, hands or limbs on
repetitive operation of mechanical or electronic office or shop machines or tools within
moderate tolerances or limits of accuracy.
3.2 Worker's Compensation Classification of Operations Code: 5191
Clerical Positions
4 Account Clerk
4.1 Summary: Performs routine clerical tasks and reviews financial records.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and six months of experience in maintaining and reviewing financial and
statistical records. Knowledge of the procedures and terminology used in clerical accounting
duties; basic computer principles and procedures; and proper public contract and telephone
etiquette. Ability to compute and post arithmetical calculations, effectively operate standard
office equipment; communicate effectively with others; comprehend and follow oral and
written instructions and perform basic computer/word processing functions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Performs sedentary work that involves sitting most of
the time, but may involve walking or standing for brief periods of time; requires little or no
dexterity.
4.2 Worker's Compensation Classification of Operations Code: 8810
Administrative Assistant
5.1 Summary: Performs a wide variety of difficult clerical and secretarial duties.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and one year of increasingly responsible secretarial experience. Knowledge of
office practices and procedures; the organization, function, and policies of the departments;
general knowledge of municipal goveriunent organization and services; persoruiel and financial
recordkeeping; computer principles and procedures; and proper public contact and telephone
etiquette. Ability to spell and use correct grammar; prioritize and schedule work to meet
deadlines; transcribe material from a Dictaphone system; communicate effectively with others;
work independently in the absence of specific instructions; prepare accurate payroll and
financial records; perform computer/word processing functions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Performs sedentary work that involves walking or
standing some of the time and involves exerting up to 10 pounds of force on a regular and
recurring basis or sustained keyboard operations.
5.2 Worker's Compensation Classification of Operations Code: 8810
6 BookkLCM
6.1 Summary: Performs bookkeeping tasks of average difficulty.
Education/Experience: Any combination of education and experience equivalent to the
completion of a high school diploma with one year experience in clerical work involving
financial recordkeeping or bookkeeping. Knowledge of Excel and other accounting software
applications and fundamental bookkeeping procedures. Ability to make arithmetical
calculations with speed and accuracy; communicate effectively with others; and maintain
detailed financial records accurately.
Licenses/Certifications: None

6.1.1 Describe the testing procedures used to determine skills and physical abilities of workers.
Kelly Services' Online PinPoint Testing application allows our team to effectively measure a candidate's
job skills remotely or in a branch office via the Internet. Our recruiters can assign online tests to
candidates based on their skill set or role. As each test is completed, the results post automatically to
the candidate's record in our front -office system for documentation, and the recruiter receives an email
notification that score results are av& lable. This tool increases the efficiency of our recruiters and allows
us to more quickly screen candidates.
Our full catalog of testing options is quite exterosive, so we have provided summary information below
by skill set:
Assessments include Word, Windows, Access, Excel, Internet Explorer. MS Project,

in their specialty. In addition, candidates must complete a self -assessment of skills expertise for their
specialty area.

6.1.2 Methodology used to supply qualified personnel after notification of need (criminal history
checks through the Texas Department of Public Safety, drug testing, etc.).
Upon notification of a need for personnel from the City, Kelly will perform background and drug
screening based on your requirements (and in accordance with applicable laws) as a condition of
assignment. We have standard procedures and packages for background and drug screening that we
have established with third -party agencies, and these procedures ensure that we execute screening
consistently and accurately. The packages we offer are designed to balance your need to get temporary
talent to work quickly with the need to identify those that might pose a risk to your employees or
company. These screens can, and oftentimes should, be different from the screens you may run on
talent that you are hiring directly for yournrganization.
Background screening packages can include the review or verification of any number of items including:
criminal records, credit (when related to the position), social security trace (to develop additional
address and/or names for criminal searches), motor vehicle records, education, prior employment,
financial sanctions, credentials, or review against government/industry watch lists. Our standard drug
screening options include 5-10 panel urine test with additional panels for ecstasy and synthetic opiates
breath alcohol testing, and hair drug testing.
We comply with all applicable laws and Fair Credit Reporting Act (FORA) requirements in determining
our standard procedures and packages for background and drug screening. As an industry expert who
manages the complexities of employment every day, the City can use our expertise in this area to your
benefit.
6.1.3 Ability to provide driver's license checks completed no longer than one year before placement.
As noted in response to 6.1.2, Kelly can perform motor vehicle records checks at the request of the City.
6.1.4 Describe procedures to replace workers that do not meet job expectations.
If the City has a concern related to the performance of a Kelly employee, we have a standard process for
effectively working with our temporary employees when an assignment turns out to be less than
successful. This process is detailed below:

Kelly follows a progressive counseling process to address employee performance issues in a
positive manner with an emphasis on improvement (involving support resources as
necessary from leadership or HR):
Verbal notification and counseling/coaching (with follow up date)
Written reminder
Decision -making leave
Removal from assignment
If outcome of training or counseling is positive, the employee will continue the assignment
If outcome is not positive:
The employee's assignment will be ended, and Kelly will conduct an exit interview with the
Hiring Manager and the employee. Information from both interviews will be documented in the
employee's record.
We will document whether the City would allow this employee to return in the future and under
what parameters. The employee could be allowed to return only with pre -approval from the
City.
We will work with the Hiring Manager to determine if they want a replacement employee for
the remainder of the assignment or if the assignment has ended.

6.1.5 Describe normal billing procedures, include sample invoice, and state overtime rates. Describe
any special billing procedure, particularly markup on overtime rate and any other special
circumstance.
Kelly's standard invoice cycle is weekly —driven by the hours paid to each employee and the rate on
your associated order Once approved by the City, time and expenses will be entered into Kelly's payroll
system and uploaded to our billing system, which will generate your invoices each week.
Kelly is proactive in developing our invoices —with each designed to incorporate our clients' most
frequently requested features, data elements, and formats. Each invoice is subjected to a legal review,
minimizing potential co -employment risk from information shared between Kelly and our customers.
Kelly's standard invoices were developed using industry best practices and can include City -specific data
elements such as cost centers, ordering sources, types of temporary help, and amount spent.
From our flexible menu of options, we can provide the City with formats and data elements for different
functional areas, including accounts payable. human resources, purchasing/procurement. end users, and
operations management. Our electronic offerings will allow the City to define the report or sort
sequence that best meets your needs for communicating information throughout your organization. We
have provided a sample invoice in the "Attachments" section of our response.
Overtime Rate
Kelly will charge overtime rates only when a temporary employee's assignment for the City would legally
require overtime pay, and the City has approved or knowingly allowed the overtime. For every hour in
excess of forty (40) hours per week —except in states requiring payment for every hour in excess of eight
(8) hours per day, or where government contracts may stipulate differently —overtime paid at time and
one-half will be billed at the markup rate of 1.47 times the straight -time bill rate, as presented in the L.J
calculation: Overtime Bill Rate = (Straight -Time Pay Rate * Straight -Time Markup) * Overtime Markup
Factor
The billing procedure for overtime rates is the same as outlined above. u

Kelly carries Primary Crime (also known as Fidelity Bond or Commercial Blanket Bond) insurance in the
amount of $3,000,000 through Federal Insurance Company This covers employee dishonesty including
customer protection.
