RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for
and on behalf of the City of Lubbock, Contract No. 11997 for temporary employment services
per RFP 14-11911-DT, by and between the City of Lubbock and Elwood Staffing Services, Inc.,
and related documents. Said Contract is attached hereto and incorporated in this resolution as if
fully set forth herein and shall be included in the minutes of the City Council.

This Services Agreement (this "Agreement") is entered into as of the 1 lth day of September ,
2014, ("Effective Date") by and between Elwood Staffing Services. Inc. (the Contractor), and the City
of Lubbock (the "City").
RECITALS
WHEREAS, the City has issued a Request for Proposals 14-11911-DT for Temporary
Employment Services.
WHEREAS, the proposal submitted by the Contractor has been selected as the proposal which
best meets the needs of the City for this project; Temporary Employment Services for Clerical.
WHEREAS, Contractor desires to perform as an independent contractor to provide temporary
employment services upon terms and conditions maintained in this Agreement; and
NOW THEREFORE, for and in consideration of the mutual promises contained herein, the City
and Contractor agree as follows:
City and Contractor acknowledge the Agreement consists of the following exhibits which are
attached hereto and incorporated herein by reference, listed in their order of priority in the event of
inconsistent or contradictory provisions:

Article 1 Services
1.1 Contractor agrees to perform those services for the City that are specified on Exhibits A
and B (the "Services") and hereto. The contractor shall comply with all the applicable
requirements set forth in Exhibits A — D attached hereto.
1.2 Contractor shall use its commercially reasonable efforts to render Services under this
Agreement in a professional and business -like manner and in accordance with the
standards and practices recognized in the industry.
1.3 Nonappropriation clause. All funds for payment by the City under this Agreement are
subject to the availability of an annual appropriation for this purpose by the City. In the
event of non -appropriation of funds by the City Council of the City of Lubbock for the
goods or services provided under the Agreement, the City will terminate the Agreement,
without termination charge or other liability, on the last day of the then -current fiscal
year or when the appropriation made for the then current year for the goods or services
covered by this Agreement is spent, whichever event occurs first. If at any time funds
are not appropriated for the continuance of this Agreement, cancellation shall be
accepted by the Seller on thirty (30) days prior written notice, but failure to give such
notice shall be of no effect and the City shall not be obligated under this Agreement
beyond the date of termination.
Article 2 Miscellaneous.
2.1 This Agreement is made in the State of Texas and shall for all purposes be construed in
accordance with the laws of said State, without reference to choice of law provisions.
2.2 This Agreement is performable in, and venue of any action related or pertaining to this
Agreement shall lie in, Lubbock, Texas.
2.3 This Agreement and its Exhibits contains the entire agreement between the City and
Contractor and supersedes any and all previous agreements, written or oral, between the
parties relating to the subject matter hereof. No amendment or modification of the terms
of this Agreement shall be binding upon the parties unless reduced to writing and signed
by both parties.
2.4 This Agreement may be executed in counterparts, each of which shall be deemed an
original.
2.5 In the event any provision of this Agreement is held illegal or invalid, the remaining
provisions of this Agreement shall not be affected thereby.
2.6 The waiver of a breach of any provision of this Agreement by any parties or the failure
of any parties otherwise to insist upon strict performance of any provision hereof shall
not constitute a waiver of any subsequent breach or of any subsequent failure to
perform.
2.7 This Agreement shall be binding upon and inure to the benefit of the parties and their
respective heirs, representatives and successors and may be assigned by Contractor or
the City to any successor only on the written approval of the other party.
2.8 All claims, disputes, and other matters in question between the Parties arising out of or
relating to this Agreement or the breach thereof, shall be formally discussed and
negotiated between the Parties for resolution. In the event that the Parties are unable to
resolve the claims, disputes, or other matters in question within thirty (30) days of
written notification from the aggrieved Party to the other Party, the aggrieved Party shall
be free to pursue all remedies available at law or in equity.
2.9 At any time during the term of the contract, or thereafter, the City, or a duly authorized
audit representative of the City or the State of Texas, at its expense and at reasonable
times, reserves the right to audit Contractor's records and books relevant to all services
provided to the City under this Contract. In the event such an audit by the City reveals
any errors or overpayments by the City, Contractor shall refund the City the full amount
of such overpayments within thirty (30) days of such audit findings, or the City, at its
option, reserves the right to deduct such amounts owing the City from any payments due
Contractor.
2.10 The City reserves the right to exercise any right or remedy available to it by law,
contract, equity, or otherwise, including without limitation, the right to seek any and all
forms of relief in a court of competent jurisdiction. Further, the City shall not be subject
to any arbitration process prior to exercising its unrestricted right to seek judicial
remedy. The remedies set forth herein are cumulative and not exclusive, and may be
exercised concurrently. To the extent of any conflict between this provision and another
provision in, or related to, this document, this provision shall control.
2.11 The City agrees to provide operational instruction to Contractor's employees in the
same manner as City's employees. The parties agree that each shall notify the other in
the event it learns of an accident or injury in the workplace involving a Contractor
employee. The City agrees that it will allow Contractor's qualified representative to
conduct an onsite investigation for any injury or accident involving a Contractor
employee.
2.12 The undersigned agree that nothing herein shall be construed to confer employee status
on any person acting on behalf of Contractor.

I. SCOPE OF WORK
BACKGROUND
1.1 The City of Lubbock (hereinafter called "City") is seeking proposals from temporary
employment agencies (hereinafter called "Agency") for information on the quality and cost of
temporary employment services. The City utilizes approximately 25 to 35 technical/clerical
temporary workers per year. Each technical/clerical temporary worker requested works from a
few days to several weeks, where the majority of requests are two to six weeks in duration.
The City also utilizes approximately 90 to 150 trades/labor temporary workers per year. The
majority of these workers are utilized during the summer months as seasonal workers and work
from about the middle of May through the middle of September.
1.2 The City may select more than two temporary employment agencies, per job family category, to
service this contract and will provide personnel requests to the agencies that provide the most
prompt and quality placement by category. The City has spent an average of $1.5 million each
year over the past five years for temporary employment services. The total appropriation for
temporary employment services in FY 2013-2014 budget is $1.4 million.
1.3 The City of Lubbock will require the successful temporary employment agencies to conduct a
standard background check for all temporary employees placed with the City and provide
copies to the designated representative at the City of Lubbock.
1.3.1 Telephone reference checks to ensure education and skills are correct, as presented on
an applicant's application.
1.3.2 Conduct criminal history checks, through the Texas Department of Public Safety, on all
applicants who are being referred for Cityjobs.
1.3.3 Make every reasonable effort to contact past and present employers to gain information
about the work habits of the applicant(s).
1.3.4 The Lubbock Police Department will conduct a more thorough background check on
any temporary employee(s) who will be required to work in confidential police work
areas or police records.
1.4 The City of Lubbock will require the temporary employment agencies to conduct pre-
employment screening for all temporary employees placed with the City and provide
documentation that the temporary employees passed to the designated representative at the City
of Lubbock.
1.4.1 All temporary employees must have a drug screening completed within ten (10) days
prior to placement.
1.4.2 Temporary employees in trades positions will have a physical exam, as needed,
completed within thirty (30) days prior to placement, unless they have had one within
the last six (6) months.
1.4.3 Temporary employees who drive City vehicles must have a driver's license check
completed within one (1) year prior to placement.
1.5 The City currently uses Microsoft Word for Windows and Excel for Windows.
2 GENERAL CONDITIONS
2.1 Agency will quote an hourly wage and bill rate at various levels (EXHIBIT C) for each type of
temporary worker described in the job descriptions in EXHIBIT B, as applicable. These rates
will remain effective for one year. Any increases in the second and third year of the contract
shall be in accordance with the Consumer Price Index. The rate should encompass any payments
to the temporary employee as well as applicable costs for conducting Drivers License Checks,
Criminal History Background Checks, Drug/Alcohol Screens, Physicals, etc. Workers
compensation coverage will be the responsibility of the agencies.
Agency must notate any difference in mark-up percentage for overtime pay. Overtime is defined
as more than 40 hours actually worked in any one week beginning on Sunday and ending on
Saturday.
City of Lubbock retirees are an exception to the quoted rates. The hourly wage shall be verified
with the designated representative at the City of Lubbock prior to the temporary assignment. The
bill rate for these employees shall be at the same percentage or better as all other temporary
employees.
The City reserves the right to request a temporary employee for a position that is not included in
this contract. The hourly wage shall be verified with the designated representative at the City
prior to the temporary assignment. These rates will be at 5% under the City's pay plan but no
lower than minimum wage. The bill rate for these temporary employees shall be at the same
percentage as all other temporary employees.
2.2 The selected agencies will appoint one person who is an employee of the agency who will service
this contract and who will be the liaison between the City and their agency.
2.3 The agencies will be solely responsible for ensuring the workers they provide the City meet all
legal requirements to be able to work in the United States and complete the I-9 form accurately
and in its entirety.
2.4 The agencies will be able to provide temporary workers within 8 hours of the request and if the
City is not contacted and/or provided with a temporary within that time period the City reserves
the right to contact another agency for service.
2.5 The agencies will provide workers who possess the necessary skills, knowledge, and ability to
perform the jobs into which they are to be placed, as per attached job description.
2.6 The City reserves the right to reject workers provided by the successful agencies, if they are
found to be unacceptable before or after starting on the job to which they have been assigned.
2.7 There shall be no obligation on the part of the City to hire any temporary worker it is supplied
under the terms of this RFP on a full time basis following the term of the temporary employment.
2.8 Should the City wish to hire an individual who has been filling the temporary position, neither the
individual nor the City will be required to pay a placement fee.
2.9 The selected agencies will have and maintain a $500,000 crime bond on the employees it
provides to the City to protect the City from any loss caused by the workers it provides.
2.10 The successful agencies are to provide the City with weekly billing by department. Normal
payment terms are Net 30. The ability to accept a City purchasing card for payment is preferred.
3 CONTRACT TERM/TERMINATION
3.1 The contract shall be for a term of one year with the option to renew for two additional one year
teens, said date of term beginning upon City Council date of formal approval and shall continue
without interruption from the executed date, under the same terms and conditions.
3.2 The City reserves the right to terminate the contract in whole or in part, for any reason, by
providing a thirty (30) day written notice to the Agency.
4 INDEMNITY INSURANCE
PROOF OF COVERAGE SHALL BE FURNISHED TO THE CITY OF LUBBOCK IN THE
FORM OF A CERTIFICATE OF INSURANCE. THE INSURANCE CERTIFICATES FURNISHED
SHALL NAME THE CITY OF LUBBOCK AS A PRIMARY ADDITIONAL INSURED AND
PROVIDE A WAIVER OF SUBROGATION IN FAVOR OF THE CITY OF LUBBOCK, OR IN THE
ALTERNATIVE, SHALL BE ACCOMPANIED BY A STATEMENT FROM THE CONTRACTOR
TO THE EFFECT THAT NO WORK ON THIS PARTICULAR PROJECT SHALL BE
SUBCONTRACTED. IT SHALL BE THE CONTRACTOR'S RESPONSIBILITY TO PROVIDE TO
THE OWNER ALL PROOF OF COVERAGE INSURANCE DOCUMENTS INCLUDING
WORKERS COMPENSATION COVERAGE FOR EACH SUBCONTRACTOR.
4.1 Agency shall indemnify, hold harmless, and defend the City of Lubbock, its officers and
employees from and against any and all liability or alleged liability without fault and liability
by virtue of the obligations that the City of Lubbock assumes toward its indemnity(s) insofar as
applicable to this Contract or the work to be performed hereunder and including cost of suit,
attorneys' fees, and all other related costs and expenses of whatever kind or character arising
directly or indirectly from any cause whatsoever in connection with or incidental to this
Contract or the work to be performed hereunder, including such injury or harm as may be
caused in part by any neglect, act, or omission of the City, its officers and employees, excepting
only such injury or harm as may be caused solely by an act or omission of the City, its officers
and employees. Notwithstanding the foregoing, the Agency specifically agrees to so indemnify,
hold harmless, and defend the City from and against any and all such liability, suits, action,
Iegal proceedings, claims, or demands that may be made or pursued by an employee of Agency,
or of any subcontractor, or materials man, or anyone acting on behalf of contractor in
connection with or incidental to this Contract which are alleged to be attributable to any
condition of or upon the City's property facilities, materials, or equipment, including where
such condition and resulting injury or harm is caused in part by any negligent act or omission of
City, its officers and employee, but excepting only such injury or harm as may caused solely by
an act or omission of City, its officers and employees. Agency agrees to waive any and all
claims and suits covered by this indemnity agreement and agrees that any insurance carrier
involved shall not be entitled to subrogation under any circumstance against City, its officers
and employees.
To the extent permitted by law, the City of Lubbock will defend, indemnify and hold Agency
and its parent, subsidiaries, directors, officers, agents, representatives, and employees harmless
from all claims, losses, and liabilities (including reasonable attorney fees) to the extent caused
by the City of Lubbock's breach of this Agreement; its failure to discharge its duties and
responsibilities set forth in this Agreement; or the negligence, gross negligence, or willful
misconduct of the City of Lubbock or the City of Lubbock's officers, employees, or authorized
agents in the discharge of those duties and responsibilities, if the City of Lubbock's immunity
under such misconduct is waived under the Texas Tort Claims Act. Likewise, and to the extent
permitted by law, Agency will defend, indemnify and hold the City of Lubbock, its officers,
agents, representatives, and employees harmless from all claims, losses, and liabilities
(including reasonable attorney fees) to the extent caused by Agency's breach of this
Agreement; its failure to discharge its duties and responsibilities set forth in this Agreement; or
the negligence, gross negligence, or willful misconduct of Agency or Agency's officers,
employees, or authorized agents in the discharge of those duties and responsibilities.
4.2 The Agency shall secure and maintain insurance for the duration of the contract. Proof of the
Agency's liability insurance shall be provided prior to receipt of a signed contract. The
following insurance is required.
4.2.1 Workers' Compensation Insurance covering all employees whether employed by the
Agency or any Subcontractor on the job including Employers Liability of at least
$500,000 aggregate.
Commercial General Liability Insurance at minimum combined single limits of
$500,000 each occurrence and in the aggregate and shall include the following:
$500,000 Products and completed operations
$500,000 Personal Injury and Advertising Injury
$500,000 Contractual Liability
Automobile Liability - Agency's insurance shall contain a combined single limit of at
least $500,000 per occurrence, and include coverage for, but not limited to the
following: Hired and Non -Owned Auto
4.3 All policies or certificates shall also contain the following endorsements:
4.3.1 Additional insured wording which includes the Agency, Subcontractors, and the City
of Lubbock with respect to general liability.
4.3.2 All liability policies shall contain cross liability and severability of interest clauses.
4.3.3 A waiver of subrogation in favor of the City of Lubbock for all types of insurance
coverages.
4.3.4 The policy shall be endorsed to require the insured to notify the City of Lubbock in
accordance with the policy provisions.
4.4 All insurance shall be purchased from an insurance company that meets the following
requirements.
4.4.1 A Best financial grading of A:VII or better
4.4.2 Licensed and admitted to do business in the State of Texas and is a subscriber to the
Texas Guaranty Fund.
4.5 All insurance must be written on forms filed with and approved by the Texas State Board of
Insurance. Certificates of insurance shall be prepared and executed by the insurance company
or its authorized agent and shall contain provisions representing and warranting the following:
4.5.1 Sets forth all endorsements as required above.
4.6 The City of Lubbock shall receive notice in accordance with the policy provisions should any
of the policies be cancelled before the expiration date thereof.

III. TEMPORARY WORKER QUALIFICATIONS
The following job descriptions are examples of the minimum experience required and fall under Level 1 of the
Proposal Submittal Form Rate Sheet in EXHIBIT C. Levels 2, 3, and 4 are used for experience in addition to
what is required in the below job descriptions. Depending on the department's needs, a request may be made
specifically for a bilingual temporary worker for any of the below positions.
Technical/Clerical Positions
Account Clerk
1.1 Summary: Performs routine clerical tasks and reviews financial records.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and six months of experience in maintaining and reviewing financial and
statistical records. Knowledge of the procedures and terminology used in clerical accounting
duties; basic computer principles and procedures; and proper public contract and telephone
etiquette. Ability to compute and post arithmetical calculations, effectively operate standard
office equipment; communicate effectively with others; comprehend and follow oral and
written instructions and perform basic computer/word processing functions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally stand and bend during the
shift; occasionally lift and carry up to 10 pounds; push and pull objects; frequently rotate upper
trunk to the left or right while sitting or standing; and place arms above, at, or below shoulder
height.
1.2 Worker's Compensation Classification of Operations Code: 8810
2 Accountant (Accountine)
2.1 Summary: Performs professional level accounting duties to prepare and maintain accurate
financial records and provide financial reports to internal and external users.
Education/Experience: Any combination of education and experience equivalent to a bachelor
degree in accounting or finance with no specific experience required. May consider other
degree with 18 hours coursework in accounting. Knowledge of the principles, practices, and
standards of general and governmental accounting and financial and quantitative analysis
methods. Ability to prepare and review financial transactions; prepare accounting and financial
statements and schedules; communicate effectively orally and in writing; operate computer and
software; compile and interpret data; and analyze problems and develop effective solutions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally lift up to 25 pounds;
occasionally carry up to 25 pounds; frequently stand and walk; occasionally kneel; frequently
pull or push objects; frequently rotate upper trunk to right or left while sitting or standing;
frequently reach above, at, or below shoulder height; and frequently handle objects.
2.2 Worker's Compensation Classification of Operations Code: 88 10
3 Administrative Assistant
3.1 Summary: Performs a wide variety of difficult clerical and secretarial duties.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and three to six years of increasingly responsible secretarial experience.
Knowledge of office practices and procedures; the organization, function, and policies of the
departments; general knowledge of municipal government organization and services; personnel
and financial recordkeeping; computer principles and procedures; and proper public contact
and telephone etiquette. Ability to spell and use correct grammar; prioritize and schedule work
to meet deadlines; transcribe material from a Dictaphone system; communicate effectively with
others; work independently in the absence of specific instructions; prepare accurate payroll and
financial records; perform computer/word processing functions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally stand, walk, kneel, and bend
during the shift; push and pull objects; occasionally flex upper trunk forward at the waist and
partially at the knees; occasionally lift and carry up to 10 pounds; occasionally rotate upper
trunk to the right or left while sitting or standing; and place arms above, at, and below shoulder
height.
3.2 Worker's Compensation Classification of Operations Code: 8810
Bookkeeper(AccountinQ)
4.1 Summary: Performs bookkeeping tasks of average difficulty.
Education/Exgerience: Any combination of education and experience equivalent to the
completion of a high school diploma with two years experience in clerical work involving
financial recordkeeping or bookkeeping. Knowledge of Excel and other accounting software
applications and fundamental bookkeeping procedures. Ability to make arithmetical
calculations with speed and accuracy; communicate effectively with others; and maintain
detailed financial records accurately.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally lift and carry up to 10
pounds; occasionally climb stairs during the shift; frequently rotate upper trunk to the right or
left while sitting or standing; and place arms above, at, or below shoulder height.
4.2 Worker's Compensation Classification of Operations Code: 8810
5 Call Taker
5.1 Summary: Provide contact service, information, and support to the public through the Citizen
Call Center.
Education/Experience: Any combination of education and experience equivalent to the
completion of a high school diploma with one year of clerical or customer service experience.
Knowledge of customer service methods and practices; practices of a call center environment;
professional telephone etiquette; and computer software and use of business computer. Ability
to communicate verbally in a clear manner in the English language; answer calls and
communicate with others using professional telephone etiquette; assist caller in clarifying the
request or issue; apply knowledge and reasoning to determine the most suitable means for
initiating action to resolve a complaint or problem; provide accurate information to callers;
operate computer and various office equipment; use a telephone for long periods of time;
follow verbal and written instructions; and communicate effectively in writing.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to sit for extended periods; occasionally
stand and walk; frequently flex upper trunk forward; frequently lift up to 10 pounds;
occasionally carry up to 10 pounds; frequently pull or push objects; frequently rotate upper
trunk forward while sitting or standing; frequently reach above, at, or below shoulder height;
and continuously talk, see, and hear.
5.2 Worker's Compensation Classification of Operations Code: 8810
Cashier
6.1 Summary: Receives and accounts for money.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and three to six months of general clerical experience. Knowledge of the
methods of receiving and accounting for money and basic office procedures. Ability to make
simple arithmetical computations quickly and accurately; accurately maintain financial records
and accounts; and communicate effectively with others.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally lift up to 10 pounds;
occasionally stand, bend, and kneel during the shift; push and pull objects; frequently rotate
upper trunk to the right or left while sitting or standing; and place arms above, at, or below
shoulder height.
6.2 Worker's Compensation Classification of Operations Code: 8810
Office Assistant
7.1 Summary: Performs a variety of clerical and secretarial duties of average difficulty.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and one to three years of secretarial experience. Knowledge of office
practices and procedures; computer principles and procedures; and proper public contact and
telephone etiquette. Ability to spell and use correct grammar; transcribe material from a
Dictaphone; communicate effectively with others; prepare and maintain accurate records; and
perform computer/word processing functions.
Licenses/Certifications: Must be able to type 55 words per minute.
Work Conditions/Physical Requirements: Ability to occasionally stand, walk, kneel, and bend

8 P/T Customer Service Representative (Museum Gift Shop)
8.1 Summary: Interacts with citizens in person or by telephone to process service requests, accept
payments, provide information, or resolve problems.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and six months to one year of sales or customer service experience.
Knowledge of retail and museum practices and procedures; the organization, function, and
policies of the department; general knowledge of municipal government organization and
services; principles and procedures in operating business computers; and proper public contact
and telephone etiquette. Ability to spell and use correct grammar; prioritize and schedule work
to meet deadlines; communicate effectively with others; follow oral and written instructions;
work independently in the absence of specific instructions; prepare and maintain accurate

Nikki Held, Branch Manager
Nikki Held will serve as the Liaison between the City and Elwood Staffing and will be your
primary contact should you have questions about our response to this RFP. Additionally
she will be the designated representative for the oversight of the City account. Nikki will
negotiate pricing as it relates to scope of service, implement processes and procedures for
the successful service launch, and set service level expectations as required by the City.
Nikki began her career with Elwood Staffing in July 2008 as a Staffing Manager in our
Hobbs, New Mexico branch. She was quickly promoted to Senior Staffing Manager and
then Branch Manager. In August 2013—after five successful years in our Hobbs branch —
Nikki transferred to our Lubbock branch, where she leads the local team and oversees
operations, recruitment, placement, compliance, and internal personnel functions.
Nikki is supported by Business Development Manager, Shelley Shields, Area Manager,
Galen Root, and the experienced branch staff in all processes. Nikki and/or her designee
will establish a relationship with a City contact and will service the City based on criteria
specific to the City. Nikki, along with the branch support staff will:

• Communicate with management via meetings, email and/or memos on current week's

Shelley Shields will provide backup support for the City account. Shelley has been with
Elwood Staffing a little over one year and has already been named as one of the top ten

Elwood Staffing, Shelley is responsible for developing and maintaining new and existing
business relationships in Lubbock and the surrounding area within a 50-mile radius.
Penny Moore, Staffing Manager
Penny is the newest member of our team, having joined Elwood Staffing in April 2014.
As a Staffing Manager Penny recruits, interviews and evaluates the skills of potential
Elwood Staffing associates with the goal of finding a job than they enjoy, while meeting
the needs of our clients as quickly and smoothly as possible.

Galen is responsible for the management of a team of Staffing Consultants in New i✓Iexico
and North/Central West Texas. His core responsibilities include driving the sales and
service efforts of the region as well as ensuring that his team has the tools and resources
they need to be successful. A Certified Staffing Professional (CSP), Galen partners with a
wide range of client companies across all industries. He excels at uncovering client needs
and creating solutions that save organizations time and money.
With an emphasis on working within the business community to strengthen the local
economic environment and create opportunities for job seekers, Galen is involved with
organizations such as Class 4 Winds, Panhandle Economic Development Council, and
various Chambers of Commerce.

SECTION 6. PROPOSER INFORMATION
6.1.1 Describe the testing procedures used to determine skills and physical abilities of workers.
We will conduct a needs assessment of the City and carefully examine the Technical/Clerical
job descriptions before we start the extensive screening process of selecting potential
candidates for your open positions. To provide a quality search tailored to the City's needs, we
will carefully consider each employee's: compatibility with the City culture, as well as skills &
abilities, attitude/personality and work history.
During our online application process candidates enter skill codes for each job they list in their
employment history. Further testing designed to match specific skills fisted in the online
application may be administered during the in -person interview process. Upon the City's
request additional customized testing may be
administered based on the job order requirements.
Elwood Staffing uses Kenexa® Prove Itl®, an award -
winning leader in internet and computer -based testing
to identify and select the ideal candidates for your
positions. This testing is administered in the local
office under the direction of our experienced branch
staff. Prove Itl features over 1,500 validated tests for
basic clerical, software knowledge, call center, financial,
healthcare, industrial, and technical job classifications.
Some of our standard testing includes Word, Excel,
Typing, Ten Key, Spelling, Grammar, Math, and Filing. Additionally, we have evaluations to
assess skills such as basic English, basic math, reading, and manual dexterity.

At Elwood we have developed a soft skills training program called STAR —Success Through
Associate Readiness. As competitive work environments become more demanding, complex
and diverse, the core skill sets found in quality contingent workers must evolve to meet those
needs. Basic technical skills may be enough to get a foot in the door, but they fall short of
providing a long-term basis for success. This initiative is specifically designed to instill and
reinforce the most important workplace behaviors in our associates so they are prepared, on
day one, to deliver quality results. To meet this challenge, every new associate must complete
the STAR training program before they begin their first client assignment.
The idea behind STAR is simple: An informed, well-rounded associate is more likely to
succeed. After reviewing the national data, we turned to our client companies to help identify
the most important soft skills needed in the entry-level workforce. After several meetings
across a wide variety of sectors and specialties, four areas of need became clear. They are:

We will either fill your order or update you on our progress within 8 hours of the request.
Applicants must be at least 18 years of age to complete our registration process and may
complete our online application 24 hours a day, 7 days a week, 365 days a year. Upon completion
of an application, candidates are scheduled for an in -person behavioral interview with one of our
staffing professionals. Prior to placement, all applicants musr pass a proprietary math, matching,
and instruction -following test. Additionally, we are currently piloting a proprietary assessment
that identifies an applicant's unproductive behaviors and likelihood of workplace success.
Screening & Selection
Our thorough screening process works to identify applicants demonstrating flexibility, a
positive work ethic and proven reliability. We will partner with you to create the proper
screening tools to secure a team of people who are ready to work for you. Upon a conditional
job offer, a qualified candidate undergoes more comprehensive screening that includes:
Employment Eligibility Verification
Elwood Staffing complies with all aspects of the Immigration Reform and Control Act regarding
Form 19 completion and retention. All Elwood Staffing offices use the Department of Homeland
Security E-Verify6 program to verify employment eligibility of all newly hired employees.
Drug Screening
We will complete drug screening within ten (10) days prior to placement and will provide
documentation that the temporary employees passed to the designated representative at the
City of Lubbock. Most Elwood Staffing branches conduct in -office drug screens; our standard
drug screen is a 5-panel urine screen. Branch personnel complete a certification process prior
to being permitted to administer a drug screen, and our standard operating procedures mitigate
risks of invalid samples or sample contamination.
Background/Criminal History Checks
We will conduct a standard background check for all temporary employees placed with the City
and will provide copies to the designated representative at the City. Elwood Staffing offers
comprehensive background check options to help you confidently choose the right members
for your team. Based on your criteria, we will arrange to order court records, complete both
professional and personal reference checks, and verify credentials. Our standard background
check vendor is Asurint. We will also conduct criminal history checks, through the Texas
Department of Public Safety, on all applicants who are being referred for City jobs.
Education Verification
Either local branch staff or our background check vendor, will conduct telephone reference
checks to ensure education and skills are correct, as presented on an applicant's application. They
will contact the educational institution to confirm the individual's education, to include dates of
atrendance, degree(s) and/or credenrial(s) received, and if any honors were attached to the degree.
Previous Work History References
Elwood Staffing will make every reasonable effort to contact past and present employers to
gain information about the work habits of the applicant(s). Whenever possible, employment
verification is completed through a personal phone call to the human resource department of
the associate's previous employer.

6.1.3 Ability to provide driver's license checks completed no longer than one year
before placement.
We are bidding on Technical/Clerical positions only, and none of those positions require the
associate to possess a valid Texas Driver's license.
6.1.4 Describe procedures to replace workers that do not meet job expectations.

100% customer satisfaction is our goal. We build a pool of qualified candidates to guarantee
the quality of our senice, as well as to meet our clients' specific criteria. If the City is
dissatisfied with the performance of an associate, we will replace that person from our
prescreened candidate pool. Elwood will not bill the City for any unsatisfactory hours —if
brought to our attention within the first four hours of an employee assignment.
Prescreened Candidate Pool
Elwood's recruitment and screening process revolves around a practice of assigning candidates
to our clients' pools that are ready to work. We will coordinate with the City to determine the
appropriate pool size —based on anticipated hiring, turnover and a buffer for fall -out. We will
then base our recruiting strategy on the need to maintain a pool of the appropriate size.
Candidates will understand that to be in our City of Lubbock pool, they will be fully screened
and must be prepared to report to work on short notice. We make sure all candidates in our pool
have been thoroughly screened.
When we say a candidate is in our "pool" we mean the individual has been through the entire
screening process —based on the client's requirements. Once we add an individual to a specific
client candidate pool the candidate records are automatically audited to make sure the candidate
meets the specific criteria set by the client. We will proactively develop and maintain a pool of
qualified candidates to meet the City's specific staffing requests for Technical/Clerical personnel.
We will conduct orientation/training on a regularly scheduled basis to maintain an adequate pool
of "ready to work" associates. We will maintain an up-to-date list of these associates to enable us
to react to short -notice or emergency situations.
6.1.5 Describe normal billing procedures and include a sample invoice.

6.1.6 Describe CDL random drug testing for temporary drivers.
We are bidding on Technical/Clerical positions only, so we will not be placing temporary drivers.
6.1.7 Describe bonding information (agency, capacities, etc.).
We have a $1 i`l crime policy that meets the City's bonding requirements.
6.1.8 Describe any work restrictions (below ground, above ground, lifting of weight,
number of consecutive hours worked, driving/equipment, etc.).
We are bidding on Technical/Clerical positions only, and these positions do not involve below
ground, above ground, lifting of weight, driving/equipment, etc. The only work restriction we
may encounter is the number of consecutive hours worked. Overtime is paid after the
completion of 40 hours in a single pay period (Monday thru Sunday) unless another period is
specified in advance based on customer demand. Elwood Staffing complies with all state laws
concerning the payment of overtime. If the state where the work is performed requires the
payment of overtime for any period other than a forty -hour week, Elwood Staffing will comply
with such law.
6.1.9 Proposal Submittal Form Rate Sheet EXHIBIT C.
Elwood Staffing provides competitive pay rates to attract only the most qualified individuals.
We believe these rates to be current and fair, not only to potential employees but to you, our
client, as well. We arc proud to provide the City with quality temporary associates. It is our goal
to ensure your job assignments arc completed correctly and on time.
A key element of our success is the quality of skill, ability and work ethic of the temporary
associate we select to work with you. Elwood Staffing's hourly rates (bill rates) include all costs
for recruiting, screening, payroll, payroll taxes (including contributions for Social Security,
unemployment and workers' compensation) and all tax filing and recordkeeping. We have a
four-hour per day minimum work schedule for all associates.

1. Section 2.1 of General Conditions in the proposal states, "Agency must notate any
difference in mark-up percentage for overtime pay." Please clarify if a different exist
from the mark-up on standard hours.
Regular markup percentages and overtime markup percentages are the same. Should
an associate be required to work overtime hours, Elwood Staffing will pay the
associate the established pay rate times the standard 1.5% for overtime pay, and the
City of Lubbock will be billed the established markup for the overtime hours. As an
example, a Level 1 Account Clerk works overtime. The City is billed as follows:
Example: $10.26 (regular pay rate) x 1.5% (OT rate) = $15.39 (OT pay rate) x 1.3255
(regular markup [32.559/6]) = $20.40 (OT bill rate paid by the City of Lubbock).
2. Section 2.10 of General Conditions in the proposal states: "The successful agencies are
to provide the City with weekly billing by department. Normal payment terms are Net
30. The ability to accept a City purchasing card for payment is preferred." Please
confirm that this is acceptable, should your company be awarded the contract.
Payment is typically due "net 14 days" from date of invoice. However, Elwood
Staffing is happy to offer the City of Lubbock extended payment terms of "net 30
days" from date of invoice.
Although Elwood Staffing's preferred payment method is EFT, Elwood Staffing will
accept a City purchasing card. We accept American Express, MasterCard, and Visa.
3. In Exhibit C, under Technical/Clerical positions, you entered N/A for the Cashier
position. Please clarify that this is a "No Bid" or not offered by your company.
