RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for
and on behalf of the City of Lubbock, Contract No. 11996 for temporary employment services
per RFP 14-11911-DT, by and between the City of Lubbock and itsQuest, Inc., and related
documents. Said Contract is attached hereto and incorporated in this resolution as if fully set
forth herein and shall be included in the minutes of the City Council.

This Services Agreement (this "Agreement") is entered into as of the 1 lth day of September
2014, ("Effective Date") by and between itsOuest, Inc. (the Contractor), and the City of Lubbock (the
"City„).
RECITALS
WHEREAS, the City has issued a Request for Proposals 14-11911-DT for Temporary
Employment Services.
WHEREAS, the proposal submitted by the Contractor has been selected as the proposal which
best meets the needs of the City for this project; Temporary Employment Services.
WHEREAS, Contractor desires to perform as an independent contractor to provide temporary
employment services upon terms and conditions maintained in this Agreement; and
NOW THEREFORE, for and in consideration of the mutual promises contained herein, the City
and Contractor agree as follows:
City and Contractor acknowledge the Agreement consists of the following exhibits which are
attached hereto and incorporated herein by reference, listed in their order of priority in the event of
inconsistent or contradictory provisions:

Article 1 Services
1.1 Contractor agrees to perform those services for the City that are specified on Exhibits A
and B (the "Services") and hereto. The contractor shall comply with all the applicable
requirements set forth in Exhibits A — D attached hereto.
1.2 Contractor shall use its commercially reasonable efforts to render Services under this
Agreement in a professional and business -like manner and in accordance with the
standards and practices recognized in the industry.
1.3 Nonappropriation clause. All funds for payment by the City under this Agreement are
subject to the availability of an annual appropriation for this purpose by the City. In the
event of non -appropriation of funds by the City Council of the City of Lubbock for the
goods or services provided under the Agreement, the City will terminate the Agreement,
without termination charge or other liability, on the last day of the then -current fiscal
year or when the appropriation made for the then current year for the goods or services
covered by this Agreement is spent, whichever event occurs first. If at any time funds
are not appropriated for the continuance of this Agreement, cancellation shall be
accepted by the Seller on thirty (30) days prior written notice, but failure to give such
notice shall be of no effect and the City shall not be obligated under this Agreement
beyond the date of termination.
Article 2 Miscellaneous.
2.1 This Agreement is made in the State of Texas and shall for all purposes be construed in
accordance with the laws of said State, without reference to choice of law provisions.
2.2 This Agreement is performable in, and venue of any action related or pertaining to this
Agreement shall lie in, Lubbock, Texas.
2.3 This Agreement and its Exhibits contains the entire agreement between the City and
Contractor and supersedes any and all previous agreements, written or oral, between the
parties relating to the subject matter hereof. No amendment or modification of the terms
of this Agreement shall be binding upon the parties unless reduced to writing and signed
by both parties.
2.4 This Agreement may be executed in counterparts, each of which shall be deemed an
original.
2.5 In the event any provision of this Agreement is held illegal or invalid, the remaining
provisions of this Agreement shall not be affected thereby.
2.6 The waiver of a breach of any provision of this Agreement by any parties or the failure
of any parties otherwise to insist upon strict performance of any provision hereof shall
not constitute a waiver of any subsequent breach or of any subsequent failure to
perform.
2.7 This Agreement shall be binding upon and inure to the benefit of the parties and their
respective heirs, representatives and successors and may be assigned by Contractor or
the City to any successor only on the written approval of the other party.
2.8 All claims, disputes, and other matters in question between the Parties arising out of or
relating to this Agreement or the breach thereof, shall be formally discussed and
negotiated between the Parties for resolution. In the event that the Parties are unable to
resolve the claims, disputes, or other matters in question within thirty (30) days of
written notification from the aggrieved Party to the other Party, the aggrieved Party shall
be free to pursue all remedies available at law or in equity.
2.9 At any time during the term of the contract, or thereafter, the City, or a duly authorized
audit representative of the City or the State of Texas, at its expense and at reasonable
times, reserves the right to audit Contractor's records and books relevant to all services
provided to the City under this Contract. In the event such an audit by the City reveals
any errors or overpayments by the City, Contractor shall refund the City the full amount
of such overpayments within thirty (30) days of such audit findings, or the City, at its
option, reserves the right to deduct such amounts owing the City from any payments due
Contractor.
2.10 The City reserves the right to exercise any right or remedy available to it by law,
contract, equity, or otherwise, including without limitation, the right to seek any and all
forms of relief in a court of competent jurisdiction. Further, the City shall not be subject
to any arbitration process prior to exercising its unrestricted right to seek judicial
remedy. The remedies set forth herein are cumulative and not exclusive, and may be
exercised concurrently. To the extent of any conflict between this provision and another
provision in, or related to, this document, this provision shall control.

I. SCOPE OF WORK
BACKGROUND -
1.1 The City of Lubbock (hereinafter called "City") is seeking proposals from temporary
employment agencies (hereinafter called "Agency") for information on the quality and cost of
temporary employment services. The City utilizes approximately 25 to 35 technical/clerical
temporary workers per year. Each technical/clerical temporary worker requested works from a
few days to several weeks, where the majority of requests are two to six weeks in duration.
The City also utilizes approximately 90 to 150 trades/labor temporary workers per year. The
majority of these workers are utilized during the summer months as seasonal workers and work
from about the middle of May through the middle of September.
1.2 The City may select more than two temporary employment agencies, per job family category, to
service this contract and will provide personnel requests to the agencies that provide the most
prompt and quality placement by category. The City has spent an average of $1.5 million each
year over the past five years for temporary employment services. The total appropriation for
temporary employment services in FY 2013-2014 budget is $1.4 million.
1.3 The City of Lubbock will require the successful temporary employment agencies to conduct a
standard background check for all temporary employees placed with the City and provide
copies to the designated representative at the City of Lubbock.
1.3.1 Telephone reference checks to ensure education and skills are correct, as presented on
an applicant's application.
1.3.2 Conduct criminal history checks, through the Texas Department of Public Safety, on all
applicants who are being referred for City jobs.
1.3.3 Make every reasonable effort to contact past and present employers to gain information
about the work habits of the applicant(s).
1.3.4 The Lubbock Police Department will conduct a more thorough background check on
any temporary employee(s) who will be required to work in confidential police work
areas or police records.
1.4 The City of Lubbock will require the temporary employment agencies to conduct pre-
employment screening for all temporary employees placed with the City and provide
documentation that the temporary employees passed to the designated representative at the City
of Lubbock.
1.4.1 All temporary employees must have a drug screening completed within ten (10) days
prior to placement.
1.4.2 Temporary employees in trades positions will have a physical exam, as needed,
completed within thirty (30) days prior to placement, unless they have had one within
the last six (6) months.
1.4.3 Temporary employees who drive City vehicles must have a driver's license check
completed within one (1) year prior to placement.
1.5 The City currently uses Microsoft Word for Windows and Excel for Windows.
2 GENERAL CONDITIONS
2.1 Agency will quote an hourly wage and bill rate at various levels (EXHIBIT C) for each type of
temporary worker described in the job descriptions in EXHIBIT B, as applicable. These rates
will remain effective for one year. Any increases in the second and third year of the contract
shall be in accordance with the Consumer Price Index. The rate should encompass any payments
to the temporary employee as well as applicable costs for conducting Drivers License Checks,
Criminal History Background Checks, Drug/Alcohol Screens, Physicals, etc. Workers
compensation coverage will be the responsibility of the agencies.
Agency must notate any difference in mark-up percentage for overtime pay. Overtime is defined
as more than 40 hours actually worked in any one week beginning on Sunday and ending on
Saturday.
City of Lubbock retirees are an exception to the quoted rates. The hourly wage shall be verified
with the designated representative at the City of Lubbock prior to the temporary assignment. The
bill rate for these employees shall be at the same percentage or better as all other temporary
employees.
The City reserves the right to request a temporary employee for a position that is not included in
this contract. The hourly wage shall be verified with the designated representative at the City
prior to the temporary assignment. These rates will be at 5% under the City's pay plan but no
lower than minimum wage. The bill rate for these temporary employees shall be at the same
percentage as all other temporary employees.
2.2 The selected agencies will appoint one person who is an employee of the agency who will service
this contract and who will be the liaison between the City and their agency.
2.3 The agencies will be solely responsible for ensuring the workers they provide the City meet all
legal requirements to be able to work in the United States and complete the I-9 form accurately
and in its entirety.
2.4 The agencies will be able to provide temporary workers within 8 hours of the request and if the
City is not contacted and/or provided with a temporary within that time period the City reserves
the right to contact another agency for service.
2.5 The agencies will provide workers who possess the necessary skills, knowledge, and ability to
perform the jobs into which they are to be placed, as per attached job description.
2.6 The City reserves the right to reject workers provided by the successful agencies, if they are
found to be unacceptable before or after starting on the job to which they have been assigned.
2.7 There shall be no obligation on the part of the City to hire any temporary worker it is supplied
under the terms of this RFP on a full time basis following the term of the temporary employment.
2.8 Should the City wish to hire an individual who has been filling the temporary position, neither the
individual nor the City will be required to pay a placement fee.
2.9 The selected agencies will have and maintain a $500,000 crime bond on the employees it
provides to the City to protect the City from any loss caused by the workers it provides.
2.10 The successful agencies are to provide the City with weekly billing by department. Normal
payment terms are Net 30. The ability to accept a City purchasing card for payment is preferred.
3 CONTRACT TERM/TERMINATION
3.1 The contract shall be for a term of one year with the option to renew for two additional one year
terms, said date of term beginning upon City Council date of formal approval and shall continue
without interruption from the executed date, under the same terms and conditions.
3.2 The City reserves the right to terminate the contract in whole or in part, for any reason, by
providing a thirty (30) day written notice to the Agency.
4 INDEMNITY INSURANCE
PROOF OF COVERAGE SHALL BE FURNISHED TO THE CITY OF LUBBOCK IN THE FORM
OF A CERTIFICATE OF INSURANCE. THE INSURANCE CERTIFICATES FURNISHED SHALL
NAME THE CITY OF LUBBOCK AS A PRIMARY ADDITIONAL INSURED AND PROVIDE A
WAIVER OF SUBROGATION IN FAVOR OF THE CITY OF LUBBOCK, OR IN THE
ALTERNATIVE, SHALL BE ACCOMPANIED BY A STATEMENT FROM THE CONTRACTOR TO
THE EFFECT THAT NO WORK ON THIS PARTICULAR PROJECT SHALL BE
SUBCONTRACTED. IT SHALL BE THE CONTRACTOR'S RESPONSIBILITY TO PROVIDE TO
THE OWNER ALL PROOF OF COVERAGE INSURANCE DOCUMENTS INCLUDING WORKERS
COMPENSATION COVERAGE FOR EACH SUBCONTRACTOR.
4.1 Agency shall indemnify, hold harmless, and defend the City of Lubbock, its officers and
employees from and against any and all liability or alleged liability without fault and liability by
virtue of the obligations that the City of Lubbock assumes toward its indemnity(s) insofar as
applicable to this Contract or the work to be performed hereunder and including cost of suit,
attorneys' fees, and all other related costs and expenses of whatever kind or character arising
directly or indirectly from any cause whatsoever in connection with or incidental to this Contract
or the work to be performed hereunder, including such injury or harm as may be caused in part by
any neglect, act, or omission of the City, its officers and employees, excepting only such injury or
harm as may be caused solely by an act or omission of the City, its officers and employees.
Notwithstanding the foregoing, the Agency specifically agrees to so indemnify, hold harmless,
and defend the City from and against any and all such liability, suits, action, legal proceedings,
claims, or demands that may be made or pursued by an employee of Agency, or of any
subcontractor, or materials man, or anyone acting on behalf of contractor in connection with or
incidental to this Contract which are alleged to be attributable to any condition of or upon the
City's property facilities, materials, or equipment, including where such condition and resulting
injury or harm is caused in part by any negligent act or omission of City, its officers and
employee, but excepting only such injury or harm as may caused solely by an act or omission of
City, its officers and employees. Agency agrees to waive any and all claims and suits covered by
this indemnity agreement and agrees that any insurance carrier involved shall not be entitled to
subrogation under any circumstance against City, its officers and employees.
4.2 The Agency shall secure and maintain insurance for the duration of the contract. Proof of the
Agency's liability insurance shall be provided prior to receipt of a signed contract. The following
insurance is required.
4.2.1 Workers' Compensation Insurance covering all employees whether employed by the
Agency or any Subcontractor on the job including Employers Liability of at least
$500,000 aggregate.
Commercial General Liability Insurance at minimum combined single limits of $500,000
each occurrence and in the aggregate and shall include the following:
$500,000 Products and completed operations
$500,000 Personal Injury and Advertising Injury
$500,000 Contractual Liability
Automobile Liability - Agency's insurance shall contain a combined single limit of at
least $500,000 per occurrence, and include coverage for, but not limited to the following:
Any Auto
4.3 All policies or certificates shall also contain the following endorsements:
4.3.1 Name insured wording which includes the Agency, Subcontractors, and the City of
Lubbock with respect to general liability and automobile liability.
4.3.2 All liability policies shall contain cross liability and severability of interest clauses.
4.3.3 A waiver of subrogation in favor of the City of Lubbock for all types of insurance
coverages.
4.3.4 The policy shall be endorsed to require the insured to immediately notify the City of
Lubbock of any changes in the insurance coverage.
4.4 All insurance shall be purchased from an insurance company that meets the following
requirements.
4.4.1 A Best financial grading of A:VII or better
4.4.2 Licensed and admitted to do business in the State of Texas and is a subscriber to the
Texas Guaranty Fund.
4.5 All insurance must be written on forms filed with and approved by the Texas State Board of
Insurance. Certificates of insurance shall be prepared and executed by the insurance company or
its authorized agent and shall contain provisions representing and warranting the following:
4.5.1 The company is licensed and admitted to do business in the State of Texas.
4.5.2 The company's forms have been approved by the Texas State Board of Insurance.
4.5.3 Sets forth all endorsements as required above.
4.6 The City of Lubbock shall receive at least twenty (20) calendar days notice prior to cancellation
or termination of insurance, except in the case of non-payment.

III. TEMPORARY WORKER QUALIFICATIONS
The following job descriptions are examples of the minimum experience required and fall under Level 1 of the
Proposal Submittal Form Rate Sheet in EXHIBIT C. Levels 2, 3, and 4 are used for experience in addition to
what is required in the below job descriptions. Depending on the department's needs, a request may be made
specifically for a bilingual temporary worker for any of the below positions.
Technical/Clerical Positions
Account Clerk
1.1 Summary: Performs routine clerical tasks and reviews financial records.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and six months of experience in maintaining and reviewing financial and
statistical records. Knowledge of the procedures and terminology used in clerical accounting
duties; basic computer principles and procedures; and proper public contract and telephone
etiquette. Ability to compute and post arithmetical calculations, effectively operate standard
office• equipment; communicate effectively with others; comprehend and follow oral and
written instructions and perform basic computer/word processing functions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally stand and bend during the
shift; occasionally lift and carry up to 10 pounds; push and pull objects; frequently rotate upper
trunk to the left or right while sitting or standing; and place arms above, at, or below shoulder
height.
1.2 Worker's Compensation Classification of Operations Code: 8810
Accountant (Accountine)
2.1 Summary: Performs professional level accounting duties to prepare and maintain accurate
financial records and provide financial reports to internal and external users.
Education/Exierience: Any combination of education and experience equivalent to a bachelor
degree in accounting or finance with no specific experience required. May consider other
degree with 18 hours coursework in accounting. Knowledge of the principles, practices, and
standards of general and governmental accounting and financial and quantitative analysis
methods. Ability to prepare and review financial transactions; prepare accounting and financial
statements and schedules; communicate effectively orally and in writing; operate computer and
software; compile and interpret data; and analyze problems and develop effective solutions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally lift up to 25 pounds;
occasionally carry up to 25 pounds; frequently stand and walk; occasionally kneel; frequently
pull or push objects; frequently rotate upper trunk to right or left while sitting or standing;
frequently reach above, at, or below shoulder height; and frequently handle objects.
2.2 Worker's Compensation Classification of Operations Code: 8810
3 Administrative Assistant
3.1 Summary: Performs a wide variety of difficult clerical and secretarial duties.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and three to six years of increasingly responsible secretarial experience.
Knowledge of office practices and procedures; the organization, function, and policies of the
departments; general knowledge of municipal government organization and services; personnel
and financial recordkeeping; computer principles and procedures; and proper public contact
and telephone etiquette. Ability to spell and use correct grammar; prioritize and schedule work
to meet deadlines; transcribe material from a Dictaphone system; communicate effectively with
others; work independently in the absence of specific instructions; prepare accurate payroll and
financial records; perform computer/word processing functions.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally stand, walk, kneel, and bend
during the shift; push and pull objects; occasionally flex upper trunk forward at the waist and
partially at the knees; occasionally lift and carry up to 10 pounds; occasionally rotate upper
trunk to the right or left while sitting or standing; and place arms above, at, and below shoulder
height.
3.2 Worker's Compensation Classification of Operations Code: 8810
4 Bookkeeper (Accounting)
4.1 Summary: Performs bookkeeping tasks of average difficulty.
Education/Experience: Any combination of education and experience equivalent to the
completion of a high school diploma with two years experience in clerical work involving
financial recordkeeping or bookkeeping. Knowledge of Excel and other accounting software
applications and fundamental bookkeeping procedures. Ability to make arithmetical
calculations with speed and accuracy; communicate effectively with others; and maintain
detailed financial records accurately.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally lift and carry up to 10
pounds; occasionally climb stairs during the shift; frequently rotate upper trunk to the right or
left while sitting or standing; and place arms above, at, or below shoulder height.
4.2 Worker's Compensation Classification of Operations Code: 8810
5 Call Taker
5.1 Summary: Provide contact service, information, and support to the public through the Citizen
Call Center.
Education/Experience: Any combination of education and experience equivalent to the
completion of a high school diploma with one year of clerical or customer service experience.
Knowledge of customer service methods and practices; practices of a call center environment;
professional telephone etiquette; and computer software and use of business computer. Ability
to communicate verbally in a clear manner in the English language; answer calls and
communicate with others using professional telephone etiquette; assist caller in clarifying the
request or issue; apply knowledge and reasoning to determine the most suitable means for
initiating action to resolve a complaint or problem; provide accurate information to callers;
operate computer and various office equipment; use a telephone for long periods of time;
follow verbal and written instructions; and communicate effectively in writing.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to sit for extended periods; occasionally
stand and walk; frequently flex upper trunk forward; frequently lift up to 10 pounds;
occasionally carry up to 10 pounds; frequently pull or push objects; frequently rotate upper
trunk forward while sitting or standing; frequently reach above, at, or below shoulder height;
and continuously talk, see, and hear.
5.2 Worker's Compensation Classification of Operations Code: 8810
Cashier
6.1 Summary: Receives and accounts for money.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and three to six months of general clerical experience. Knowledge of the
methods of receiving and accounting for money and basic office procedures. Ability to make
simple arithmetical computations quickly and accurately; accurately maintain financial records
and accounts; and communicate effectively with others.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally lift up to 10 pounds;
occasionally stand, bend, and kneel during the shift; push and pull objects; frequently rotate
upper trunk to the right or left while sitting or standing; and place arms above, at, or below
shoulder height.
6.2 Worker's Compensation Classification of Operations Code: 8810
7 Office Assistant
7.1 Summary: Performs a variety of clerical and secretarial duties of average difficulty.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and one to three years of secretarial experience. Knowledge of office
practices and procedures; computer principles and procedures; and proper public contact and
telephone etiquette. Ability to spell and use correct grammar; transcribe material from a
Dictaphone; communicate effectively with others; prepare and maintain accurate records; and
perform computer/word processing functions.
Licenses/Certifications: Must be able to type 55 words per minute.
Work Conditions/Physical Requirements: Ability to occasionally stand, walk, kneel, and bend
during the shift; push and pull objects; occasionally flex upper trunk forward at the waist and

P/T Customer Service Representative (Museum Gift Shop)
8.1 Summary: Interacts with citizens in person or by telephone to process service requests, accept
payments, provide information, or resolve problems.
Education/Experience: Any combination of education and experience equivalent to graduation
from high school and six months to one year of sales or customer service experience.
Knowledge of retail and museum practices and procedures; the organization, function, and
policies of the department; general knowledge of municipal government organization and
services; principles and procedures in operating business computers; and proper public contact
and telephone etiquette. Ability to spell and use correct grammar; prioritize and schedule work
to meet deadlines; communicate effectively with others; follow oral and written instructions;
work independently in the absence of specific instructions; prepare and maintain accurate
records; control loss prevention while maintaining good customer relations; perform
computer/word processing functions; and develop and maintain merchandise displays.
Licenses/Certifications: None
Work Conditions/Physical Requirements: Ability to occasionally stand, walk, kneel, and bend

9 Temporary Election Worker
9.1 Summary: Assist with verifications of petitions.
Education/Experience: Must be at least 18 years of age and a registered voter of Lubbock
County. Must have experience working as an election judge or early voting clerk for Lubbock
County Elections. Knowledge of typing, computer skills, and Election laws. Ability to follow
verbal and written instructions; work independently in the absence of specific instructions;
establish and maintain effective working relationships with fellow employees and City
Secretary staff; and be detail -oriented.
Licenses/Certifications: None.
Work Conditions/Physical Requirements: Ability to continuously sit; occasionally flex upper
trunk forward at the waist and partially flex at the knees; occasionally rotate upper trunk to the
left or right while sitting or standing; and frequently place arms above, at, or below shoulder
height. Vision requirements include close vision, distance vision, peripheral vision, color
vision, and ability to adjust focus. Requires exposure to computer screens and the public; may
be required to work extended hours.

Light industrial candidates are tested in basic math, safety procedures (HAZCOM, lifting,
lockout—tagout, material handling, personal protective equipment, and forklift
certification) and their ability to categorize items alphabetically. In addition, we will
administer specific tests identified by the City of Lubbock.
ilsQuest has strict training policies for safety in the work environment. If an individual
does not pay appropriate attention or is not responsive during the training and education
process, the individual is no longer eligible for employment. ilsQuest has a partnership
agreement with all clients that if safety meetings are held, our employees may participate
and documentation is provided to our office. Also, RCS provides our company with
safety videos covering a wide range of job classifications and work place settings. In

minimize workers' compensation risk and promote performance. We perform quarterly
site visits to ensure that all safety precautions are being met and that our employees are
following the client's environmental health and safety program. This is an integral part of
our system. itsQuest has a corporate culture which focuses on safety awareness and
attitude from all assigned employees. We believe an employee who passes this portion of
our program will be an employee who will adapt rapidly to the culture and needs of our
clients.
itsQuest utilizes the support of a commonly owned supporting entity, Imperium Risk,
Inc., a risk and safety management company. The support of Imperium Risk includes
consulting and training in compliance with OSHA and ANSI standards. The research
support and practical hands on experience of Imperium Risk improves the risk and safety
assessments of itsQuest and indirectly benefits our client's needs without additional costs.
The safety requirements for public and private entities increase annually; and the need to
maintain compliance and adherence to rules rises every year. itsQuest has the ability to
draw upon our resources to be on the cutting edge of federal and state safety and risk
compliance and to indirectly assist the City of Lubbock.
B. Physical Abilities
itsQuest acknowledges and will comply with the City of Lubbock's request to ensure
temporary employees in trades positions will have a physical exam, as needed, completed
within thirty days prior to placement, unless the employee has had a physical within the
last six months.

6.1.2 Methodology for Supplying Qualified Personnel
itsQuest has been recognized by the American Staffing Association (ASA) and by Risk
Control Services (RCS) as being a leader in the staffing industry with consistent
assessment and placement with the designation of being Workers' Compensation Risk
Certified (WRC). itsQuest was one of the `charter' recipients of the WRC Certification;
only 100 staffing companies nationwide received this designation at its inception. This
designation involves constant Yd party oversight and evaluation to the adherence of the
WRC principles. The ASA and RCS developed WRC Certification as the staffing
industry's ISO 9000 compliment. By using a WRC Certified company, a client is
guaranteed that all procedures are followed consistently and thoroughly; the standards set
forth by the WRC certification have lead to decreased turnover rates, decreased on-the-
job accidents and incidents at client locations, reduced loss time accidents, reduced

2.0 Screening
Every itsQuest assigned employee is professionally screened and evaluated before a
hiring determination is made. All employees must meet our employment requirements
and the City of Lubbock's requirements before designated placement. Below is an
overview of our screening and assessment criteria.

2.1 Criminal / Driving Background Checks
itsQuest performs background checks on all assigned employees as part of the screening
process. The background check(s) administered include county, city and state criminal
background verifications, which will be through the Texas Department of Pubic Safety.
We will obtain national verifications upon client request. All background checks are
performed prior to placement and again upon reactivation if the employee leaves the job
assignment to return later.
Temporary employees who drive City vehicles will have a new driver's license check
completed prior to placement
2.2 Drug Screening
Each applicant during the process must sign a drug test release form prior to placement.
This form allows our company the right to administer a drug screen prior to placement,
randomly, with reasonable suspicion and in any type of workplace accident. The drug
screens are five panel screens administered in the itsQuest office and no charge is made
to the client.
Drug screens will be complete within ten days prior placement.
itsQuest's five panel in-house test screens for:

The screens also test for temperature and sample impairment (use of a non urine
substance in an attempt to alter the test results)
The company will perform DOT drug screens through third party administrators and also
has the ability to screen on ten panels.
Alcohol straws - This test indicates if alcohol is present in the body. This test is
randomly performed on site or at the request of the client. This may be accompanied by a
modest charge for client requested tests.
When certain job classifications require more in depth testing we send the candidate to an
outside independent testing facility. Once a candidate has passed the drug test, we will
consider the candidate for placement.

3.0 Testing
All non light industrial candidates are tested for claimed skills as disclosed in their
application or interview process. The company uses a customized evaluation and training
software system. Specific tests will be administered to comply with the specific skill sets as

itsQuest will provide our employees with the training necessary to ensure optimum success
and safety at the work site.
5.0 Employee Retention and Recognition Programs
Service Pay - itsQuest, Inc. employees will receive a service bonus if the employee
satisfies the following requirements:
• If the employee earned at least 1,700 hours during the calendar year.
• The employee must be active at the year end. This is defined as having a
paycheck/advice dated in the month of December for the service pay eligibility year
period.
• The Service Pay is 1.25 percent of the total earnings of the employee for the
applicable bonus eligibility year. This includes both regular hourly pay and overtime
hourly pay.
• The Service Pay is earned wages and will be taxed and reported in the same manner
as other earnings.
The service pay is based on a calendar year (January 1 to December 31); it is the
responsibility of the employee earning the pay to report the eligibility to their itsQuest,
Inc. office. The service pay will be included on the next payroll cycle. Eligible service

pay ceases after sixty days (60) from January I st and will not be carried forward or paid
in arrears.
Holiday Pay - itsQuest, Inc. employees may qualify for Standard Holiday Pay (average
hours worked, maximum of 3 hours) if the employee fulfills all of the following:
• Work and be paid for 960 hours in the 26 week period prior to the holiday
• Work at least 30 hours in the week prior to the holiday
• Eligible holidays include: Memorial Day, Independence Day, Labor Day,
Thanksgiving Day, Christmas Day, and New Years Day
• Must work the scheduled day before and the day after the designated benefit
• If the client pays the holiday, the employee will not receive a second paid day from
itsQuest.
Referral Bonuses - itsQuest assigned employees are encouraged to refer family and friends
seeking employment to register with our company. In order to encourage this, we offer a
$25.00 "Referral Bonus" to all assigned employees. To receive a bonus, the applicant must
list the name of who referred them as the source of referral on their application. They must
also work a total of 40 hours within a 30 day time frame. There is no limit on the number of
referrals the employee can refer. Clients are not billed for the referral bonuses paid to our
assigned employees.
B. Response Time
When a job (work) order is placed with itsQuest it will be evaluated and then assigned to an
Employment Consultant to complete. Depending on the City of Lubbock's requirements and
skill level of an applicant, we will strive to fill the job position within four hours of
notification. Typically, an itsQuest Employment Consultant can fill most positions within
eight hours of notification. Historically, itsQuest has a successful track record in maintaining
timeliness and consistency in filling assignments.
C. Value Added Services
itsQuest representatives are available to our clients seven days a week/twenty-four hours a
day. All management employees are assigned a cell phone and a representative is on call
every day and on weekends. Your company will be provided a list of our contact names, cell
phone numbers, and emergency notification procedures in case of a workers' compensation
accident.
itsQuest has a strict safety guideline policy that ensures our employees are working in a safe
work environment. We will perform quarterly site visits and random audits to ensure that the
facility meets safety standards. We will require our employees to attend safety training and
adhere to the safety standards of the City of Lubbock. We have a full time risk and safety
manager that is available for questions and comments related to facility safety.

G. Quality Assurance
itsQuest has a policy that if an employee is not performing to the client's standards and we
are notified within the first four hours, no charge is applied. This policy is extended to all of
our clients.
itsQuest has a policy that our employees can transfer to a client's payroll if need be after 720
working hours. This policy may be negotiated prior to an award of contract.
itsQuest offices are connected by a computerized network that allows information to be
passed uniformly, and in a timely manner. Staff is constantly being trained by our corporate
training department on new forms, corporate policy and customer service. These factors will
allow the company to expand with your company's needs and provide the same service,

6.1.4 Worker Replacement
itsQuest has a policy that if an employee is not performing to the client's standards and
we are notified within the first four hours, no charge is applied. This policy is extended
to all of our clients. itsQuest has an eight hour turnaround time for all employees. If an
employee notifies itsQuest of an absence, a replacement employee will be contacted to
report to work in the original employee's position within eight hours, at no additional
charge to the client. in an effort to reduce employees arriving late to work, itsQuest will
conduct arrival calls to assure they are arriving to work as scheduled.

ilsQuest acknowledges and agrees that normal payment terms for the City of Lubbock
will be Net 30 days. The City of Lubbock understands that unpaid accounts will be
considered default after sixty days after an approved invoice is issued. A service charge
of 1.5% may be accrued on unpaid invoices on a monthly basis. Invoices are generated at
the end of our payroll process once the paychecks have been processed. ilsQuest has the
capability to submit invoices to the City of Lubbock weekly by department as required.
ilsQuest acknowledges and agrees that should the City of Lubbock wish to hire an
individual onto the City of Lubbock payroll who has been filling the temporary position,
neither the individual nor the City of Lubbock will be required to pay a placement fee.
Whereas ilsQuest agrees that the City of Lubbock may place an ilsQuest employee on
the City of Lubbock payroll without requiring to pay a placement fee, ilsQuest does not
consent to transferring an employee to another staffing company's payroll for any reason.

The Third Party Administrator or a designated employer representative will notify
itsQuest, Inc. of employees selected for random testing. The itsQuest staff, the Third
Party Administrator, or the itsQuest Drug and Alcohol Program Administrator may
notify the employees' supervisor of the employees to be tested. It is preferred that the
supervisor notifies the employee of testing. However, any of these designated positions
(including a supervisor's designee) may instruct the employee to report to the designated
collection/testing facility. Notification must be made so that advance notice to the
employee is minimized. It is imperative that the person providing the notification stress
the importance of the time limit and requirement to report to the facility. Employees will
be allowed 30 minutes from notification, plus travel time, to get to the collection facility.

itsQuest acknowledges and agrees to have and maintain a $500,000 fidelity crime bond
on employees provided to the City of Lubbock in order to protect the City of Lubbock
from any loss caused by the workers itsQuest provides. Should itsQuest be awarded the
contract for Temporary Employment Services, the City of Lubbock will be provided a
copy of proof of bonding.
Our agent Kevin P. Kilcoyne of Barrow Group, LLC, will facilitate the insurance and/or
bonds for itsQuest. Information for our Broker is listed on your Insurance Requirement
Affidavit in the Appendix of this proposal.

itsQuest does not require any work restrictions outside of the described job descriptions
provided within the RFP in Exhibit B.
itsQuest does require effective safety measures be required of all assigned employees and
supervisor monitoring during work hours and on the job sites.
itsQuest will review any alterations or changes from the described job descriptions on a
case by case basis. Historically, itsQuest has worked with the City of Lubbock to
accommodate work needs and effectively evaluate safety measures, practices, and
equipment.
