THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on behalf of the City of Lubbock, Amendment No. 1 to that certain
Professional Services Contract, No. 11195, dated May 23, 2013, for storm water utility
fee adjustments, by and between the City of Lubbock and Freese and Nichols, Inc., of
Dallas, Texas, and related documents. Said Contract Amendment is attached hereto and
incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.

AMENDMENT NO. 1
TO AGREEMENT
OF LUBBOCK, TEXAS
AND
FREESE AND NICHOLS, INC.
FOR ENGINEERING SERVICES
ENGINEERING SERVICES TO: Provide Coordination with LP&L and/or Utility Billing Subconsultant, On -Call
stormwater inquiry response assistance, research related to exemptions, fee limits, and rate options
from other cities, conduct additional tier rate evaluations and provide options to City staff with all
supporting data tasks not included in original project scope and Contract NO. #11195, hereinafter
referred to as "the Project".
THIS IS AN AMENDMENT TO THE AGREEMENT dated May 23, 2013 and entered into by and between the
CITY OF LUBBOCK, TEXAS, hereinafter called "Owner," and FREESE AND NICHOLS, INC., hereinafter
called the "Engineer," of 2732 82nd Street in Lubbock, Texas. The original Agreement was approved by
City Council action on May 23, 2013, Resolution No. 2013-110163.
This amendment is a time extension for the original agreement, such that the Agreement and
Amendment shall terminate at the close of business on September 30, 2015, unless a mutual agreement
is made by the Owner and the Engineer to extend the agreement.
This amendment includes additional compensation for tasks performed outside the original contract
scope, as well as ongoing assistance to City staff related to inquiry assistance, exemption and fee
research, and additional evaluation of rate structure options. Detailed breakdown is included as Exhibit
A, which is incorporated as if fully set forth herein.
All other portions of the original Agreement shall remain in place and are not altered by this
amendment.
Executed in three counterparts (each of which is an original) on behalf of Engineer by its Vice President
shown below and on behalf of Owner this 14th day of May. 2015.
