BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on behalf of the City of Lubbock Interlocal Agreements with Frenship
ISD, New Deal ISD, Idalou ISD, Shallowater ISD, Lubbock -Cooper ISD, Slaton ISD and
Roosevelt ISD to exchange Automated External Defibrillator (AED) devices provided by
the City Health Department for use of various ISD buildings for mass immunization and
shelter in the event of a public health emergency, a copy of which Agreements and any
associated documents are attached hereto and which shall be spread upon the minutes of
this Council and as spread upon the minutes of this Council shall constitute and be a part
hereof as if fully copied herein in detail.

INTERLOCAL AGREEMENT

This Interlocal Agreement ("Agreement") is entered into between the Roosevelt
Independent School District ("District"), and the City of Lubbock Health Department
("Department"). The District is an Independent School District organized under Education
code Chapter 11, The Department is a Local Health Department of the City of Lubbock
operated under Chapter 121 of the Health and Safety Code. The Interlocal Cooperation Act,
Government Code Chapter 791, governs this Agreement.
I. Purpose
The City of Lubbock Health Department ("Department") is required, by the City of
Lubbock/Lubbock County Emergency Management Plan and by grant directives, to plan
and prepare for public health emergencies which may result from natural or man-made
causes. During such an emergency, it may necessary to immunize or shelter large numbers
of people in the area served by the Department and the District. Prior public health
experience with mass immunizations has shown that schools are well suited to this activity
because; Prior public health experience with mass immunizations and sheltering has shown
that schools are well suited to this activity because: 1) Their location is known to large
numbers of individuals within the community; 2) They have large assembly areas; 3) They
have other necessary facilities such as refrigeration and restrooms.
The City of Lubbock and Roosevelt ISD are committed to the health and safety of citizens,
employees and others who use their facilities, The Department has determined that the
District possesses facilities that are qualified to serve if mass immunization or treatment is
necessary. The District desires to be as helpful as possible in the event of a public health
emergency, and agrees to make its facilities available for purposes of mass immunization or
treatment, under the terms set out below. In support of this commitment, RISD and City of
Lubbock Health Department will provide an Automated External Defibrillator (AED) at
identified locations throughout the RISD system to make early defibrillation accessible to
Individuals who experience sudden cardiac arrest. The AED units will be installed in RISD
buildings identified for use as immunization clinics or shelters during emergencies declared
by the Commissioner of Health or the local health authority. The District and the
Department have concluded that this contemplated use of the facilities is a "governmental
function" as defined in the Interlocal Agreement Act.
H. Public Health Emergency
This agreement as pertains to facilities usage will go into effect only if. -

scale immunization or treatment is necessary as a control measure for an
outbreak of communicable disease or if mass prophylaxis against
bioterrorism agent or other infectious disease is required.
2) Classes at the facility are either not scheduled or are canceled.
III. Obligations of the Department
1) The Department will supply or arrange for all equipment, vaccine, medicine
and personnel necessary to administer the vaccine or medication.
2) The Department will supply or arrange for all equipment and personnel
necessary for staffing, security, crowd control and other tasks, except as
described in Section IV.
3) The Department will be responsible for disposal of medical waste and
disinfection at the facility following its use for the emergency. The health
authority will provide written assurance of its safety for use as a school
facility following its use.
4) To the extent they cam be determined, the Department will be responsible for
costs of utilities described in Section IV. This compensation is mutually
agreed to be `an amount that fairly compensated the performing party" as
stated in the Interlocal Cooperation Act. The amounts to be paid to the
District will be paid from current revenues available to the Department.
5) The Department, in conjunction with RISD personnel, will identify locations
for the wall -mounted AED units.
6) The Department will purchase the AED units and carrying cases for the
portable units.
7) The Department is responsible for first aid and AED training of City
personnel deployed during an emergency to RISD sites utilized as clinics or
shelters.
8) The Department shall be responsible for the acts and negligence of its
employees or volunteers, under state and federal law.
IV. Obligations of the District
1) The District is responsible for allowing the use of the facility and all utilities
(gas, electricity, water, and telecommunications) normally associated with its
use as a school facility.
2) The District is responsible for providing use of all rooms, fixtures, and
equipment existing at the facility that the Department regards as necessary for
on -site use during the period of the emergency.

3) The District will provide at least one person on -site during the period of
emergency use with access to the rooms, fixtures and equipment described
above.
4) The District is responsible for the installation, care and maintenance of the
AED units, as proscribed by the manufacturer.
5) The District is responsible for initial and on -going training for RISD
personnel on AED usage.
6) Future replacement of AED units, batteries, electrodes and other related
accessories is the responsibility of the District.
7) The District shall be responsible for the acts and negligence of its employees
or volunteers, under state and federal law.
V. Term
This agreement becomes effective after approval by the governing bodies of the District and
Department as indicated below. It may be canceled by either party by giving thirty days
written notice to the other party, otherwise it remains in effect for five years and may be
renewed by mutual agreement expressed in writing.

1 } The Commissioner of Health or the local health authority declares that large
scale immunization or treatment is necessary as a control measure for an
outbreak of communicable disease or if mass prophylaxis against
bioterrorism agent or other infectious disease is required; and
2) As a consequence of the health emergency, the superintendent of the District,
in consultation with the presiding officer of the District's Board of Trustees,
has cancelled classes or other District activities. The determination to cancel
school activities and/or permit the use of District facilities by the Department
shall belong exclusively to the District and its determination is final and may
not be appealed.
III. Obligations of the Department
1) The Department will supply or arrange for all equipment, vaccine, medicine
and personnel necessary to administer the vaccine or medication.
2) The Department will supply or arrange for all equipment and personnel
necessary for staffing, security, crowd control and other tasks, except as
described in Section IV.
3) The Department will be responsible for disposal of medical waste and
disinfection at the facility following its use for the emergency. The health
authority will provide written assurance of its safety for use as a school
facility following its use.
4) To the extent they can be ascertained, the Department will be responsible for
reimbursing the District for the costs of utilities described in Section IV.
This compensation is mutually agreed to be an amount that fairly
compensates the performing party as required by the Act. The amounts to be
paid to the District will be paid from current revenues available to the
Department.
5) The Department, in conjunction with District personnel, will identify
locations for the wall -mounted AED units. The Department shall comply
with all reasonable requests from the District regarding the placement of the
units.
6) The Department will purchase the AED units and carrying cases for portable
units.
7) The Department is responsible for first aid and AED training of City
personnel deployed during an emergency to District sites used as clinics or
shelters.

with Section II above, and all utilities (gas, electricity, water, and
telecommunications) normally associated with its use as a school facility.
2) The District is responsible for providing use of rooms, fixtures, and
equipment existing at the facility that the Department requests as necessary
for on -site use during the period of the emergency. Requests from the
Department for such use may not be unreasonably denied. The Department
agrees that it is prohibited from accessing any rooms or equipment wherein
confidential District personnel and/or student data is located or stored.
3) The District will provide at least one person on -site during the period of
emergency use with the authority to grant the Department access to the
rooms, fixtures and equipment described above.
4) The District is responsible for the installation, care and maintenance of the
AED units, as proscribed by the manufacturer.
5) The District is responsible for attending initial training provided by the
Department and securing on -going training for District personnel on AED
usage.
6) Future replacement of AED units, batteries, electrodes and other related
accessories is the responsibility of the District. The determination to expend
District funds to replace any equipment shall be at the District's sole
discretion.

This Interlocal Agreement ("Agreement") is entered into between the Slaton
Independent School District ("District"), and the City of Lubbock Health Department
("Department"). The District is an Independent School District organized under
Education code Chapter 11. The Department is a Local Health Department of the City
of Lubbock operated under Chapter 121 of the Health and Safety Code. The Interlocal
Cooperation Act, Government Code Chapter 791, governs this Agreement.
I. Purpose
The City of Lubbock Health Department ("Department") is required, by the City of
Lubbock/Lubbock County Emergency Management Plan and by grant directives, to
plan and prepare for public health emergencies which may result from natural or man-
made causes. During such an emergency, it may necessary to immunize or shelter large
numbers of people in the area served by the Department and the District. Prior public
health experience with mass immunizations has shown that schools are well suited to

large assembly areas; 3) They have other necessary facilities such as refrigeration and

The City of Lubbock and Slaton ISD are committed to the health and safety of citizens,
employees and others who use their facilities. The Department has determined that the
District possesses facilities that are qualified to serve if mass immunization or treatment
is necessary. The District desires to be as helpful as possible in the event of a public
health emergency, and agrees to make its facilities available for purposes of mass
immunization or treatment, under the terms set out below. In support of this
commitment, SISD and City of Lubbock Health Department will provide an Automated
External Defibrillator (AED) at identified locations throughout the SISD system to
make early defibrillation accessible to individuals who experience sudden cardiac
arrest. The AED units will be installed in SISD buildings identified for use as
immunization clinics or shelters during emergencies declared by the Commissioner of
Health or the local health authority. The District and the Department have concluded
that this contemplated use of the facilities is a "governmental function" as defined in the
Interlocal Agreement Act.

II. Public Health Emergency
This agreement as pertains to facilities usage will go into effect only if:
1) The Commissioner of Health or the local health authority declares that
large scale immunization or treatment is necessary as a control measure
for an outbreak of communicable disease or if mass prophylaxis against
bioterrorism agent or other infectious disease is required.
2) Classes at the facility are either not scheduled or are canceled.
M. Obligations of the Department
1) The Department will supply or arrange for all equipment, vaccine,
medicine and personnel necessary to administer the vaccine or
medication.
2) The Department will supply or arrange for all equipment and personnel
necessary for staffing, security, crowd control and other tasks, except as
described in Section IV.
3) The Department will be responsible for disposal of medical waste and
disinfection at the facility following its use for the emergency. The
health authority will provide written assurance of its safety for use as a
school facility following its use.
4) To the extent they cam be determined, the Department will be
responsible for costs of utilities described in Section IV. This
compensation is mutually agreed to be `an amount that fairly
compensated the performing party" as stated in the Interlocal
Cooperation Act. The amounts to be paid to the District will be paid
from current revenues available to the Department.
5) The Department, in conjunction with ISD personnel, will identify
locations for the wall -mounted AED units.
6) The Department will purchase the AED units and carrying cases for the
portable units.
7) The Department is responsible for first aid and AED training of City
personnel deployed during an emergency to ISD sites utilized as clinics
or shelters.

employees or volunteers, under state and federal law.

Consider a resolution authorizing and directing the Mayor to execute for and on behalf
of the City of Lubbock Interlocal Agreements and any associated documents with
Frenship ISD, New Deal ISD, Idalou ISD, ShalIowater ISD, Lubbock -Cooper ISD, Slaton
ISD and Roosevelt ISD to exchange Automated External Defibrillator (AED) devices
provided by the City Health Department .for use of various ISD buildings for mass
immunization and shelter in the event of a public health emergency.
BACKGROUND/DISCUSSION:
Under the Metropolitan Medical Response System (MMRS) grant administered by the
Texas Governor's Division of Emergency Management, the City of Lubbock is required
to plan and prepare for public health emergencies, which may result from natural or
man-made causes. Interlocal Agreements with school districts allows for facility usage,
especially high school/junior high school buildings including gymnasiums, for mass
dispensing of medications in the event of bioterrorism or other health emergencies.
These agreements help meet the requirements of the MMRS, Public Health
Preparedness, and Pandemic Influenza grants.
During such an emergency, it may be necessary to immunize or to shelter Iarge
numbers of people in the area served by the Lubbock -Cooper, New Deal, Roosevelt,
Idalou, Slaton, or Shallowater Independent School Districts and the Lubbock Health
Department. An Interlocal Agreement approved by Council on August 10, 2006 exists
between the Lubbock ISD and the City allowing the use of LISD facilities during the
period of an emergency.
The City of Lubbock and the various school districts in Lubbock County are committed
to the health and safety of citizens, employees and others who use their facilities. In
support of this commitment, the City of Lubbock will provide Automated External
Defibrillator (AED) units at identified locations throughout the various independent
school systems to make early defibrillation accessible to individuals who experience
sudden cardiac arrest. The key to significantly improving cardiac arrest survival rates
in adults lies in increasing the availability of AEDs. The AED units will be installed in
school buildings identified for use as immunization clinics or shelters during
emergencies declared by the Coiru-nissioner of Health or the local health authority.
Portable AED units will also be provided to designated school personnel and be
available during the emergency.
Obligations of the Health Department include:
1. Responsible for identifying locations for the mass immunization clinics.
2. Responsible for purchasing the AED units with pediatric key for use with
children. Frenship will receive 3 AEDs. Lubbock -Cooper, New Deal, Roosevelt,
Idalou, Slaton, and ShaIlowater will receive 2 AEDs per district. AED units cost
approximately $1,800 each.
Obligations for the Independent School District include:
1. Responsible for the installation, care and maintenance of the AED units, as
prescribed by the manufacturer.
2. Responsible for initial and on -going training for ISD personnel on AED usage.
3. Responsible for the future replacement of AED units, batteries, electrodes and
other related accessories.
FISCAL IMPACT:
The purchase of the AEDS will be thru the Metropolitan Medical Response System
grant and funding for emergency preparedness. The total costs of AEDs to county
districts will be $27,000. The purchase will not impact the General Fund.
