RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City Council of the City of Lubbock hereby authorizes and directs the
Mayor of the City of Lubbock to execute an Amendment No. 4 to the Contract by and
between the City of Lubbock and Hugo Reed & Associates, Inc., on the Glenna Goodacre
Boulevard Project in Overton Park, which Amendment No. 4 and any associated
documents are attached hereto and made a part of this Resolution for all intents and
purposes.

THIS AMENDMENT NO.4 to THE CONTRACT FOR ENGINEERING SERVICES for
DESIGN and BID: GLENNA GOODACRE BOULEVARD PROJECT in OVERTON PARK,
LUBBOCK, said contract dated December 8, 2003 (Resolution No. 2003-R0562) together with
Amendment No. I dated August 26, 2004 (Resolution No. 2004-R0417), Amendment No. 2 dated
November 4, 2004 (Resolution No. 2004-RO551), and Amendment No. 3 dated November 7, 2005
(Resolution No. 2005-R0519) is made by and between the City of Lubbock, Texas, hereinafter
called the OWNER, and Hugo Reed and Associates, Inc., hereinafter called I-fRA.
NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained,
the OWNER and HRA do mutually agree as follows.
ARTICLE 1. CONTRACT PERIOD
The effective date of the original contract was December 8, 2003, Amendment No. 3 extended the
Contract Period to December 30, 2006 to include additional design phase services and those
construction phase services as generally outlined therein. This AMENDMENT NO.4 will extend
the Contract Period through December 31, 2007.
ARTICLE 2. SCOPE OF SERVICES
This AMENDMENT NO.4 is made at the request of the OWNER for the purpose of amending the
Scope of Services to revise those general professional services as detailed in Attachment A hereto,
"Amended Project Scope and Services_"
ARTICLE 3. COMPENSATION
The general tasking proposed to perform the additional services authorized by this AMENDMENT
NO.4 is described in Attachment A. No change to the maximum amount payable under this
contract will be made as a result of this AMENDMENT NO. 4.
ARTICLE 4. OTHER
This Amendment is intended for the sole purpose of clarifying certain changes in scope and services
which occurred cooperatively between the OWNER and HRA during the prosecution of the work
under Amendment No. 3. This AMENDMENT NO.4 will formally amend said scope of services.
These changes were necessitated by market conditions and timing beyond the control of OWNER
and HRA. No changes to the contract are requested or granted as a result of this Amendment, other

than those detailed in Articles 1 through 4, above. All other provisions of the original contract and
its prior Amendments will remain in full force and effect. This Amendment shall become a part of
and be incorporated into the original contract upon its full execution by both OWNER and HRA.
ARTICLE 5. SIGNATORY WARRANTY
The undersigned signatory for Hugo Reed and Associates, Inc. hereby represents and warrants that
he is an officer of the organization for which he has executed this contract and that he has full and
complete authority to enter into this contract on behalf of his firm.
The undersigned signatory for the OWNER hereby represents and warrants that he/she has full and
complete authority to enter into this contract on behalf of the City of Lubbock.
IN WITNESS WHEREOF, the parties hereto have caused this AMENDMENT NO.4 to the
original contract to he executed, but this AMENDMENT NO.4 to the original contract shall not be
valid until signed by a duly authorized representative of each party.

OWNER: City of Lubbock, Texas
PROJECT: Amendment No. 4 to Agreement for Engineering Services for Design
and Bid: Glenna Goodacre Boulevard Project in Overton Park, Lubbock
This Amendment alters the Project Scope and Services that were generally outlined in
Amendment No. 3. The changes to the scope and services formalized by this Amendment are as
follows, relative to the Basic Services categories described in Amendment No. 3. No other
changes to the scope and services are proposed with this Amendment No. 4:
BASIC SERVICES
A. PHASE 1 DESIGN SERVICES — "WAL-MART STREETS" AND
CONDEMNATION R-O-W PARCEL SURVEYS
The Amendment No. 3 Phase I Basic Design Services are outlined in
detail in Exhibit A -I, Worksheet A3-IB, according to the tasking and
man-hours indicated in Amendment No. 3.
Following is a summary of the additional major categories of Phase l
Basic Design Services that have been performed as Revised Scope items.
These items were performed in lieu of certain Amendment No. 3 Phase 2
Basic Design Services, which were deleted as outlined in B.I.a. below:
Additional Municipal Paving and Drainage Construction

Avenue T, full width curb -to -curb, from south end of radius at
intersection with 7'' Street to north end of radius at intersection
with Glenna Goodacre Boulevard;
Avenue S, full width curb -to -curb, from south end of radius at
intersection with 71h Street to north end of radius at intersection
with Glenna Goodacre Boulevard;
Avenue R, full width curb -to -curb, from south end of radius at
intersection with 7`h Street to north end of radius at intersection
with Glenna Goodacre Boulevard;
Curb and gutter improvements for the north side of Glenna
Goodacre Boulevard from north end of radius at intersection of
Avenue R to north end of radius at intersection with Avenue S.
B. PHASE 2 DESIGN SERVICES — "RESIDENTIAL STREETS"

The Amendment No. 3 Phase 2 Basic Design Services for Residential
Streets are outlined in detail in Exhibit A-1, Worksheet A3-213,
according to the tasking and man-hours indicated in Amendment No. 3.
Following is a summary of the major categories for the Phase 2 Basic
Design Services that were deleted as Revised Scope items, and replaced
in their entirety by the additional services generally described in A.l .a.
above:
Deleted Municipal Paving and Drainage Design and
Construction Documents
1 O`h Street, full width curb -to -curb, from east of Avenue U to
west of Avenue S;
Avenue T, full width curb -to -curb, from 9`s Street to i Oh Street;
Relocate inlets and extend piping from intersection of Avenue S
and 10'4 Street west to clear the future roundabout at that
intersection.
C. SUPPLEMENTAL SERVICES
1. Any Supplemental Services for the original agreement and in subsequent
Amendments for the purposes of establishing necessary survey control,
surveying R-O-W parcels, acquiring necessary field survey data for the
performance of the Basic Services, or other services are as outlined in
those documents.
HRA performed certain additional Supplemental Services as Revised
Scope services at the request of the OWNER to facilitate the smooth
progression of the work. Existing project budget funds were available to
be applied to the performance of these additional services due to
efficiencies in the performance of other services. These additional
Supplemental Services are as generally described below:
a. Supplemental Engineering Services
HRA has performed various additional construction phase
engineering services, including review of contractor Requests for
Information, making site visits to observe the work, attending
meetings regarding construction -related matters, making design
revisions to facilitate construction field change directives, various
coordination tasks for and preparations of alternate construction
bid packages, and miscellaneous tasks associated with the
proposed Avenue X reconstruction from Marsha Sharp Freeway to
Mac Davis Lane.

Supplemental Surveying Services
HRA has performed various additional surveying services.
including construction staking for the municipal paving and
drainage improvements. performing field topography work for
design revisions and for record information. and performing field
topography work for the future design for the reconstruction and
widening of Avenue X from Marsha Sharp Freeway to Mac Davis
Lane.

For Services rendered under this Contract, OWNER agrees to pay HRA as follows:

No changes to the maximum amount payable or to the methods and basis
for payment are proposed with this Amendment,
B. BASIC AND SUPPLEMENTAL SERVICES, AND REIMBURSABLES,
