RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, a Deed Notice (the
"Notice") for the tract of land located at 402 Municipal Drive, as described on Exhibit
"1" to the Notice, and any other related documents. Said Notice is required by the Texas
Commission on Environmental Quality and is to be filed of record in Lubbock County,
Texas. Said Notice is attached hereto and incorporated in this Resolution as if fully set
forth herein and shall be included in the minutes of the Council.
Passed by the City Council this 22nd day of February 2007.

This Notice is tiled to provide information concerning certain environmental conditions and/or
use limitations pursuant to the Texas Commission on Environmental Quality ("TCEQ") Texas
Risk Reduction Program Rule ("TRRP") found at 30 Texas Administrative Code ("TAC"),
Chapter 350, and affects the real property ("Affected Property-) described as follows:
That certain 1.34 acre tract of land in Section 80, Block A, Lubbock County,
Texas being a portion of tract "A'; Municipal Hill Addition to the City of
Lubbock according to the map, plat andUor dedication deed thereof recorded
in Volume 1795 Page 282 of the deed records of Lubbock County, Texas, and
further as said tract is depicted in the survey attached hereto as Exhibit "1
being described by metes and bounds as follows:
Beginning at a %" iron rod with a cap found at the corner of said tract "A"
and the most northwest corner of' the Texas Department of Transportation
("TxDOT") tract for the northeast corner of this tract;
Thence S 19 °1277"E, along the west line of said T.rDOT tract, a distance of
305.51 feet to the southeast corner of this tract from whence a %" iron rod
found at the southwest corner of said T.xDOT tract in the north right of way
line of Municipal Drive bears S 19'12'17" E a distance 112.39.feet;
Thence S 77°55'51 "W a distance of'94.55 feet to a point in the east wall of a
brick building at 402 Municipal Drive;
Thence N 19 °14'52"W, along said wall, a distance of 23.68_feet to a corner of
said building;
Thence S 70'39'40"W, along a wall, a distance of 49.90.feet to a corner of
said building;
Thence N 19'05'09"W, along a wall, a distance of 12.80.feet to a corner of
said building;
Thence S 70 °54'51 "W, along a wall, a distance of 0.30 feet to a corner of said
building;
Thence N 19'05'09"W, along a wall, a distance nf' 41.80 feet to a corner of
said building;
Thence S 70°46'53" W, along a wall, a distance of'46.30 feet to a corner of
said building;

northwest corner of this tract;
Thence N 69 5736"E, along a chain link fence, a distance of 86.47 feet to a
corner of said fence for a corner of this tract;
Thence N 10 `28'17"W, along said chain link fence, a distance of 8.08 feet to
a corner of said fence far a corner of this tract;
Thence N 70 `09'49"E, along said chain link fence, a distance of 115.66 feet
to a corner of said fence far a corner of this tract,
Thence S 22 °4848"E, along said chain link fence, a distance of 10.55 feet to
a corner of said fence far a corner of this tract;
Thence N 71'21'41 "E, along said chain link fence, a distance of 9.80 feet to
the place of beginning.
Portions of the soils of the Affected Property contain certain identified chemicals of concern
causing those portions to be considered an Affected Property as that term is defined in the TRRP.
List each CDC by environmental medium that exceeds the critical PCL.
None
This Notice is required for the following reasons:
The Affected Property currently meets TRRP standards for commercial/industrial use.
Based on the APAR, the levels of chemicals of concern pose no significant present or future risk
to humans or the environment based on commercial/industrial land use. No further remediation
of the Affected Property is required by the TCEQ as long as the Affected Property is not to be
used for residential purposes as the property may not be protective for residential use_ 1f any
person desires in the future to use the Affected Property for residential purposes, the TCEQ must
be notified at least 60 days in advance of such use and additional response actions may be
necessary before the property may be so used. Persons contemplating a change in land use for
the Affected Property are encouraged to review the definitions for commercial/industrial and
residential land use contained in TRRP as the definition of residential land use is broad and
subject to change.

address of P.O. BOX 2000, Lubbock, TX 79457.
