RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, a Contract for vehicle body
repair & painting — annual pricing, by and between the City of Lubbock and Gene Messer
Ford of Lubbock, Texas, and related documents. Said Contract is attached hereto and
incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.

Dear Mr. Richardson:
GENE MESSER FORD has been awarded the items noted below for Vehicle Body
Repair & Painting - Annual Pricing based on your response to the City of Lubbock Invitation to
ITB #244-03/RS.
1. A Purchase Order will be issued by the City of Lubbock and covers the category of
items shown below, and no other, during the period beginning March 4, 2003 and
ending March 3, 2005. The City of Lubbock shall not be responsible for payment of
any invoices except those orders placed pursuant to this agreement.
2. Category of Items:
1. Passenger Vehicles (Primary) 25% Parts Discount $32.00 Per Labor Hour
3. GENE MESSER FORD'S bid dated January 28, 2004, is incorporated into and made
a part of this agreement.
4. Prices: As quoted.
5. All invoices shall be directed to:

6. The City of Lubbock reserves the right to enforce the performance of this contract in
any manner prescribed by law or deemed to be in the best interest of the City of
Lubbock in the event of breach or default of this agreement. The City of Lubbock
reserves the right to terminate this agreement with a thirty (30) day written notice in
the event GENE MESSER FORD fails to perform in accordance with their bid dated
January 28, 2004.

In compliance with the Invitation to Bid #244-03-RS, the undersigned Bidder having examined the Invitation
to Bid and Specifications, and being familiar with the conditions to be met, hereby submits the following Bid
for furnishing the material, equipment, labor and everything necessary for providing the items listed below
and agrees to deliver said items at the locations and for the prices set forth on this form. The Invitation to
Bid #244-03-RS is by reference incorporated in this contract. The Bid Form must be completed in blue or
black ink or by typewriter.
Rates quoted on the Bid Form and any labor hours used to figure estimates shall not exceed those published in
the current Mitchell Estimating Book. The rates bid shall be used in all work for the class of vehicles covered.
No variance from the labor rate bid will be allowed durine each contract Year.
COMMODITY CODE FOR AUTOMOTIVE BODY WORK 92819
1. PASSENGER VEHICLES (AS DEFINED IN THE SPECIFICATION)
Parts shall be provided at crash guide list less Zs- % percent.
Labor shall be provided at $ J per hour.
The estimated crash guide list for parts for evaluating purposes is $11,000 and labor 1,200 hours.
2. TRUCKS (AS DEFINED IN THE SPECIFICATION)

STANDARD LIST USED BY THE APPRAISAL FIRM.
ESTIMATED PARTS AND LABOR AMOUNTS ARE FOR EVALUATION PURPOSES ONLY, ACTUAL AMOUNTS MAY BE
MORE OR LESS THAN THOSE USED FOR EVALUATION.
PICK UP AND DELIVERY:
Bidder must include free pickup and delivery of vehicles, including -flat bedding when required.

Upon return of finished vehicles, operators will remain until the vehicle is inspected and accepted. If it is
determined that the vehicle is not properly repaired, the operator will return the vehicle to Contractor's shop
for repair and deliver at no additional charge.
All vehicles must be returned within 24 hours of completion.

IV. TECHNICAL REQUIREMENTS
Supply all information requested and attach this section to the Bid Form.
Initial each section to verify that specifications are met; enter "N.A." if options or specifications are not
available. All exceptions or equivalencies must be fully explained or documented.
A. General: The intent of this bid is to secure the services of one or more qualified contractors to perform
body repair and/or painting as required for the City of Lubbock.
B. Parts/Materials: All parts/materials used in the performance of this contract must be new and unused
and,, at a minimum, include a 90-day warranty.

1. All repair estimates for service must be free of charge.

calls made after 12:00 p.m., Contractor must be out by 12:00 p.m. the next working day to provide
estimate. Failure to adhere to these response times will eliminate your firm from consideration for

Pursuant to Texas Local Government Code 171.905(b), in purchasing real property or personal property that is not
