RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on behalf of the City of Lubbock, a Section 5310 Grant Amendment, by
and between the City of Lubbock and the Texas Department of Transportation, and
related documents. Said Grant Agreement Amendment is attached hereto and
incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.

AMENDMENT#1
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of
Transportation, hereinafter called the "State", and Lubbock/CITIBUS, City of hereinafter called the "Subrecipient".
WITNESSETH
WHEREAS, the State and the Subrecipient executed a contract on March 25, 2010 to effectuate their agreement to
provide for the expenditure of funds pursuant to the provisions of 49 U.S.C., § 5310, for a transportation project to
provide mass transportation service planned, designed, and carried out to meet the special needs of elderly individuals
and individuals with disabilities; and,
WHEREAS, it has become necessary to amend that grant agreement;
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto,
the State and the Subrecipient do agree as follows:
AGREEMENT
Article 1. Description of Amended Items
The amendment combines remaining Section 5310 apportionment Minute Order 112259 with previous Minute Order
112145. Total reimbursable amount is $50,156 and 0.00 TDC. Attached hereto is the revised project budget and shall
replace the budget included with the above -mentioned Grant.
All other provisions of the original grant agreement are unchanged and remain in full force and effect.
Article 2. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the
organization they represent.
IN WITNESS WHEREOF, THE STATE AND THE SUBRECIPIENT have executed duplicate counterparts to effectuate
this agreement.

# Consider a resolution authorizing the Mayor to execute a Section 5310 Grant
amendment, with the Texas Department of Transportation (TxDOT). (Citibus)
BACKGROUND DISCUSSION:
At the TxDOT Commission Meeting on May 27, 2010, a second allocation of Section
5310 funds was awarded. The City of Lubbock/Citibus was allocated an additional
$28,687 in Section 5310 funds. TxDOT originally awarded $21,469 to the City of
Lubbock/Citibus at the February 25, 2010 Commission Meeting. The total Section 5310
funds awarded to the City of Lubbock/Citibus is $50,156. The grant for the $21,469 in
Section 5310 funds was approved at the June 10, 2010 City Council Meeting.
Section 5310 grant funds are used for preventative maintenance for CitiAccess (Demand
Response Service). The funds from Section 5310 grants are to be used to help provide
mass transportation service planning, designed, and carried out to meet the special needs
of elderly individuals and individuals with disabilities.
FISCAL IMPACT:
The match required for this grant has already been included in the Citibus budget.
Acceptance of this grant will result in no additional cost to the City of Lubbock.
SUMMARY/RECOMMENDATION:
Citibus recommends the approval of the Texas Department of Transportation Section
5310 Grant amendment.

Texas Transportation Commission (commission) takes special note of its designation by the
governor as the administering agency for the Federal Transit Administration (FTA) grant program,
"Formula Grants for Special Needs of Elderly Individuals and Individuals with Disabilities" (49 U.S.C.
§5310), in a letter dated October 4, 2005; and further acknowledges that federal program regulations
require the Texas Department of Transportation (department) to ensure that grant funds are distributed
fairly and equitably within the state.
The United States Congress has passed a Continuing Resolution for a five -month period; the
FTA has available funds for this period. As soon as authorizing legislation covering the remainder of
the fiscal year or a portion of it has been enacted, the additional funds will be made available.
Awards to transit operators are calculated in accordance with the formula in Title 43, Texas
Administrative Code §31.31. The distribution is shown in Exhibit A.
Title 43, Texas Administrative Code, §5.73 establishes the process for which Transportation
Development Credits (TDC) may be awarded at the discretion of the commission. The commission
passed Minute Order 110771, on December 14, 2006, expressing its intent to award TDC that will
promote public transportation capital infrastructure projects: fleet replacement, fleet expansion,
maintenance facilities; and capital projects that support regional coordination.
The commission finds that the projects in Exhibit A are eligible for funding and awards a
total of $3,018,224 in federal Formula Grant funds for Special Needs of Elderly Individuals and
Individuals with Disabilities and 373,135 in TDC. The projects receiving TDC awards will reduce
congestion by improving reliable transit options therebv ,---- 'ng levels of ridership; expand
economic opportunity by increasing �r the transit dependent populations to
jobs and other necessary actin echanical breakdowns; improve air
quality by reducing emission,, bus industry; and increase the value of
the transportation assets by inv. fated rolling stock thus yielding

The Texas Transportation Commission (commission) takes special note of its designation by
the governor as the administering agency for the Federal Transit Administration (FTA) grant
program, "Formula Grants for Special Needs of Elderly Individuals and Individuals with Disabilities"
(49 U.S.C. §5310), in a letter dated October 4, 2005, and further acknowledges that federal program
regulations require the Texas Department of Transportation (department) to ensure that grant funds
are distributed fairly and equitably within the state.
The commission passed Minute Order 112145, on February 25, 2010, awarding the available
portion of the FY 2010 federal §5310 program funds in accordance with the five month continuing
resolution of SAFETEA-LU passed by the United States Congress.
The United States Congress has now passed a continuing resolution of SAFETEA-LU
through December 2010, and the FTA has announced the total available funds for FY 2010 §5310
federal apportionment for Texas. The balance of the FY 2010 §5310 federal apportionment for
Texas, including deobligated funds from previous awards, is awarded under this minute order.
Awards to transit operators are calculated in accordance with the formula in Title 43, Texas
Administrative Code, §31.31. The distributions are shown in Exhibit A.

economic opportunity by increasing the level of service access for the transit dependent populations
to jobs and other necessary activities; enhance safety by reducing mechanical breakdowns; improve
air quality by reducing emissions with technological advances in the bus industry; and increase the
value of the transportation assets by investing in the replacement of depreciated rolling stock thus
yielding savings and efficiencies which can be reinvested into additional trips.

Transportation Code, Chapter 455, assigns a broad spectrum of public transportation roles
and missions to the department.
Transportation Code, Chapter 456, authorizes the commission to administer funds
