Contract For Environmental Engineering Services - 10_11_2004Resolution No. 2004-RO483 October 11, 2004 Item No. 15 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an AMENDMENT TO CONTRACT BETWEEN THE CITY OF LUBBOCK AND ENPROTEC, INC. FOR ENVIRONMENTAL ENGINEERING SERVICES, and all related documents. Said Amendment is attached hereto as Exhibit "A" and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. FURTHER, the City of Lubbock accepts the termination, effective September 1, 2004, of that certain AGREEMENT FOR ENVIRONMENTAL ENGINEERING SERVICES, by and between the City of Lubbock and Compliance Services Group, Inc., dated on or about November 16, 1995. Said termination letter is attached hereto as Exhibit `B" and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council Passed by the City Council this 11th day of October , 2004. FOR ENVIRONMENTAL ENGINEERING SERVICES WHEREAS, pursuant to Contract (the "Original Contract') dated on or about November 9, 1995, the City of Lubbock (the "City") and Enprotec, Inc. ("Enprotec") entered into an agreement whereby Enprotec agreed to perform, and the City agreed to compensate Enprotec for, the services described therein; WHEREAS, the City is in need of additional services relating to environmental engineering not included in the Original Contract; and WHEREAS, the City and Enprotec now desire to include such additional services in the Original Contract under the terms and conditions set forth in the Original Contract. NOW, THEREFORE, for and in consideration of the premises and the mutual covenants herein contained, the City and Enprotec agree to modify the Original Contract as follows: 1. The Original Contract shall be amended by adding "Exhibit A-7", attached to this Amendment to Contract and made a part hereof for all purposes. 2. Except as expressly modified or amended herein, all terms and provisions of the Original Contract shall be and remain in full force and effect as therein written.
