Smallwood - 08/12/2010Resolution No. 2010—RO350 August 12, 2010 Item No. 5.7 RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional Teal property interests for municipal public use and purposes, to -wit: for the Lake Alan 'Henry Pipeline Project, and the City Council of said City finds it in the public interest ,and for public purposes and municipal purposes to proceed with the acquisition of said interests as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement interests in connection with the tract of land further described in Exhibit "A" and attached hereto, be acquired for public purposes and municipal purposes as set forth in the preamble hereof. SECTION 2. THAT the owner of said tract, being E. C. Smallwood, BE offered Through the Right -of -Way Department of the City of Lubbock the amount of $10,597.80 for the purchase of said easement interests and unless accepted forthwith, the City ;Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the real property interests. SMALLWOOD Field Motes describing the centerline of a Sixty -Foot (601 wide permanent pipeline• easement being located in the Northwest Quarter of Section 1247, B.S. & R Survey, Garza County, Texas and said pipeline centerline being described as follows: Beginning at a 1/2" Iron rod with cap, set on the East line of the Northwest Quarter of Section 1247, for the beginning of this description, from whence a 8"x8" Concrete monument found for the Northeast corner of the Northwest Quarter of said Section 1247, bears North 1056'56" East, a distance of 1092.54, Bald point of beginning having a project coordinate of Y = 7175743.71 and X = 1043136.84; Thence North 56955'03" West, along the eenteriine of said Sixty -Foot (601 wide permanent pipeline easement, a distance of 2057.29 feet to a 1/2" Iron rod with cap, set on the South right of way line of a sixty -foot county road, for the end of this description, whence a 4"x4" concrete monument found for the Northwest comer of Section 1247, bears North 1057'53" East, a distance of 30.00 feet and North 88000'49" West, a distance of 879.69 feet.
