Said Contract is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Neal Barron Lubbock Police Department 916 Texas Avenue Lubbock, TX 79401 Subject: Enhancement Proposal (EP) 255115B Property Bar Code T: 925 621 2700 F: 925 621 2799 www.tiburoninc.com Reference: The Master Support Agreement between City of Lubbock and Tiburon, Inc., dated May 26, 2005 Dear Lt. Barron: Tiburon, Inc. is pleased to present the Lubbock Police Department with this Enhancement Proposal for our Property and Evidence Bar Code System. The Tiburon Property Barcode Application (PBA) provides web -based product integration with the Tiburon RMS Property module, with an emphasis on reading and writing barcodes for property and property locations. The PBA: • Supports the use of the Windows 2000, or later, operating system and Microsoft Internet Explorer on PC -based workstations and compatible portable devices. • Allows for all property module functionality that exists in the current version of RMS. • Communicates with the host RMS server utilizing similar technologies and protocols that are currently employed for the existing client/sever applications. • Utilizes the TCP/IP protocol, in a wired and wireless LAN configuration. • Incorporates the use of bar code readers, and possesses the ability to create and print bar code labels for both property items and storage locations. • Incorporates the use of electronic signature pads for capturing signatures during the property movement process. The hardware components shown in Attachment A will also be provided. Price Description Property and Evidence Bar Code System License Fee $15,000 Property and Evidence Workstation License Fee (Qty. 5) $6,000 Pocket Prop Handheld Workstation License Fee (Qty. 3) $1,200 Signature Capture Software Licenses (Qty. 3) $ 285 Training $3,400 Tiburon Services $26,600 Equipment (see Attachment A for detail) $11,049 Total $63,534 The Property and Evidence Bar Code System application is supplied with a one (1) year 9x5 Warranty from cuiover. The Tiburon Annual Maintenance amount will increase by $5,700 annually effective the next maintenance period. The $5,700 will be included with the annual maintenance invoice. This amount may be subject to an annual increase not to exceed 5%. Tiburon Responsibilities 1) Assign licenses as per the "Scope Description." 2) Remotely install the RMS Property Bar Code and Pocket Prop base system components. 3) Provide on -site installation services of the one (1) client -provided fixed workstation and the one (1) client -provided handheld device. 4) Tiburon will provide four (4) hours of onsite training and can be delivered any time during Tiburon's standard business hours (between the hours of 8:00 am and 5:00 pm, Monday through Friday). 5) Tiburon will provide one (1) electronic copy of the bar code documentation (Tiburon standard format and content). 6) Correct any discrepancies in operation, based on client testing (in accordance with Tiburon's baseline Bar Code documentation). Neal Barron Lubbock Police Department Enhancement Proposal (EP)-255115B: RMS Property Bar Code Page 3 of 6 Client Responsibilities 1) Designate a person to be the principal point of contact for all technical questions and administrative arrangements relating to this Enhancement Proposal. 2) Provide VPN access to Tiburon development personnel. 3) Provide a server for barcode application in accordance with Tiburon's specifications. 4) Ensure that the workstation to be used with the bar code application meet Tiburon's specifications for the bar code application. 5) Provide hand held workstations (for the Pocket Prop application) in accordance with Tiburon's specifications. 6) Test the Bar Code System for conformance with Tiburon's baseline Bar Code documentation. 7) Provide a facility for training with a workstation (with a connection to the Tiburon systems) for the instructor and a projection screen. 8) Provide a workstation (with a connection to the Tiburon systems) for each student in the class. 9) Schedule students to attend the training (maximum of eight (8) students). 10) Ensure that scheduled students are able to attend the courses for their complete duration 11) Prepare and have ready all network connections associated with this Enhancement Proposal, including any wireless access points. Completion Criteria This work will be considered complete ten (10) business days after Tiburon has provided the Client with written notification that the Property Bar Code Application is ready for testing in the test system, or the Property Bar Code Application has been placed into production, whichever comes first. If Client does not confum completion with a sign off letter presented by the Tiburon project manager within ten (10) business days of submittal of such letter, or otherwise notifies Tiburon in writing why completion sign -off has not been provided any final invoice(s) will be issued and will be payable in accordance with the payment terms of this Enhancement Proposal. Terms and Conditions 1) Tiburon is not providing any hardware or third -party products. The Client is responsible for providing all hardware and third -party products in accordance with Tiburon's specifications. 2) Payment Schedule: 50% Upon Tiburon receipt of the signed acceptance of this Enhancement Proposal. Neal Barron Lubbock Police Department Enhancement Proposal (EP)-255115B: RMS Property Bar Code Page 4 of 6 50% Upon completion. 3) This work will be scheduled to commence at a mutually agreeable date after Enhancement Proposal acceptance. 4) The terms and conditions of this Enhancement Proposal and the Agreement referenced herein prevail regardless of any conflicting or additional terms on any Purchase Order or other correspondence. Any contingencies or additional terms obtained on any Purchase Order are not binding upon Tiburon. All Purchase Orders are subject to approval and acceptance by Tiburon. 5) This fixed price Enhancement Proposal is valid unless modified by Tiburon in writing prior to Client acceptance of this Enhancement Proposal; otherwise, this Enhancement Proposal will expire on May 31, 2010. 6) By the Client's acceptance of this Enhancement Proposal in the signature blocks provided below, the Client is authorizing Tiburon to proceed with the work described herein and confirms funding will be obligated. Any requisite contractual documents required by the Client's purchasing procedures are the 'responsibility of the Client. 7) The Tiburon Property Bar Code product is the only software application used with Tiburon products to allow for proper functioning in productive use by the City of Lubbock and under the Software License Agreement is Tiburon Proprietary. There are no third -party vendors authorized by Tiburon to provide application software support for this software product. Tiburon, Inc. is the sole qualified and authorized provider of extended support services for its proprietary software products Lt.
