BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed
to execute for and on behalf of the City of Lubbock an Agreement for mowing services by
and between the City and the Texas Department of Transportation, and any other related
documents. Said Agreement is attached hereto and incorporated in this Resolution as if
fully set forth herein and shall be included in the minutes of the City Council.

Dear Mayor McDougal:
The State owns and maintains a system of highways, including FM 2528 in Lubbock
County, Texas for public use and benefit. The City of Lubbock has requested to mow
both sides of the roadway along FM 2528 south of FM 597 for a distance of two miles.
The City of Lubbock has committed to cooperating with the State by mowing this area as
outlined below.
The City of Lubbock will:
A. Be responsible for all individuals working in these areas.
B. Provide for traffic control in accordance with the Texas Manual of
Uniform Traffic Control Devices (TMUTCD) prior to performing any
work on State rights -of -way.
C. Ensure that all necessary safety equipment is provided to personnel
performing work on State rights -of -way.
D. Provide all labor, equipment and supplies necessary for the mowing of
State right-of-way.
E. Mow from the edge of pavement to the ROW line at a height of no less
than 7 inches.
The Texas Department of Transportation will:
A. Perform all other maintenance activities.
This agreement becomes effective when executed (signed) by the State. The Agreement
may be terminated by either party under the following conditions:
1. Upon failure by the City of Lubbock to fulfill its obligations as set forth in
this agreement.
2. By mutual consent and agreement of both parties. A 30 day written notice
is required when terminating by mutual consent and agreement.
3. By either party. A 60 day written notice is required when terminating by
this method.
