HomeMy WebLinkAboutResolution - 2004-R0424 - Change Order To Primary Streets Maintenance Program Contract - 09_16_2004Resolution No. 2004-RO424 September 16, 2004 Item No. 21 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Change Order No. 2 to the 2004 Primary Streets Maintenance Program Contract, attached herewith, by and between the City of Lubbock and Granite Construction Company, and any associated documents, which Change Order shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. VaKiliver, Attorney of Counse 04ChOrRs August 26, 2004 I Resolution No. 2004-RO424 September 16, 2004 Item No. 21 CHANGE ORDER NO.2 TO 2004 PRIMARY STREETS MAINTENANCE PROGRAM WHEREAS, the City Council has approved the 2004 Primary Streets Maintenance Contract as listed in the specifications on January 8, 2004. WHEREAS, the contractor, Granite Construction Company, Inc., agrees to the following changes: (1) That the following items shall be deleted to the 2004 Primary Streets Maintenance Program: The construction of 3rd Street from Avenue M to Avenue P. (2) That Bid Item No. 6 (6" Black Base Patching) shall be decreased by 2,500 square yards. Original Amount of Contract $ 794,292.50 Amount Increased by Change Order No. 1 $ 188,000.00 Contract Total $ 982,292.50 Amount Decreased by Change Order NO. 2 $ 38,000.00 New Contract Total $ 944,292.50 This Change Order represents a 3.9% decrease in the Contract. THIS AGREEMENT WITNESSETH: In consideration of the above listed changes to the 2004 Primary Streets Maintenance Contract, the Owner and the Contractor agree to the herein changes. The aforementioned changes and work affected hereby, are subject to all Contract stipulations and covenants. After performance of a construction contract begins, Change Orders may be approved if necessary to 1) make changes in plans or specifications; or 2) decrease or increase the quantity of work to be performed or materials, equipment, or supplies to be furnished. This does not mean that a department can redefine the project. All work that alters the nature of the thing to be constructed or that is not an integral part of the proiect obiective must be let out for public bid by the Purchasing Department. Description of change (alteration, deviation, addition, or deletion) caused by conditions encountered during construction not covered by the specifications and drawings of the project (attach additional pages if necessary): See attachment A. Change Orders must either be negotiated in the best interest of the City of Lubbock or put out for public bid by the Purchasing Department. Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs, including material quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and overhead. Where certain unit prices are contained in the initial contract, no deviations are allowed in computing negotiated change order costs. The delay will be such that the 2004 Primary Streets Maintenance Program contract with Granite Construction Company will expire before the work can begin. The construction of 3rd Street will take place as part of the 2005 Maintenance Program. This delay will necessitate the reduction of 2,500 square yards of 6" Black Base from Bid Item Number 6.
