HomeMy WebLinkAboutResolution - 2004-R0403 - Resolution Of Partial Paving Release And Quitclaims - 08_26_2004FILE AND a7rURNYQ Resolution No. 2004-RO403 August 26, 2004 ED Bl1CY R-O-VI Item No. 19 PARTIAL PAVING RELEASE RESOLUTION �ry THE STATE OF TEXAS § VOL 93 1ry(P 022 38851 COUNTY OF LUBBOCK § WHEREAS, Resolution No. 2001-RO393 passed by the City Council on October 11, 2001, determined the necessity for making certain street improvements as therein designated, which Resolution was filed as a matter of record in Volume 7705, Page 204 of the Official Real Property Records of Lubbock County, Texas, reference to which record is hereby made for all pertinent purposes; and WHEREAS, the City Council of the City of Lubbock finds and determines that the liens and/or clouds against certain abutting properties created by the filing of such Resolution should be released against such properties as are hereinafter described for the reasons hereinafter stated; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I. THAT the following described properties in Unit Number 2386-005, Frankford Avenue from 82nd Street to 98th Street are hereby released and quitclaimed because no assessments were made against such properties after a public hearing thereon as a result of an independent appraisal showing no property enhancement to wit: The following metes and bounds described property: Beginning at the Southeast corner of this tract which bears North 89 degrees 57 minutes 15 seconds East a distance of 205.00 feet and North 00 degrees 02 minutes 45 seconds West a distance of 65.00 feet from the Southwest corner of Section 26, Block E-2, Lubbock County, Texas, same point lying in the north line of 98th Street; Thence South 89 degrees 57 minutes 15 seconds West along the north line of 98th Street a distance of 120.01 feet to a point of curvature; Thence northwesterly around a curve to the left, said curve having a radius of 30.00 feet, a central angle of 89 degrees 58 minutes 46 seconds, a chord distance of 42.42 feet, tangent lengths of 29.29 feet and an arc length of 47.11 feet to a point of tangency; Thence North 00 degrees 01 minutes 31 seconds West, parallel to the west line of Section 26, a distance of 372.47 feet to the northwest corner of this tract; Thence East along the South line of the alley south of 96t' Street a distance of 150.00 feet to the northeast corner of this tract; Thence South 00 degrees 01 minutes 31 seconds East, parallel to the west line of Section 26 a distance of 402.56 feet to the POINT OF BEGINNING. THAT all of the properties to which this partial release is applicable as hereinabove described are located within the corporate limits of the City of Lubbock, Lubbock County, Texas, and this Release is only applicable to the properties hereinabove specifically described and released. All interests and/or liens not specifically herein released are hereby retained by the City of Lubbock.
