RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on behalf of the City of Lubbock, Contract No. 10666 for pavement
markings at the Lubbock Preston Smith International Airport airfield, by and between the
,City of Lubbock and Ili -Litz Markings, Inc. of Adams Center, New York, and related
documents. Said Contract is attached hereto and incorporated in this resolution as if fully
set forth herein and shall be included in the minutes of the City Council.

INTERNATIONAL AIRPORT AIRFIELD PAVEMENT MARKING (TAXIWAYS) , having carefully
examined the plans, specifications, instructions to bidders, notice to bidders and all other related contract documents
and the site of the intended work, and being familiar with all of the conditions surrounding the construction of the
intended project including the availability of materials and labor, hereby intends to furnish all labor, materials, and
supplies; and to construct the project in accordance with the plans, specifications and contract documents, within the
time set forth therein and at the price stated below.
The bidder binds himself on acceptance of his bid to execute a contract and any required bonds, according to the
accompanying forms, for performing and completing the said work within the time stated and for the prices stated
below.

Bidder hereby agrees to commence the work on the above project on a date to be specified in a written
"Notice to Proceed" of the Owner and to substantially complete the Base Bid Items within forty-five (45)
consecutive calendar days; and to substantially complete the Alternate I Items within an additional twenty-one (21)
calendar days, if Alternate I is awarded; thereafter as stipulated in the specifications and other contract documents.
Bidder hereby further agrees to pay to Owner as liquidated damages for each calendar day in excess of the time set
forth in the general conditions of the contract documents, the following sum of allowed construction time with
liquidated damages; $1,450.00 45 calendar days for substantial completion of Base Bid Items, $1,450.00
21 calendar days for substantial completion of Alternate I Items.
Bidder understands and agrees that this bid submittal shall be completed and submitted in accordance with
instruction number 28 of the General Instructions to Bidders.
Bidder understands that the Owner reserves the right to reject any or all bids and to waive any formality in
the bidding.
The Bidder agrees that this bid shall be good and may not be withdrawn for a period of thirty (30) calendar
days after the scheduled closing time for receiving bids.
The undersigned Bidder hereby declares that he has visited the site of the work and has carefully examined
the plans, specifications and contract documents pertaining to the work covered by this bid, and he further agrees to
commence work on or before the date specified in the written notice to proceed, and to substantially complete the
work on which he has bid; as provided in the contract documents.
Bidders are required, whether or not a payment or performance bond is required, to submit a cashier's check
or certified check issued by a bank satisfactory to the City of Lubbock, or a bid bond from a reliable surety
company, payable without recourse to the order of the City of Lubbock in an amount not less than five percent (5%)
of the total amount of the bid submitted as a guarantee that bidder will enter into a contract, obtain all required
insurance policies, and execute all necessary bonds (if required) within ten (10) business days after notice of award
of the contract to him.

Bidder understands and agrees that the contract to be executed by Bidder shall be bound and include all

Pursuant to Texas Local Government Code
252.043(a), a competitive sealed bid that has
been opened may not be changed for the
purpose of correcting an error in the bid price.
