HomeMy WebLinkAboutResolution - 2003-R0252 - Right Of Way Deed - Robert James Key - 07_10_2003Resolution No. 2003-RO252 July 10, 2003 Item No. 20 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: Whereas, a Right -of -Way Deed exists in Block One (1), Drive In Subdivision, an Addition to the City of Lubbock, Lubbock County, Texas, being a part of that 3,889.60 sq ft tract of land conveyed by Robert James Key to the State of Texas in Right -of -Way Deed recorded in Volume 6197, Page 150, Real Property Records of Lubbock County, Texas and adjoining that tract of land conveyed to Dwarkesh Corporation in Warranty Deed recorded in Volume 6899, Page 193, Real Property Records of Lubbock County, Texas; Whereas, the land specified is no longer needed for the use of citizens as a road; Whereas, a release of the right-of-way would enable an abutting landowner more efficient use of the land; Whereas, the Texas Department of Transportation has made this request of the City of Lubbock. Whereas, the property description for said right-of-way are attached in Exhibits "A" & `B" of this resolution; NOW THEREFORE, BE IT RESOLVED that the City of Lubbock does not interpose any objection for the State to sell and release the said right-of-way to the abutting landowner. FIELD NOTES OF A 0.089 ACRE (3889.60 SF) TRACT OF LAND OUT OF BLOCK 1, DRIVE-IN SUBDIVISION, LUBBOCK COUNTY, TEXAS: BEGINNING at a TxDOT monument, at Station 144+94.26, in the western boundary of 58th Street, located in the southeast corner of TxDOT Parcel No. 59, as recorded in Volume 6197, page 150, Lubbock County Deed Records, for the southeast corner this tract; (1) THENCE N 87°38'00" W, along the northern boundary of 58th Street, 29.92 feet to a found 5/8-inch iron rod at the southwest corner of said Parcel No. 59 and this tract; (2) THENCE N 02°19'02" E, 130.00 feet to a found 5/8-inch iron rod in the northwest corner of said Parcel No. 59 and this tract; (3) THENCE S 87°38'00" E, 29.92 feet to a found 5/8-inch iron rod in the western boundary of Interstate Highway No. 27, at Station 146+19.84, at the northeast corner of said Parcel No. 59 and this tract; (4) THENCE S 02°19'02" W, along the western boundary of Interstate Highway No. 27, 130.00 feet to the Place of Beginning and containing 0.089 acres of land. Access is prohibited across the "Control of Access Line" to the transportation facility from the adjacent property. I, Max W.
