RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on behalf of the City of Lubbock, Change Order No. I to that certain
Contract No. 9413 by and between the City of Lubbock and Archer Western Contractors,
Ltd., for Lake Alan Henry Water Supply Project Pump Stations, Contract D, and related
documents. Said Change Order is attached hereto and incorporated in this resolution as if
fully set forth herein and shall be included in the minutes of the City Council.

"Change Order" means a written order to a Contractor executed by the Owner in accordance with the contract authorizing an
addition to, deletion from, or adjustment or revision of the requirements of the contract documents, or an adjustment to the
compensation payable to Contractor, or to the time for performance of the contract and completion of the Project, or a
combination thereof, which does not alter the nature of the thing to be constructed and is an integral part of the project objective.
Adjustments to "Estimated Quantities" to a line item in a Unit Price contract do not require a Change Order. All work that alters
the nature of the thine to be constructed or that is not an integral nart of the nroiect obiective must be let out for public bid.
Description of change (alteration, deviation, addition, or deletion) caused by conditions encountered during construction
not covered by the specifications and drawings of the project (attach additional pages if necessary):
(1)SCADA remote monitoring capability was requested to monitor the status and power quality of the new 7.5
WA Electrical Substation at Lake Alan Henry. A/W is requesting S48,363 to complete the work. (2)The
power transformers and conduits necessary to operate the wall fans and roof dampers were omitted from the
Lake and Post Booster Pumps Station building. Contractor is requesting S 18,410.70. (3)Portion of a screening
wall at Post Booster Pump Station was deleted from the scope of work. A/W is offering S 10,000 credit.
Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs, including material
quantities, material costs, taxes, insurance, employee benefits, other related costs, profit and overhead. Where certain unit prices
are contained in the initial contract, no deviations are allowed in computing negotiated change order costs.
ITEMIZED COSTS MUST BE FULLY DOCUMENTED AND ATTACHED TO THIS FORM.

Mr. Franklin:
Attached with this letter is documentation for Change Order No. 1. This change order involves the
following items.
1. During design of the Lake Booster Pump Station, it was decided to not remotely monitor the
status / power quality of the Electrical Substation secondary service output to the Lake Booster
Pump Station. During coordination efforts between SGS, Archer Western and City personnel,
the City requested a proposal from Archer Western to provide this remote monitoring through
their sub -contractors. The additional work required to provide this monitoring includes SCADA
configuration and installation of fiber optic and conduit. Archer Western is requesting
$48,363.00 to complete the work.
The following documents are attached to support this change.
RFI-025 with response from Freese and Nichols, Inc. dated September 23, 2010. -
CMR-011 submitted by Archer Western, with response from Freese and Nichols, Inc. dated
June 29, 2011.
CMR-011A submitted by Archer Western, with cost breakdown dated July 21, 2011.
2. During construction, it was discovered that power cable and conduit had not been shown in the
plans to power the actuators on the roof dampers. In addition the actuators for the dampers for
the wall fans did not have a power supply. In order to provide these power supplies, Archer
Western is requesting $18,410.70

• RFI-052 with response from Freese and Nichols, Inc. dated April 8, 2011.
• CMR-012 submitted by Archer Western, with cost breakdown dated July 21, 2011.
3. During construction, it was decided to delete a portion of the screening wall at the Post Booster
Pump Station, as it was not required by the Electric Power Provider. Archer Western offered a
net credit for this deletion of $10,000.00

Subject: CMR 11 — LBPS Pump Station Scada
Dear Mr. Wood:
During our original field coordination meeting with SGS, the owner said that they may want
to monitor the status/ power quality of the Electrical Substation secondary service output to
the LBPS via a fiber optic connection to the LBPS Scada system. This was also addressed
in RFI-025. We have calculated the costs to do this work to be $ 48,363.00. Please note that
on SGS`s portion of the work that their estimate is based on 5 days of commissioning. A
detailed break down and back up of the work related to this change order is included for
your review and approval.

Engineering Proposal for
Substation SCADA Implementation and Testing
SGS Engineering offers the following proposal for requested SCADA implementation change
order at Lake Alan Henry Pump Station Substation. The scope of this proposal includes
connection of all intelligent devices at the substation to the data concentrator (SEL-3530),
programming of all devices to move requested data and controls, internal testing of all SCADA
points and controls within the substation and coordination with Owner's representatives to verify
information and control is present and operational at the Owner's control center.
The data will be moved within the substation transparently and collected in the data
concentrator and then made available to the Owner over Modbus TCP via a fiber optic
connection provided by others.
A 3" PVC conduit will be provided exclusively for fiber installation into the substation control
building, terminating outside the substation fence. Others will provide the balance of the conduit
to the Owner's interface point. Others will install fiber and make all Owner connections to
substation equipment.
The scope of the project with line item estimates of engineering costs. -

During our original field coordination meeting with SGS, the owner said that they may want
to monitor the status/ power quality of the Electrical Substation secondary service output to
the LBPS via a fiber optic connection to the LBPS Scada system. This was also addressed
in RFI-025. We have calculated the costs to do this work to be $ 48,363.00. Please note that
on SGS's portion of the work that their estimate is based on 5 days of commissioning.
Additional break down and back up of the work related to this change order is included for
your review and approval.

Engineering Proposal for
Substation SCADA Implementation and Testing
SGS Engineering offers the following proposal for requested SCADA Implementation change
order at take Alan Henry Pump Station Substation_ The scope of this proposal Includes
connection of all intelligent devices at the substation to the data concentrator (SEL-3530),
programming of all devices to move requested data and controls, internal testing of all SCADA
points and controls within the substation and coordination with Owner's representatives to verify
information and control Is present and operational at the Owner's control center,
The data will be moved within the substation transparently and collected in the data
concentrator and then made available to the Owner over Modbus TCP via a fiber optic
connection provided by others.
A 3" PVC conduit will be provided exclusively for fiber installation Into the substation control
building, terminating outside the substation fence. Others will provide the balance of the conduit
to the Owner's interface point. Others will Install fiber and make all Owner connections to
substation equipment.
The scope of the project with line item estimates of engineering costs:

The "Fan Schedule" on Drawing M-4 specifies Greenheck/SBS supply fans with unit -mounted backdraft
dampers. The "Power Ventilators" specification 15838-2.03F.1. states that the fans are to be furnished
with "gravity shutters".
In approved submittal SD057-15838-001, Greenheck submitted the specified SBS-3H42 fans with VCD-
20 dampers and 24VAC electric actuators. This was missed during Archer Western's review of the data
prior to submitting to the Engineer. When Greenheck was questioned about the why motorized dampers
were being proposed in lieu of the specified gravity dampers, they stated that they will not furnish, nor
warrant, this model of supply fan with gravity dampers that are mounted on the outside (where the fans
are forced to "pull" the shutters open instead of "push" them open).
In order to furnish the specified supply fan model/ arrangement, the manufacturer is requiring the unit -
mounted dampers to be installed with electric actuators (actuators are at no additional cost to the Owner).
However, the "Damper Control Schematic(s)" that are shown in 5/E-16 and 5/E-32 will have to be revised
to show the additional motorized dampers at the fans, and there will be additional costs associated with
the electrical installation.
Please revise schematics as shown in 51E-16 and 51E-32 to reflect the additional motorized dampers at
the supply fans, or provide direction as how we are to proceed as soon as possible.

NOTES;
1. All work on site, is based on working five days a week at eight hours per day, on a straight time basis.
2. Clear and reasonable access must be provided throughout the erection timeline, for hoisting materials and
shuttling trucks, Clear access must be maintained for the crane to advance freely.
3. All work shall conform to the AISC code of standard practice, latest revision, and the PCI Code. No standards
stricter than PCI will apply.
4. Accurate Initial lines and grades must be established and maintained by others. Erection crew will lay out from
established bench marks and column lines.
5. This bid is based on bearing on the slab with tie back connections to the structural steel.
6. One mobilization to the jobsite for personnel and equipment is included in this Quote. Additional mobilizations
will be billed at cost plus overhead to the GC.
7. A sequence and schedule of erection must be signed off prior to production of materials. Any changes in this
schedule may be cause for additional charges.
S. Our production schedule is based on 6 weeks casting and 10 days erection, total for 2 buildings. We would like
to have all submittals approved within 10 weeks of signed contract.
9. We exclude full time, non -working site safety, fire watch and superintendent personnel from this quote. These
positions can be added at a cost plus basis.
10. We exclude Post installation testing or inspection.
11. OSHA required safety protection will be supplied for our trade only.
12. Cleaning w111 be done at the completion of an area. Cleaning will be limited to erection smudges and debris.
13. Cleaning or repair, due to the negligence of other trades will be considered an add and will be billed on a cost
plus basis.
14. This quote excludes stone and/or drainage necessary to establish or maintain access throughout the site_
15. All barricades, street closures, traffic control etc. will be by others.
16. Is per plans and PRECAST CONCRETE specifications provided as of this date. Any exceptions will be noted.

EAGLE PRECAST CORP. must have signed purchase order, notice of furnishings and notice of cornmencernent In our file and two
sets of necessary drawings and spas prior to any drafting or manufacturing.
By signing this quotation you are contracting with us for specially fabricated precast concrete products to be used In the above
referenced project for the above referenced contract price excluding applicable sales tax. A construction schedule is required as
soon as possible. After reviewing the schedule a mutual agreed upon production slot will be set. Drafting and Engineering cost will
be Invoiced on monthly bases. If job is delayed for any reason EAGLE PRECAST reserves the right to proceed with Drafting,
Engineering, & Production of stone and will Invoice for these services on the ZIP of each month with a Net of 30 days.
