Said Agreement is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by the City Council on September 8, 2011 TOM MARTIN, MAYOR ATTEST: Retie ca Garza, City Secretty—) APPROVED AS TO CONTENT: It Quincy Whit6Asststant City Manager APPROVED AS TO FORM: I 4 Chad Weaver, Assistant City Attorney vw:ccdocs/RES.Interlocal Agreement -Lubbock County August 24, 2011 Resolution No. 2011-RO400 STATE OF TEXAS § COUNTY OF LUBBOCK § INTERLOCAL AGREEMENT FOR LIBRARY SERVICES WHEREAS the Commissioners Court of Lubbock County, Texas, hereinafter referred to as "THE COUNTY", has determined that a need exists for the provision of county -wide library services; and WHEREAS, the City Council of the City of Lubbock hereinafter referred to as "THE CITY", has agreed to participate with "THE COUNTY" in order to provide library services for the citizens of Lubbock County; and WHEREAS, this agreement is made pursuant to Chapter 791 of the Texas Government Code; THIS AGREEMENT is made and entered into by and between THE COUNTY and THE CITY in consideration of the mutual benefits to each party to provide library services as specified below: PURPOSE: THE CITY shall use the funds provided to it by THE COUNTY strictly for providing Lubbock County citizens with library services, including, but not limited to, personnel, library materials and resources, maintenance and administrative costs. TERM OF CONTRACT: This contract shall be effective from October 1, 2011 thru September 30, 2012, and shall be automatically renewed each subsequent October 1 thereafter, upon written request of THE CITY to THE COUNTY to continue this agreement. PAYMENTS: Payments to THE CITY shall be made in quarterly installments not later than the 30`" day of each calendar quarter of the contract year. Each party paying for the performance of a governmental function or service must make those payments from current revenues available to the paying party. TERMINATION BY THE CITY: THE CITY shall have the right to terminate this contract upon thirty (30) days written notice to THE COUNTY. A report of library services for the period from the beginning of the contract period through the effective date of the termination shall be submitted to THE COUNTY within 30 days of the effective termination date. Any unspent funds remaining on the effective termination date shall be immediately refunded to THE COUNTY within 30 days of the effective termination date. TERMINATION BY THE COUNTY: Although it is the express intention of THE COUNTY that funding of library services be an ongoing program, THE COUNTY, in circumstances dictated by any future budgetary constraints or change in existing circumstances, reserves the right to terminate this contract at the end of any COUNTY fiscal year. FUNDS ALLOCATION: THE COUNTY will provide for the period October 1, 2011 through September 30, 2012, a total sum of $192,000.00. Fund allocations for subsequent contract periods will be provided by THE COUNTY on or before each October 1, subject to receipt by THE COUNTY of the written request by THE CITY to continue this agreement. Each fund allocation paid by THE COUNTY shall be in an amount equal to six percent (6%) of THE CITY'S total libraries budget. AUTHORIZATION: The Commissioners Court of THE COUNTY has authorized the County judge to execute all documents in its behalf The City Council of THE CITY has authorized the mayor to execute all documents in its behalf. This document constitutes the whole and complete contract by and between the parties and may not be modified in any way except upon the prior written consent of the parties hereto.
