Said Letter of Award is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. A Purchase Order will be issued by the City of Lubbock and covers the category of items shown below, and no other, during the period beginning April 24, 2003 and ending April 23, 2004. The City of Lubbock shall not be responsible for payment of any invoices except those orders placed pursuant to this agreement. 2. Category of Items: Bid Item Unit Price I. Drilling Services 1. Dirt excavation using convention dirt auger on drilling machines with minimum 39,000 Ft. pound torque, 25,700 pound crowd pressure and 35 foot depth. $ 148.50 /hr. 2. Rock excavation using conventional rock augers or core barrels on drilling machines with same minimum specifications as listed above. $ 210.00 /hr. Bid Item Unit Price 3. The City of Lubbock reserves the right to terminate this agreement with a thirty (30) day written notice in the event Deerwood Construction, Inc. fails to perform in accordance with their bid dated March 20, 2003. Where any item called for in the ITB documents is supplemented here, the original requirements, not affected by this addendum, shall remain in effect. Whenever the word Owner's Representative or representative is used in this bid, is shall be understood as referring to, City of Lubbock, or its representative Bobby Schaefer, -Foreman Supervisor, so designated to act in any particular under this agreement. 1. QUESTION: Will this bid be awarded on an ALL or NONE basis? ANSWER: Yes, to be considered for this Project, the City of Lubbock has decided to award Bid Item I on an ALL or NONE basis, as per Section 8 of LPEtL Specifications # DE - 0019 - 01 - 012203. 2. QUESTION: Can the City of Lubbock, install the necessary traffic control signs "barricades and traffic control devices? If not, once we are done drilling how long will it take for the City to set up their own traffic control signs? ANSWER: NO, in the specifications section 5 Traffic Control states: 'The Contractor shaii be responsible for providing all necessary and legally required signs, barricades and traffic control devices. These devices shall be required anytime the Contractor's equipment is operating on a public street or highway. A cost proposal item is requested for installing and removing traffic control devices for a single pole location on a city street and on a state highway." The contractor shall notify the owner's representative once they have completed each individual job site, let it be further understood that completion of each job site consist of the job description as issued to the Contractor. The Contractor will give the owner's representative one (1) week to make the necessary arrangements for the City of Lubbock to install the necessary and legal required signs. In the event that the City of Lubbock fails to install the necessary and legal required signs within one (1) week from the time the owner's representative is notified, the City of Lubbock will reimburse the Contractor for any rental cost incurred thereafter, as long as the Contractors has the proper "invoice or receipts" documentation. Once the owner's representative notifies the Contractor to remove their. necessary and legal required signs, the City of Lubbock will no longer reimburse the Contractor for any rental thereafter for that particular job site. 3. QUESTION: How will the City of Lubbock notify the Contractor of the DIGTESS confirmation order numbers, will they call us or fax the confirmation order numbers? ANSWER: Specifications section 6 Permits: has been changed to read as follows: When construction is occurring on a state highway right-of-way, LPEtL Department will arrange for and secure all necessary highway R.O.W. permits. The Contractor will be furnished.a copy and will be responsible for maintaining a copy of those highway permits on the job site at all times. LPEtL and the City Of Lubbock participate in the Texas One -Call system for preventing damage to buried utility lines. LPEtL's one -call contractor is Texas Digtess. DIGTESS can be contacted at 1- 800-DIGTESS. Contractor will call and arrange for all underground utilities to be located prior to excavation.
