HomeMy WebLinkAboutResolution - 2003-R0094 - Amendment To Contract For Operating Assistance - Txdot - 02_27_2003Resolution No. 2003-R0094 February 27, 2003 Item No. 18 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, an amendment to Contract No. 5130517-1017 for operating assistance, by and between the City of Lubbock and Texas Department of Transportation (TxDOT), and related documents. Said Contract is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. WITNESSETH WHEREAS, the State and the Recipient executed a contract on September 11, 2002 to effectuate their agreement to provide for the expenditure of funds for the purpose of establishing and maintaining public and mass transportation projects and to administer funds appropriated for public transportation under Transportation Code, Chapter 456; and, WHEREAS, it has become necessary to amend that grant agreement; NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto, the State and the Recipient do agree as follows: AGREEMENT Article 71. Description of Amended Items: The Governor, Lt, Governor, and the Speaker of the House have directed the state to reduce its FY 2003 general revenue by an amount equal to at least seven percent. In addition, the state has received an additional amount of oil overcharge funds. These two factors combined result in a net reduction of state funds. Therefore, Article 3A, page 2, sentence 1 is revised to read "The maximum amount payable under this agreement without modification is $1, 216,038. Exhibit A.attached hereto is the revised project budget and shall replace the budget included with the above -mentioned Grant. All other provisions of the original grant agreement are unchanged and remain in full force and effect. Article 2. Signatory Warranty The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the organization they represent. IN WITNESS WHEREOF, THE STATE AND THE RECIPIENT have executed duplicate counterparts to effectuate this agreement.
