RESOLUTION
WHEREAS, the City of Lubbock solicited bids (ITB # 05-102-MA) for, among
other things, a 10,000 pound forklift, (herein so called) for use by the City of Lubbock;
WHEREAS, Section 271.905 of the TEXAS LOCAL GOVERNMENT CODE
provides that if the local government of a municipality with a population of 200,000 or
less receives one or more bids from a bidder whose principal place of business is in the
local government, and whose bid is within three percent (3%) of the lowest bid price
received by the local government from a bidder who is not a resident of the local
government, the local government may enter into a contract with either the lowest bidder,
or the bidder whose principal place of business is in the local government, conditioned
upon appropriate findings of the governing body;
WHEREAS, Associated Supply Company, with a principal place of business
located at 2102 E. Slaton Hwy., Lubbock,. Texas, 79404, is located within the city limits
of the City of Lubbock;
R'HEREAS, Associated Supply Company, submitted a bid to the City of Lubbock
for a contract to supply the forklifts in accordance with the above -referenced ITB # 05-
102-MA, said bid being in an amount that is within three percent (3%) of the lowest bid
price received; and
WHEREAS, the City Council of the City of Lubbock finds that the bid submitted
by Associated Supply Company, offers the City of Lubbock the best combination of
contract price and additional economic development opportunities for the City of
Lubbock and its residents, including the employment of residents of the City of Lubbock
and increased tax revenues to the City of Lubbock; NOW THEREFORE;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City of Lubbock awards Bid # ITB 05-102-MA (the "Bid"), respecting
the property described as a 10,000 pound forklift, as more particularly described in the
Bid (the "Property"), to Associated Supply Company of Lubbock, Texas.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LUBBOCK:
THAT the Purchasing Manager or his/her designee, BE and is hereby
authorized and directed to execute for and on behalf of the City of Lubbock any and all
purchase orders and related documents regarding the purchase of the Property pursuant
to the Bid.
Passed by the City Council this 21 st day of September, 2005.
