RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for
and on behalf of the City of Lubbock and the Lubbock Police Department, an acceptance of the
FY2018 Edward Byrne Memorial Justice Grant Program, by and between the City of
Lubbock and the United States Department of Justice, and the Office of the Attorney General, in
the amount of $181,769.00, of which $90,884.50 will be allocated to the Lubbock Police
Department and $90,884.50 will be allocated to Lubbock County, Texas, pursuant to an
interlocal agreement between the City of Lubbock and Lubbock, County, Texas, and related
documents. Said Acceptance agreement is attached hereto and incorporated in this resolution as
if fully set forth herein and shall be included in the minutes of the City Council.

COUNTY OF LUBBOCK
INTERLOCAL AGREEMENT
BETWEEN THE CITY OF LUBBOCK, TEXAS AND COUNTY OF LUBBOCK, TEXAS
FY2018 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM A WARD
This Agreement is made and entered into this 13th day of September , 2018, by
and between the COUNTY of LUBBOCK, acting by and through its governing body, the
Commissioners Court, hereinafter referred to as COUNTY, and the CITY of LUBBOCK, acting
by and through its governing body, the City Council, hereinafter referred to as CITY, both of
LUBBOCK County, State of TEXAS, witnesseth:
WHEREAS, this Agreement is made under the authority of Chapter 791, TEXAS
Government Code: and
WHEREAS, each governing body, in performing governmental functions or in paying
for the performance of governmental functions hereunder, shall make that performance or
those payments from current revenues legally available to that party: and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of both parties, that the undertaking will benefit the public, and that the
division of costs fairly compensates the performing party for the services or functions
under this agreement: and I
WHEREAS, the CITY agrees to provide the COUNTY $90,884.50 from the JAG award
for the FY2018 JAG LUBBOCK COUNTY JOINT LAW ENFORCEMENT
INITIATIVE PROGRAM; and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate
the JAG funds.
NOW THEREFORE, the COUNTY and CITY agree as follow:
Section 1.
CITY agrees to pay COUNTY a total of $90,884.50 of JAG funds actually awarded to and
received by the CITY.
Section 2.
COUNTY agrees to use $90,884.50 for the FY2018 JAG LUBBOCK COUNTY JOINT LAW
ENFORCEMENT INIT ATIVE Program until September 30, 2019.
Section 3.
Nothing in the performance of this Agreement shall impose any liability for claims against
COUNTY other than claims for which liability may be imposed by the TEXAS Tort Claims Act.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims against CITY
or the COUNTY other than claims for which liability may be imposed by the TEXAS Tort
Claims Act.
Section 5.
Each party to this agreement will be responsible for its own actions in providing services under
this agreement and shall not be liable for any civil liability that may arise from the furnishing of
the services by the other party.
Section 6.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.
Section 7.

By entering into this Agreement, the parties do not intend to create any obligations express or
implied other than those set out herein; further, this Agreement shall not create any rights in any
party not a signatory hereto.

A. Crime Scene I Forensics Equipment and Training
The Lubbock Police Department (LPD) will purchase computer software and
equipment to enhance their capabilities to investigate cybercrimes and other crimes
that are committed utilizing computer and cellphone technology. As technology
advances it is paramount for law enforcement to counter with advanced knowledge,
skills, and equipment. By upgrading the crime scene and forensics equipment
including cybercrimes along with training, it will allow the LPD to stay abreast with
the rapidly evolving world of technology as it relates to solving crimes in order to
better serve the needs of the citizens in our community.

B. GPS Tag, Track, and Locate Technologv Equipment

The Lubbock Police Department will purchase Vehicle-Mounted Tag, Track, and
Locate (TTL) GPS Systems in order to help combat the exponential rise in auto
thefts experienced the past couple years within its jurisdiction. Currently the City
of Lubbock (COL) ranks #2 in the state in Auto Thefts for cities with populations
under 850,000 and #7 for all cities in the state of Texas. The COL currently is
utilizing License Plate Recognition System technology in an attempt to combat
auto thefts; how these are assisting with recovery of stolen vehicles they are not
helpful with apprehension of offenders. The Vehicle-Mounted GPS System will
assist officers in the apprehension and tracking of the offender in the stolen
vehicle. In lieu of engaging in a vehicle pursuit endangering officers and citizens
this equipment will allow officers to track the offender and vehicle mitigating risk
while protecting the community allowing apprehension in a controlled manner.

C. Smartboards for Training Academv
The Lubbock Police Department (LPD) will purchase Smartboards to use in their
classrooms at the LPD Training Academy. The LPD conducts their own in house
24 week training academy for new hires. The LPD also conducts all of their own
TCOLE required training for new and current LPD officers. Replacing outdated
equipment in the classrooms with the Smartboard Technology will enhance the
learning environment and allow for a variety of teaching methods.

D. Fleet Management Svstem and Training
The Lubbock Police Department (LPD) will purchase a Fleet Management
System to provide a more efficient way of tracking our fleet vehicles which
consists of approximately 500 vehicles and trailers. Currently we do not have a
way to track the spare keys that officers and supervisors have access to in the
event a key is Jost, locked in a vehicle, or when a spare vehicle is obtained. An
electronic fleet management system would allow us to account for each key and
the individual who checked the key out. This would provide a more efficient way
to oversee our resources. The LPD Logistics Division is responsible for
maintaining, ordering, repairing, and assigning the police department's fleet. By
providing them with training they will learn more efficient and cost effective
ways to manage the growing fleet of over 500 vehicles, equipment, and trailers.

A. Crash Data Retrieval System

The Lubbock County Criminal District Attorney's Office staffs a certified Crash Data
Retrieval Technician/Analyst and a Crash Data Retrieval System (CDR). This
technician is available to provide state and local law enforcement agencies with
technical and analytical assistance investigating motor vehicle crashes. The CDR
system has proven to be an invaluable tool for accident investigators and prosecutors.
It provides an "unbiased witness" to the event thereby supplementing the
reconstruction process and providing crucial evidence at trial. The equipment and
software are constantly being updated as newer vehicles are manufactured. As a
result, the maintenance of our current CDR system comes at a considerable cost. This
year the system will need to be upgraded to the CDR900. This upgrade is required to
support new communication protocols from current and future vehicle network
systems. The ability to purchase current software, hardware and tools will insure the
future reliability and usefulness of the CDR system. Periodic training is also required
to keep the technician/analyst certified and current with the system upgrades.

B. Digital Forensics Unit
The Lubbock County Criminal District Attorney's Office operates a multi-media
forensics lab. This unit will offer examination of crime related videos and audio files
to all Lubbock County law enforcement agencies as well to agencies and prosecutors
on the South Plains of Texas. Grant funds will be used to equip and maintain the
components of this lab which include infrastructure, computers, monitors, software
and training.

C. Maintain and Upgrade Mobile Infrastructure
The Lubbock County Criminal District Attorney's Office prides itself in being the
most technologically advance prosecutor's office in the region. The Lubbock County
CDA office utilizes an electronic filing system to receive cases from law enforcement
agencies and tries cases using digital courtroom presentations. These presentations
and the data used is mostly accessed by laptop computers and other mobile devices.
As technology advances, the need to upgrade, maintain equipment and infrastructure
is necessary.

D. Digital Video Processing
Perhaps the most pressing issue for the Lubbock County Criminal District Attorney's
Office, and every D.A. Office in America, is the explosion of digital video. Each case
now comes with in car video and the first responders in Lubbock County are now
being equipped with body cameras. This will quickly double the amount of video files
handled by this office. Combined with the dramatic increase in privately owned
surveillance systems, digital video has become one of the most prevalent forms of
evidence used in trial. Not only does this video have to be adapted for proper playing
in court, many of these videos have to be edited or redacted before being allowed to
be played in court. Editing and redacting are often ordered during trial, so having the
proper equipment and software in place is a necessity for today's prosecutor offices.
Also, coordinated efforts between the prosecutor and law enforcement in purchasing
this equipment is must. This requires standard practices and requires the prosecutor to
obtain certain equipment and software for the law enforcement agencies in the
county.

The Lubbock County Sheriffs Office (LSO) will purchase computer hardware,
software and equipment to enhance their capabilities to investigate cybercrimes and
to process crime scenes. With the advancement of technology, criminals are
increasingly using computers and the internet in their efforts. To keep up, it is
paramount to law enforcement to have advanced knowledge, skills and equipment to
counter the sophistication of technology related crimes. By upgrading equipment in
the crime scene unit we are able to more thoroughly document scenes for evidentiary
and investigatory purposes. Additionally we are expanding our crime scene unit and
we will be purchasing a utility body to mount on a new crime scene vehicle. By
upgrading the Cyber Crime and Crime Scene Division equipment and training, the
LSO will continue to stay abreast with the rapidly evolving world of technology.
These upgrades along with the training will ensure the LSO continues to have the
most advanced means to investigate crimes.
