AN ORDINANCE ABANDONING AND CLOSING A 20-FOOT UTILITY a 0
EASEMENT, LOCATED IN TRACT "A," ACUFF HEIGHTS ADDITION, LUBBOCK 2
COUNTY,"TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED 1N THE BODY OF
THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL
MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the City Council finds that the easement hereinafter described in the body
of this Ordinance is no longer needed for easement purposes and for public use; and it would I
be in the public interest to close, vacate and abandon the same for easement purposes and for �..
public use; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement as hereinafter described shall BE and the same is
hereby closed,vacated and abandoned for easement purposes and for public use, such easement
being more particularly described in the attached Exhibit "A" and "B."
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the
official maps of the City of Lubbock to reflect said abandonment and closing, showing the
number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word
of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.

CITY OF LUBBOCK,
LUBBOCK COUNTY, TEXAS
A tract of land containing 0.100 of one acre situated in the City of Lubbock, Lubbock County,
Texas, said 0.100 of one acre being a part or portion out of Tract"A", Replat of Lots 1-3, Block 2,
Acuff Heights Addition, according to the plat thereof recorded in Volume 2834, Page 255, Lubbock
County Official Records, which said 0.100 of one acre also being out of acertain tract conveyed
to A.A. Today, Inc., by virtue of Warranty Deed recorded in Volume 2797, Page 60, Lubbock
County Deed Records, and part obtained by Ordinance No. 9202, recorded in Volume 2834, Page
245, Lubbock County Official Records, said 0.100 of one acre also being more particularly
described as follows:
COMMENCING at a No. 4 rebar found [Northing: 7279213.292, Easting: 949210.846] at the
Northwest corner of Lot 8, Block 12, Williams Tubbs Addition, according to the plat thereof
recorded in Volume 26, Page 50, Lubbock County Deed Records;
THENCE, S 880 10'44" E along the North line of said Block 12, and along the existing South right-
of-way line of 3rd Street, a distance of 668.00 feet;
THENCE, S 010 49' 16" W a distance of 145.00 feet to the Northwest corner [Northing:
7279047.136, Easting: 949873.900] and POINT OF BEGINNING of this herein described tract;
1. THENCE, S 880 10' 44" E a distance of 218.00 feet to a point on the East line of said
Tract "A" for the Northeast corner [Northing: 7279040.208, Easting: 950091.790] of
this tract;
2. THENCE, S 01° 49' 16" W along the East line of said Tract "A", a distance of 20.00
feet to the Southeast corner of said Tract "A" for the Southeast corner of this tract;
